And you\u2019re pretty sure it crossed your property line. Maybe they built a shed over the boundary. Maybe they\u2019re using a part of your land to park equipment, or to drive over.<\/p>\n\n\n\n<p>In some cases, the encroachment isn\u2019t obvious. Then the deed holder wants to build a cottage or a deck, has a survey done, and the issue surfaces. Or maybe it is obvious. So the deed holder seeks a real estate lawyer for research and advocacy, as pricey survey work seems unnecessary. &nbsp;<\/p>\n\n\n\n<p>In any case, the encroachment is real. To begin a resolution\u2026<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Be Generous<\/h2>\n\n\n\n<p>Maybe you don\u2019t mind the encroachment, as long as there\u2019s mutual respect. Options are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.deeds.com\/articles\/the-neighbors-agreement-consenting-to-new-property-lines\/\">Modify the property boundary<\/a><strong> by mutual consent.<\/strong> The law on property lines varies by state, and a lawyer who\u2019s admitted to your state\u2019s Bar can best advise you.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Make a deal.<\/strong> If the neighbor can\u2019t be pried away from that all-important part of your property, perhaps they\u2019d be willing to buy that section of your land. Not only do you want the fair market value, but you also want the neighbor to cover the appraisal, survey, and attorney\u2019s work you\u2019ll need to sell the land and draw up new deeds.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Have your local real estate lawyer draw up a permission letter or an <\/strong><a href=\"https:\/\/www.deeds.com\/articles\/the-different-types-of-easement-deeds-for-real-estate\/\">easement<\/a>.\u00a0This could be the best compromise for all concerned. You\u2019re not saying \u201ckeep out!\u201d Yet the neighbor has formally acknowledged your ownership.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size\" style=\"padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20);padding-left:var(--wp--preset--spacing--20)\"><em><strong>Make your agreement formal. When you\u2019re on record as affirmatively allowing legal access, the neighbor can\u2019t try to stake a claim to the area by using it for years and claiming an interest by <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/articles\/gaining-title-to-property-through-adverse-possession-or-the-myth-of-adverse-possession\/\"><strong><em>adverse possession<\/em><\/strong><\/a><em><strong>.<\/strong><\/em><\/p>\n\n\n\n<p>Often, lawsuits settle out of court. This typically means a compromise where the encroacher pays for the land and covers the property taxes at issue.<\/p>\n\n\n\n<p>Granted, lawyering up against someone you run into all the time is awkward at best. To maintain a good relationship, you might point out that everything needs to be done officially for the sake of future deed holders of the area in question. Documentation simply amounts to good planning.<\/p>\n\n\n\n<p>Now, what if the encroacher refuses to sign any type of formal agreement, yet continues to insist on access?<\/p>\n\n\n\n<p>In that case\u2026<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Be Protective<\/h2>\n\n\n\n<p>Is the neighbor engaged in a flat-out attempt to usurp your land? Do the neighbor\u2019s actions or words suggest such an expectation? Time to warn your pushy neighbor to move off. You might decide to put up a row of hedges or fencing. (Check your local ordinances; they could, for example, forbid your neighbor from damaging trees.)<\/p>\n\n\n\n<p>But avoid moving the neighbor\u2019s items without first obtaining the advice of a lawyer. A lawyer often begins by writing a \u201ccease and desist\u201d letter with a deadline.<\/p>\n\n\n\n<p>Some disputes can\u2019t be settled, even if both sides are trying. That\u2019s when a court can step in, examine the situation, state laws, and local rules, and hash out an order that everyone must follow, now and in the future. In some cases, legal action is the only way to recover the money you spend on property restoration.<\/p>\n\n\n\n<p>Remember to contact your title company and your mortgage lender first. Find out whether title insurance policies from either source can help you pay the cost of a legal action.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size\" style=\"padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--20);padding-bottom:var(--wp--preset--spacing--20);padding-left:var(--wp--preset--spacing--20)\"><em><strong>Got a <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/articles\/homeowners-associations-an-hoa-boards-effect-on-your-property\/\"><strong><em>deed to a condo unit<\/em><\/strong><\/a><em><strong>? Encroachment is rarely an issue when you own only what\u2019s within \u201cthe four walls.\u201d When disputes arise, turn to the condo association\u2019s governing documents for relevant rules that may apply to unit owners, management, and the board. If necessary, consult a lawyer experienced in condo law.