It puts the title to a home in your hands. And, like most possessions, the title to your real estate can be insured.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Does Every Home Have Title Insurance?<\/h2>\n\n\n\n<p>No. But if you finance a home with a mortgage, the home becomes collateral for a lender. So, you must pay for title insurance at closing so your <em>lender<\/em> is covered against unknown title flaws.<\/p>\n\n\n\n<p>This means as long as there\u2019s a mortgage, there\u2019s title insurance. But the beneficiary is the lender. The borrower doesn\u2019t get protection from a lender\u2019s policy.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Why Does a Mortgage Lender Get Title Insurance on My Home?<\/h2>\n\n\n\n<p>By ordering title insurance, lenders protect themselves against risks such as liens that might not have been exposed during the title search. Liens signify unpaid debts or fees \u2014 obligations left unresolved from the course of a prior ownership, attached to the title. These obligations relate to things like past property taxes, homeowners\u2019 association fines, or construction companies\u2019 claims.<\/p>\n\n\n\n<p>Similarly, old court judgments might have been left unresolved. Or some lost heir, or maybe a business, could have a claim to the property.<\/p>\n\n\n\n<p>A lot can happen in the history of deeds. Once in a while, the normal title search process misses something important.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">So, When I Pay Off the Mortgage, My Home No Longer Has Title Insurance?<\/h2>\n\n\n\n<p>If the only policy you get at closing is <em>lender&#8217;s title insurance<\/em>, then that\u2019s true. A lender\u2019s policy is only good to the extent that there\u2019s a balance on your loan.<\/p>\n\n\n\n<p>Once you pay off your entire mortgage, your home no longer has title insurance.<\/p>\n\n\n\n<p>Because the beneficiary of a lender&#8217;s title policy is\u2026 the lender.<\/p>\n\n\n\n<p>You need to know this when you first finance the home you\u2019re buying. You do have an opportunity at closing to get an additional policy \u2014 one that will protect the home beyond the span of a mortgage. More on this in a moment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">I\u2019m Not Thrilled About Covering the Lender. Can I Get Out of Paying for a Lender\u2019s Policy?<\/h2>\n\n\n\n<p>Probably not. (But see more details below, where we discuss exceptional states.)<\/p>\n\n\n\n<p>Now, it\u2019s possible that the seller will cover the title insurance for you. Ask your real estate agent or title company what\u2019s normal in your state.<\/p>\n\n\n\n<p>Ultimately, of course, you\u2019re buying the home and covering the lender\u2019s costs. So, all things considered, most mortgage companies do expect buyers to cover a lender&#8217;s title insurance policy. Their loan, their terms!<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">As a Deed Holder, Can I Get Title Insurance That Covers <em>My<\/em> Risks?<\/h2>\n\n\n\n<p>Yes. Consider getting an <em>owner\u2019s title insurance policy<\/em>. It just takes a one-time premium, paid at closing. Check out the price of the title&nbsp;insurance you might expect for a given home\u2019s location with this&nbsp;<a href=\"http:\/\/facc.firstam.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">calculator<\/a>&nbsp;from California-based First American Title<sup>TM<\/sup>, the largest U.S. title company.<\/p>\n\n\n\n<p>Unless you are buying into a place where the state regulates pricing, you\u2019re free to <a href=\"https:\/\/www.deeds.com\/articles\/buying-a-home-should-you-pick-your-own-title-insurance-policy\/\">shop around for title coverage<\/a> from a company licensed in the state. But note that you\u2019d normally get a discount on a bundle if both the lender\u2019s and owner\u2019s policies come from the same company. Expect the title research and insurance policy bundle to cost up to 1% of the price of the home.<\/p>\n\n\n\n<p>Let your real estate agent know early in the house-hunting game if you plan to work with an insurer of your choosing.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How Will Insurance Protect My Deed?<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full is-style-rounded is-style-rounded--2\"><img loading=\"lazy\" decoding=\"async\" width=\"600\" height=\"400\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/07\/how-will-title-insurance-protect-my-deed.webp\" alt=\"\" class=\"wp-image-6678\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/07\/how-will-title-insurance-protect-my-deed.webp 600w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/07\/how-will-title-insurance-protect-my-deed-300x200.webp 300w\" sizes=\"auto, (max-width: 600px) 100vw, 600px\" \/><\/figure>\n\n\n\n<p>Owner\u2019s title insurance covers the deed holder against the cost of resolving a significant title flaw. Say a company or agency filed a lien against your home, but you weren\u2019t aware when you bought the home. The title insurer protects you in case of legal action from that entity.