The quitclaim&nbsp;allows separating partners to\nfollow a court\u2019s direction and leave one party as sole owner of the marital\nhome. Quitclaims might seem convenient in other circumstances, but they are\nrarely the best choice.&nbsp;<\/p>\n\n\n\n<p>In contrast to\nthe&nbsp;<a href=\"https:\/\/www.deeds.com\/warranty-deed\/\">warranty deed<\/a>, a quitclaim deed offers no assurances of\nclear title.&nbsp;In most jurisdictions&nbsp;a recorder of deeds must simply\nrecord a quitclaim deed; it is not the recorder\u2019s role to investigate the\ncircumstances of the conveyance.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.deeds.com\/articles\/the-quitclaim-deed-and-fraudulent-real-estate-transactions\/\">Scammers may take advantage of the quitclaim\u2019s\nsimplicity<\/a>&nbsp;to siphon equity\nfrom vulnerable people. After recording a quitclaim, a bad actor may&nbsp;sell\nthe property with no guarantees, rent it under false pretenses, or exploit its\nunderlying value as collateral.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Spot the Mortgage Relief Scam<\/h2>\n\n\n\n<!--more-->\n\n\n\n<p>The quitclaim may be the deed of choice for&nbsp;<a href=\"https:\/\/www.makinghomeaffordable.gov\/get-answers\/pages\/get-answers-how-avoid-scams.aspx\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">scammers preying on people struggling to make their mortgage payments<\/a>, too. There are a number of well-worn tricks. Tricksters&nbsp;scour the public foreclosure notices, find their targets, and then write to specific homeowners. Others advertise more widely, with &#8220;Stop foreclosure!&#8221; notices. The con artist or fake company might claim to be&nbsp;a \u201cforensic auditor\u201d or a bank.&nbsp;Some scammers say they are affiliated with the government. Many tout a money-back guarantee.<\/p>\n\n\n\n<p>They might have the\nhomeowner sign papers to get a modified loan, supposedly to reduce the monthly\nmortgage payment. Buried in the middle of the paperwork is an agreement to\ntransfer the title.<\/p>\n\n\n\n<p>Other shady actors\ntell distressed homeowners outright to quit their interest on the titles and\nbecome renters to buy back their homes later, after building better credit.\nSoon,&nbsp;the residents may&nbsp;face unmanageable rent increases\u2014after\nplacing their homes in a villain\u2019s hands.<\/p>\n\n\n\n<p>Other ploys persuade\nowners to sign quitclaim deeds, move out, and await a promised portion of the\nhome sale proceeds. Then the manipulators let&nbsp;the home foreclose, while\nrenting it out or otherwise exploiting its value. The duped owners have given\naway their interests in the real estate\u2014but kept their mortgage debts.<\/p>\n\n\n\n<p>A homeowner who needs a loan modification or other mortgage assistance should call the current mortgage lender directly and ask for options. The government may offer&nbsp;<a href=\"https:\/\/www.consumer.ftc.gov\/articles\/0187-when-paying-mortgage-struggle\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">other workable foreclosure relief options<\/a>.<\/p>\n\n\n\n<p>Note that the Mortgage\nAssistance Relief Services (MARS) Rule directs mortgage assistance companies\nto&nbsp;state the client\u2019s total fees up front. The rule bars companies from\ntaking fees before an owner gets an offer from a real lender\u2014and accepts it.<\/p>\n\n\n\n<p>A different standard\napplies to lawyers. A lawyer offering genuine legal assistance can require a\nfee up front. The lawyer must be licensed in the homeowner\u2019s state and must\ndeposit the homeowner\u2019s payments in a client trust account. The lawyer may\nwithdraw the client\u2019s money only when completing legal services, and must\nnotify the client of every withdrawal from the trust account. Homeowners should\ncarefully research the credentials of mortgage relief providers that hold\nthemselves out as legal professionals.