At this time, everything discussed here is <em>alleged<\/em>. The case has yet to be decided.<\/p>\n\n\n\n<p>Ohio Attorney General Dave Yost has filed the suit. Yost claims UWM Holdings \u2014 doing business as United Wholesale Mortgage \u2014 steers hopeful borrowers to UWM\u00ae mortgages. UWM, says the lawsuit, doesn\u2019t shop around for the customers and save people money, as its advertising promises. Instead, says Yost, its network of brokers steers the business right back to UWM, which then charges borrowers more than competitors would.<\/p>\n\n\n\n<p>Yost has declared: \u201cThis predatory business practice has no place in Ohio.\u201d<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">What the Filing Says: A Sampling of Allegations<\/h2>\n\n\n\n<p>A.G. Yost\u2019s lawsuit is now in the Common Pleas Court for Montgomery County, Ohio. It can be seen on the <a href=\"https:\/\/www.ohioattorneygeneral.gov\/Files\/Briefing-Room\/News-Releases\/2025-4-16-UWM-Complaint-Filed.aspx\" target=\"_blank\" rel=\"noreferrer noopener\">Attorney General\u2019s website<\/a>.<\/p>\n\n\n\n<p>It seeks compensation for affected mortgage borrowers and a court order requiring the company to comply with Ohio law. Ohio also seeks $25,000 in civil penalties for<em> each<\/em> unfair or deceptive activity.<\/p>\n\n\n\n<p>According to Dave Yost\u2019s extremely long and detailed filing, United Wholesale Mortgage:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Is Ohio\u2019s largest wholesale mortgage lender.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Regularly and publicly promises customers that it sources loans from independent brokers in order to dig up the best rates for borrowers.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Praises the ability of its brokers to independently shop from multiple lenders, making the wholesale option more supportive to borrowers than retail. The claims that UWM\u2019s network of brokers save people money by seeking out lenders with the best offers is false. Thus, says the Ohio legal filing, \u201cthousands of Ohio homebuyers have been duped.\u201d<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Has \u201ccorrupted a large swath of brokers and turned them into the functional equivalent of retail \u2018loan officers\u2019 loyal to a single lender, UWM.\u201d<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Generates marketing statements that its brokers must use verbatim. These marketing materials \u201camplify UWM\u2019s own public misrepresentations\u201d that its network of brokers will work independently to benefit customers.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Does not disclose to the public that it supplies the \u201cindependent\u201d brokers\u2019 marketing materials.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Expects the brokers to steer applicants back to its own mortgages. UWM mortgages are nearly always more costly for the customers. The average Ohio UWM borrowers\u2019 loan origination cost $1,016 more in 2023 than competitors\u2019 offerings.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Does not offer lower interest rates to offset higher costs.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Expects brokers to agree <em>not<\/em> to shop for loans for customers. Expects brokers to withhold low-priced findings from customers. Brokers thus withhold information from borrowers about better offers from UWM\u2019s main competitors, such as Rocket Mortgage\u00ae.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Take action against brokers who stray from the expectations. These brokers are penalized, sued, or cut out of the network. In this way, UWM gets 99% of the brokers\u2019 business redirected to itself.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Uses the website <em>FindAMortgageBroker.com<\/em> and its search function to point potential customers to brokers that steer the most loans to UWM. This rewards complicit brokers by increasing their flow of customers and revenue.<\/li>\n<\/ul>\n\n\n\n<p>There are other allegations as well. For example, that the company \u201cfrequently flies corrupted brokers to its campus in Pontiac, Michigan\u201d for conventions, courses, and events, which often include \u201clavish meals and live entertainment, all at UWM\u2019s expense.\u201d<\/p>\n\n\n\n<p>Thereby, alleges the Ohio Attorney General, UWM has broken several Ohio consumer-protection and anti-corruption laws, including Ohio\u2019s Residential Mortgage Lending Act and its Corrupt Practices Act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Ohio Wants the Public\u2019s Input<\/h2>\n\n\n\n<p>In the filing\u2019s own words, \u201cUWM does everything in its power to ensure that the mortgage brokers in its network are anything but \u2018independent.\u201d The filing explains further:<\/p>\n\n\n\n<p><em>Through a pattern of misrepresentations, deception, and unlawful inducements, UWM and loyalist brokers have conspired to funnel Ohio consumers into purchasing UWM home mortgage loans, which are materially more expensive than readily available alternatives\u2026As a result, UWM and its loyalist brokers have pilfered millions of dollars from the pockets of Ohio families.<\/em><\/p>\n\n\n\n<p>UWM has issued hundreds of millions of dollars\u2019 worth of mortgages in Ohio. Thousands of unsuspecting borrowers, according to the court filing, have been &nbsp;\u201censnared in UWM\u2019s scheme.\u201d This is why the Ohio A.G. wants United Wholesale Mortgage to be fined and forced to pay compensation for the borrowers\u2019 losses. If Ohio\u2019s lawsuit succeeds, the court will also issue civil penalties, and an order that the company must comply with state laws.<\/p>\n\n\n\n<p>Meanwhile, Ohio is asking the public to submit consumer complaints against UWM, using the email address UWMOhioComplaints@bsfllp.com.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">UWM<sup>\u00ae <\/sup>Denies State\u2019s Allegations<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"342\" height=\"167\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/06\/uwm-denies-states-allegations.png\" alt=\"\" class=\"wp-image-6580\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/06\/uwm-denies-states-allegations.png 342w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/06\/uwm-denies-states-allegations-300x146.png 300w\" sizes=\"auto, (max-width: 342px) 100vw, 342px\" \/><\/figure>\n\n\n\n<p>The Michigan-based lender denies the allegations. The company says it will fight Ohio\u2019s claim to the fullest extent of the law.<\/p>\n\n\n\n<p>UWM insists:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The court case is a \u201cPR stunt\u201d by the Attorney General.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>UWM had no prior warning that Ohio considered the company in breach of state law.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Brokers are within their legal rights to send most, even all, of their customers to one lender.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Yost is rehashing allegations made in a 2024 filing by a law firm working with a hedge fund. A spokesperson for UWM said investment groups coordinated a smear campaign against UWM, then shorted UWM stock before releasing a scathing report, gaining financially from UWM\u2019s subsequent stock price drop.<\/li>\n<\/ul>\n\n\n\n<p>UWM communicated with <em>Scotsman Guide<\/em>, a data firm providing informational tools to mortgage originators, declaring all of the above. The company told <em>Scotsman Guide<\/em> it stands by the \u201cthousands of independent mortgage brokers who serve the unique needs of borrowers across the country.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Success\u2014At What Cost, Ohio Asks (And Who\u2019s Footing the Bill?)<\/h2>\n\n\n\n<p>Since 2020, UWM\u00ae has been the largest wholesale lender in the industry, says A.G. Yost\u2019s court filing. Since then, UWM has become \u201cthe largest mortgage lender overall \u2014 retail or wholesale \u2014 accounting for more than $107.9 billion of mortgage originations annually.\u201d But the company achieved this top-notch status, says A.G. Yost, through methods \u201cwidely regarded as brazenly aggressive.\u201d<\/p>\n\n\n\n<p>If Ohio is right, this company is sabotaging the very reason customers want a wholesale option.
