Paying off a mortgage is an impressive milestone.<\/p>\n\n\n\n<p>Now that you have&nbsp;paid off all the debt on your property, your home state&#8217;s law will direct your lender&nbsp;to take certain actions.&nbsp;<\/p>\n\n\n\n<p>The lender will send you&nbsp;a certificate of satisfaction. This certificate, which the lender records in&nbsp;your home&nbsp;county, notifies the public that&nbsp;you have satisfied your&nbsp;obligation, and the lender has removed the lien&nbsp;from your property.<\/p>\n\n\n\n<p>A few details of this process depend on what state your property is in, and whether your debt was secured through a deed of trust.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Mortgage\u2014\u200bor Deed of Trust?&nbsp;<\/h2>\n\n\n\n<p>While the loan you have just paid off&nbsp;is commonly called a mortgage, some states use a deed of trust to secure the debt:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>A mortgage loan exists between two parties: it comes from the bank to the person who buys the home. The mortgage document fully describes all details, terms and conditions of the loan. It explains the principal balance amount, the expected maturity date,\u00a0interest rate information, and the terms by which the owner can pay down the debt.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>The deed of trust is a special\u00a0type of encumbrance\u00a0on the title of the home. It too\u00a0sets forth the details and\u00a0terms\u00a0of the mortgage loan. But unlike the mortgage document, the deed of trust\u00a0designates a\u00a0trustee (often the title company), who actually holds a form of ownership in\u00a0the home until the loan is fully repaid. Yes: the buyer is still considered the\u00a0homeowner. Yet the deed of trust represents a conditional transfer of ownership to the lender. In this way, the trustee is positioned to start a foreclosure\u00a0on the lender&#8217;s behalf\u00a0in the event of the buyer&#8217;s default. This non-judicial foreclosure is cheaper and\u00a0simpler for the lender. The lending institution can\u00a0simply reclaim the property from the trustee, exert its right to\u00a0the title, and thereby avoid what would have been drawn-out judicial foreclosure proceedings against a title holder in default.<\/li><\/ul>\n\n\n\n<p>Once recorded, the mortgage or deed of trust will appear on the title to the home. This is the county&#8217;s public notice that the lender has a lien on your home.&nbsp;<\/p>\n\n\n\n<div class=\"wp-block-columns has-2-columns is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Mortgage States<\/h2>\n\n\n\n<p> In \u201clien theory\u201d states, the buyer agrees to\u00a0a mortgage lien with the bank, with no trustee in the middle. These states use the judicial foreclosure process. Mortgage lien states include: <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Connecticut<\/li><li>Delaware<\/li><li>Florida<\/li><li>Illinois<\/li><li>Indiana<\/li><li>Iowa<\/li><li>Kansas<\/li><li>Kentucky<\/li><li>Louisiana<\/li><li>Maine<\/li><li>New Jersey<\/li><li>New York<\/li><li>North Dakota<\/li><li>Ohio<\/li><li>Pennsylvania<\/li><li>South Carolina <\/li><li>Vermont<\/li><li>Wisconsin<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Deed of Trust States<\/h2>\n\n\n\n<p> Other states are \u201ctitle theory states.\u201d They have provisions for deeds of trust\u2014although they may be simply be called mortgages\u2014with non-judicial foreclosures. These include the District of Columbia, and: <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Alabama<\/li><li>Alaska<\/li><li>California<\/li><li>Colorado<\/li><li>Georgia (which uses the term \u201c<a href=\"https:\/\/www.grec.state.ga.us\/infobase\/table%20of%20contents%20pdf\/Chapter%2039.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">security deed<\/a>\u201d)<\/li><li>Hawaii<\/li><li>Idaho<\/li><li>Massachusetts<\/li><li>Michigan<\/li><li>Minnesota<\/li><li>Mississippi<\/li><li>Missouri<\/li><li>Nebraska<\/li><li>Nevada<\/li><li>New Hampshire<\/li><li>North Carolina<\/li><li>Oregon<\/li><li>South Dakota<\/li><li>Tennessee<\/li><li>Texas<\/li><li>Utah<\/li><li>Virginia<\/li><li>Washington<\/li><li>West Virginia<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Hybrid States<\/h2>\n\n\n\n<p> As it expedites a foreclosure, a deed of trust in lieu of\u00a0mortgage is\u00a0the lender&#8217;s preference where options exist. Meanwhile, a buyer&#8217;s preference\u00a0is the\u00a0standard mortgage.\u00a0Some states allow both mortgages and deeds of trust: <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Arizona<\/li><li>Arkansas<\/li><li>Maryland (although it is primarily a lien state)<\/li><li>Montana (although most single-family loans involve a deed of trust) <\/li><li>New Mexico<\/li><li>Oklahoma<\/li><li>Rhode Island<\/li><li>Wyoming<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Release: What the Lender Does&nbsp;After the Homeowner Pays Off the Mortgage<\/h2>\n\n\n\n<p>It is now time for the lender to release the lien. Within 3 weeks after you fully pay your&nbsp;loan off in&nbsp;California, for example,&nbsp;state law requires the&nbsp;lender&nbsp;to cancel the deed of trust and dismiss the trustee. The lender does this by issuing a&nbsp;deed&nbsp;of reconveyance.&nbsp;Another term for this, in the mortgage situation,&nbsp;is the deed of release of mortgage. It shows that the homeowner&nbsp;has paid for the property, fully&nbsp;satisfying&nbsp;the conditions of the loan.<\/p>\n\n\n\n<p>In Georgia, to take another example, the lender releases the mortgage by returning the original security deed\u2014the cancellation stamped on its face\u2014or a quitclaim deed specifying release or cancellation. <\/p>\n\n\n\n<p>You may get a payment from the lender, returning&nbsp;reserve funds that were held in escrow for&nbsp;property taxes and the homeowner&#8217;s insurance.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Reorganize: What the Homeowner Should Do After Paying&nbsp;the Mortgage in Full<\/h2>\n\n\n\n<p>When the bank no longer has a lien on your home, you own it. Be sure you have the documentation to prove it in a safe place\u2014such as an actual safe.<\/p>\n\n\n\n<p>If you do not&nbsp;receive&nbsp;a&nbsp;certificate of satisfaction within the month, contact&nbsp;your lender to request the documentation. \u200b<\/p>\n\n\n\n<p>Get in touch with the county treasurer&#8217;s office. It should have&nbsp;your up-to-date&nbsp;details. Be ready&nbsp;to pay the property taxes that used to be paid from your escrow account.<\/p>\n\n\n\n<p>Contact your insurance provider, too. Be sure the agency removes the lender from your homeowner\u2019s insurance policy.<\/p>\n\n\n\n<p>And do be sure you are carrying title insurance for your home.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Life After Mortgage: It Has Its Perks<\/h2>\n\n\n\n<p>Whatever the rate you paid on the loan, you are now saving. That&#8217;s a good thing.&nbsp;<\/p>\n\n\n\n<p>Of course,&nbsp;there are sound arguments for bolstering your&nbsp;retirement account before hastening to pay off a&nbsp;mortgage early. But while the performance of an IRA can be unpredictable, saving money by paying off a mortgage is a sure thing. Indeed, the closer you get to&nbsp;retirement age, the more conservatively your financial planner will advise you to invest. Therefore, satisfying a home loan becomes increasingly beneficial over time.\u200b<\/p>\n\n\n\n<p>Pay off the mortgage, and you can also take out a&nbsp;reverse mortgage&nbsp;to help fund a happy retirement.&nbsp;<\/p>\n\n\n\n<p>Life after your mortgage is paid does have its perks.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Congratulations!