<\/p>\n\n\n\n<p>Bottom line:\nlegitimate mortgage assistance businesses do not require the homeowner to\nconvey an ownership interest. &nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quitclaims Are Not an Alternative to&nbsp;Probate<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"420\" height=\"500\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2023\/12\/quitclaims-are-not-an-alternative-to-probate-1.png\" alt=\"\" class=\"wp-image-3544\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2023\/12\/quitclaims-are-not-an-alternative-to-probate-1.png 420w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2023\/12\/quitclaims-are-not-an-alternative-to-probate-1-252x300.png 252w\" sizes=\"auto, (max-width: 420px) 100vw, 420px\" \/><\/figure>\n\n\n\n<p>Many parents hope to transfer a home to their adult children. A quitclaim deed may seem easy. Yet the Internal Revenue Service takes a hard look at parent-to-child property transactions.&nbsp;The IRS imposes a&nbsp;<a href=\"https:\/\/www.irs.gov\/forms-pubs\/about-form-709\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">gift tax<\/a>&nbsp;on real estate with a higher fair market value than the permitted annual exemption. Moreover, a quitclaim giveaway means the child gets the property at the value the parent paid. A beneficiary to the will, in contrast, gets a \u201cstepped up\u201d cost basis\u2014which means relief from ultimately large capital gains taxes.<\/p>\n\n\n\n<p>Some parents have\ngiven deeds to children or other relatives to hold \u201cin case something happens\nto me\u201d\u2014that is, to save and record after the homeowner\u2019s death.&nbsp;Risks\nabound in this form of casual estate planning.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Unrecorded deeds disappear.<\/strong> Deeds can get lost or forgotten, or wind up in an adult child\u2019s safe. Parents with good reasons to change their minds later about the gift cannot do so. Passing a deed for someone to hold means giving away choice.<\/li>\n\n\n\n<li><strong>Undelivered deeds are recipes for confusion.<\/strong> A quitclaim that someone holds onto is an uncompleted gift. The estate must determine if the homeowner met      delivery of deed requirements, and satisfied all state law provisions. Thus, the probate court will still face a duty to oversee the home&#8217;s disposition\u2014the quitclaim deed itself may have expired when the homeowner did.<\/li>\n\n\n\n<li><strong>Deeds &#8220;to hold&#8221; get recorded anyway.<\/strong> On the other hand, the adult child might record the deed before the parent\u2019s death to ensure its validity. Then the parents risk losing the homestead exemption on their taxes. Even if the recipient holds onto the deed, a later attempt to record the deed could subject the property to an unexpected tax bill that will have to be paid or fought in court. This does not even get into possible ramifications for fraud, where homeowners have listed the home as an asset when applying for and claiming benefits\u2014yet have also created an undisclosed deed.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Alternative Estate Planning Options<\/h2>\n\n\n\n<p>As for documents that\navert probate, consider: &nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>A Declaration of Trust.&nbsp;<\/strong>The parent can use this document to create the trust, and convey real property into it through a transfer deed.<\/li>\n\n\n\n<li><strong>A Revocable Living Trust.&nbsp;<\/strong>Directions in a streamlined, &#8220;pour-over&#8221; will can move property into the trust that the owner did not yet put into it while alive. <\/li>\n\n\n\n<li><strong>The Transfer on Death Deed.<\/strong>&nbsp;The&nbsp;<a href=\"https:\/\/www.deeds.com\/transfer-on-death-deed\/\">TOD (transfer on death) deed<\/a> includes a legal description of the property and designates a named person or persons (and backups, in case of death of the named persons) to receive property upon the owner\u2019s death. In states that allow it in the real estate context, the TOD deed is a simple solution. This revocable deed\u2014signed by the grantor, notarized and      recorded\u2014expressly takes effect on death. When beneficiaries present the owner\u2019s death certificate to the county, they receive the property, and become responsible for any debts and obligations on the home.<\/li>\n<\/ul>\n\n\n\n<p>An\nunwilling&nbsp;beneficiary is free to&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/refusing-to-accept-a-deed\/\">refuse&nbsp;a&nbsp;deed<\/a>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Every Estate Plan Is Unique<\/h3>\n\n\n\n<p>Avoiding probate,\nwhile usually desirable, is not essential for everyone. A will containing\nexplicit directions can serve to transfer a&nbsp;home effectively, befitting an\noverall estate plan.