<\/strong><\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Be Compliant<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full is-style-rounded is-style-rounded--2\"><img loading=\"lazy\" decoding=\"async\" width=\"1013\" height=\"606\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/05\/be-protective.webp\" alt=\"\" class=\"wp-image-6498\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/05\/be-protective.webp 1013w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/05\/be-protective-300x179.webp 300w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/05\/be-protective-768x459.webp 768w\" sizes=\"auto, (max-width: 1013px) 100vw, 1013px\" \/><\/figure>\n\n\n\n<p>You might start by reviewing the <a href=\"https:\/\/www.deeds.com\/articles\/real-estate-legal-descriptions-for-deeds\/\">legal description<\/a> of your property, spelled out on your deed. Check the current version of all documents to know your lot\u2019s exact measurements.<\/p>\n\n\n\n<p>Working things out amicably might involve putting a barrier up along the boundary line so there are no further misunderstandings. Do your local zoning rules permit its installation?<\/p>\n\n\n\n<p>If you\u2019re thinking of installing fencing to benefit both deed holders, check with your township for the form to make a&nbsp;<a href=\"http:\/\/www.whitehalltownship.org\/forms\/fence_line_agree.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">fence line agreement<\/a> that you can maintain jointly. You\u2019ll need to submit an up-to-date property survey report as an enclosure with your form. The fence must match the borderline in the current survey. It must meet local construction standards.<\/p>\n\n\n\n<p>Check your local rules for having your submissions notarized and filed with your home county\u2019s recorder of deeds. The recorder of deeds establishes a public notice of every significant agreement affecting your ownership rights.<\/p>\n\n\n\n<p>But wait\u2026 What if you\u2019re not in agreement? Do you still have reason to think your neighbor is overstepping boundaries or placing things over established setbacks?<\/p>\n\n\n\n<p>To be sure, contact your code enforcement department. Especially as setbacks prevent <a href=\"https:\/\/www.deeds.com\/articles\/the-water-log-a-deed-holders-intro-to-storm-runoff\/\">stormwater runoff<\/a> issues for local governments, officials may step in on your behalf.<\/p>\n\n\n\n<p>If your neighbor is dumping or storing anything hazardous on your property, don\u2019t just let it go. Don\u2019t let your inaction turn you&nbsp; into the one who\u2019s out of compliance. Your state\u2019s environmental conservation department can inspect a hazard. If your neighbor\u2019s activities are contaminating the ground, penalties are serious.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Be Knowledgeable<\/h2>\n\n\n\n<p>Imagine that the people next door claim their&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/the-property-survey-do-you-need-one\/\">land survey<\/a>&nbsp;proves they are <em>not<\/em> encroaching. Are the people next door misreading the survey?<\/p>\n\n\n\n<p>Or could you have mismatched surveys? If not, who is wrong about the boundaries?<\/p>\n\n\n\n<p>This mystery must be solved. And solving it starts with a trip to the file cabinet containing your deed and other real estate documents. Go through that paperwork to find your property survey. That document will indicate who must back off.<\/p>\n\n\n\n<p>Now, if you opted at closing to pay a one-time premium and receive a policy for owner\u2019s title insurance, find that paperwork. If you got the standard policy, and something was installed over your property line before your closing, then your policy (or the surveyor\u2019s) might cover the costs of resolving an encroachment problem.<\/p>\n\n\n\n<p>The possibility of boundary line fiascos can prompt people to buy&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/home-buyers-cover-your-assets-choosing-between-standard-and-extended-title-insurance\/\">enhanced title insurance<\/a> policies. Enhanced (also called extended) policies cover issues arising during the course of ownership \u2014 not just what was already there on closing day.<\/p>\n\n\n\n<p>If the title insurance does cover borderline issues, the policy holder may file a claim on the policy.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Be Diligent<\/h2>\n\n\n\n<p>Encroachment laws vary by state, and apply differently for each specific dispute. Running into these matters teaches us a lot about our deeds and surveys \u2014 sometimes more than we ever wanted to know!<\/p>\n\n\n\n<p>But it\u2019s important to address them head-on. Title issues just get worse if people improve or keep using disputed land.<\/p>\n\n\n\n<p>Finally, a reminder that this article is not a substitute for legal advice.