<\/p>\n\n\n\n<p>Owner\u2019s title insurance will cover your interests as long as you hold the deed. Your heirs, when they hold the real estate, can even make claims.<\/p>\n\n\n\n<p>Usually this policy covers the entire property value. You can ask your insurance agent about coverage that accounts for inflation of your home\u2019s value over time.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Is the Coverage Only for Past Defects That Weren\u2019t Discovered?<\/h2>\n\n\n\n<p>Title insurance covers undisclosed restrictions on how you may use your property, or unknown liens and easements. It\u2019s a hedge against surprise claims \u2014 say, from some earlier owner\u2019s heirs. But what about a defect that shows up after you buy? For that, it all depends on whether you choose a <em>standard policy<\/em> or an <em>extended policy<\/em>.<\/p>\n\n\n\n<p>An extended owner\u2019s title policy covers issues left by long-ago foreclosures, survey inconsistencies, more types of easements and liens, breached agency regulations from the past \u2014 even certain zoning problems. But it goes further, covering the deed holder in cases of scams, fraud, and post-policy forgery. <a href=\"https:\/\/www.deeds.com\/articles\/hey-back-off-when-an-encroaching-neighbor-wants-a-piece-of-your-property\/\">Encroachments after your purchase<\/a> may also be covered. Always discuss coverage with the company to understand what\u2019s covered, what\u2019s not, any deductibles, and what endorsements you might need.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size\" style=\"padding-top:var(--wp--preset--spacing--40);padding-right:var(--wp--preset--spacing--40);padding-bottom:var(--wp--preset--spacing--40);padding-left:var(--wp--preset--spacing--40)\"><em><strong>A survey can prevent a whole lot of what extended policies cover! <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/articles\/your-homes-measurements-differ-from-the-description-now-what\/\"><strong><em>Surveys point out \u00a0features that may impact your property as described on your deed<\/em><\/strong><\/a><em><strong>. But not all physical issues have fixes \u2014 especially in this time of climate challenges.<\/strong><\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">I Heard There are Special Rules in Certain States?<\/h2>\n\n\n\n<p>Yes. Some states regulate pricing. Florida, New Mexico, and <a href=\"https:\/\/www.tdi.texas.gov\/tips\/title-insurance.html\">Texas<\/a> are examples. Check out the states\u2019 websites to decide whether you need to shop around, even where title insurance costs have caps.<\/p>\n\n\n\n<p>Iowa home buyers receive state protections. For most primary residences, a super-low fee covers complete title research and coverage. And most endorsements are free. Read all about <a href=\"https:\/\/opportunityiowa.gov\/housing\/iowa-title-guaranty\" target=\"_blank\" rel=\"noreferrer noopener\">Iowa title protection<\/a> on the state\u2019s new, dedicated webpage.<\/p>\n\n\n\n<p>Bonus: Iowa uses proceeds to fund <a href=\"https:\/\/opportunityiowa.gov\/about\/iowa-finance-authority\" target=\"_blank\" rel=\"noreferrer noopener\">initiatives that keep people housed<\/a>. Nice job, Iowa.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why Can\u2019t <em>All <\/em>State Governments Stand Behind Their County Deed Records?<\/h2>\n\n\n\n<p>Missing title defects should become a rarity now that counties across the nation are digitizing their records. Computer-based searches easily spot defects. Insurance payouts are rarely necessary.<\/p>\n\n\n\n<p>So, we hear you. Forcing buyers to cover title insurance is seeming more and more like an extra fee \u2014 one that governments ought to make obsolete.<\/p>\n\n\n\n<p>And let\u2019s not forget that <a href=\"https:\/\/www.deeds.com\/articles\/when-do-you-need-a-warranty-deed\/\">receiving a warranty deed<\/a> from the seller means a title company stands behind its integrity. The warranty states that the title is marketable. Contact the title company if you run into claims against the deed. Their staff should be willing to help.<\/p>\n\n\n\n<p><strong><em>Pro tip:<\/em><\/strong> Find out if your seller bought an owner\u2019s title policy. You could be eligible to \u201csubstitute\u201d your new policy for the seller \u2014 at a discount rate.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Looking Ahead\u2026<\/h2>\n\n\n\n<p>Latent defects in deeds are gradually becoming a problem of the past.<\/p>\n\n\n\n<p>To this point, we\u2019ve watched <a href=\"https:\/\/www.deeds.com\/articles\/setting-the-example-bergen-county-migrates-370000-nj-deeds-to-the-blockchain\/\">Bergen County, New Jersey migrate hundreds of thousands of deeds<\/a> onto a blockchain ledger. As this kind of work becomes normal, title defects should diminish.
