This was to resolve the government\u2019s allegations that, for several years, beginning in 2018, the bank violated the Equal Credit Opportunity Act and Fair Housing Act. The problem involved an alleged pattern of ignoring minority neighborhoods.<\/p>\n\n\n\n<p>But that was a past U.S. government. The current Justice Department wants to drop settlements like this. The current federal government is moving to relieve lenders of their obligations to ensure access to information and financing in mainly minority counties.<\/p>\n\n\n\n<p>Access to financing is, of course, essential for households hoping to <a href=\"https:\/\/www.deeds.com\/articles\/buying-a-house-to-save-money-its-a-tried-and-true-method\/\">build wealth through real estate<\/a>.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">What a Court Found OceanFirst Had Done<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"315\" height=\"560\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/07\/what-a-court-found-oceanfirst-had-done.webp\" alt=\"\" class=\"wp-image-6693\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/07\/what-a-court-found-oceanfirst-had-done.webp 315w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/07\/what-a-court-found-oceanfirst-had-done-169x300.webp 169w\" sizes=\"auto, (max-width: 315px) 100vw, 315px\" \/><\/figure>\n\n\n\n<p>OceanFirst was faulted for its focus on majority-white areas, a federal district court heard, to the detriment of mainly Black, Hispanic and Asian areas.<\/p>\n\n\n\n<p>When the case later settled, the U.S. government directed OceanFirst to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Invest at least $14 million to support home loan accessibility, refinancing, and renovations for residents of majority-nonwhite neighborhoods in Middlesex, Monmouth, and Ocean counties.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Invest $700K into outreach and information-sharing in these allegedly underserved New Jersey counties.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Invest $400K in community partnerships to provide homeowner support, and avert foreclosures.<\/li>\n<\/ul>\n\n\n\n<p><a href=\"https:\/\/ir.oceanfirst.com\/news\/news-details\/2024\/OceanFirst-Bank-Announces-Voluntary-Settlement-of-Fair-Lending-Claims-by-the-U.S.-Department-of-Justice-and-U.S.-Department-of-Housing-and-Urban-Development\/default.aspx\" target=\"_blank\" rel=\"noreferrer noopener\">OceanFirst agreed<\/a> last year to expand its operations, and train its staff on fair lending practices. It further agreed to create a position for a director of community lending for minority communities.<\/p>\n\n\n\n<p>You might call it <em>diversity, equity, and inclusion<\/em>. Or you might just call it<em> fair<\/em>. The Justice Department at the time called it holding institutions \u201caccountable for their discriminatory actions while ensuring racial and economic justice for all Americans.\u201d<\/p>\n\n\n\n<p>The OceanFirst settlement was one of numerous successes of an anti-redlining initiative launched in 2021.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size\" style=\"padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\"><em><strong>In late 2021, the U.S. Department of Justice launched its <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/articles\/the-justice-department-zeroes-in-on-mortgage-discrimination\/#:~:text=In%20Late%202021%2C%20the%20Justice%20Department%20Launched%20Its%20Combatting%20Redlining%20Initiative\"><strong><em>Combatting Redlining Initiative.<\/em><\/strong><\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Current Administration Keen to \u201cReboot Redlining\u201d \u2013 Harvard\u2019s Journal of Law &amp; Technology<\/h2>\n\n\n\n<p>Now, agencies and lenders are being allowed to take down guardrails against discrimination in lending. The Department of Justice has already freed multiple banks from their obligations under hard-won redlining settlements.<\/p>\n\n\n\n<p>This includes a redlining lawsuit against a nonbank mortgage lender serving the Philadelphia area \u2014which, the current administration now says, has done enough. The lender\u2019s practices (between 2015 and 2019) had been challenged under the Equal Credit Opportunity Act, the Consumer Financial Protection Act, the Fair Housing Act, and other provisions geared to stop discrimination in lending. Dropping the consent order in this additional case is just one example of <a href=\"https:\/\/www.consumerfinancemonitor.com\/2025\/05\/30\/trustmark-redlining-consent-order-terminated\/\" target=\"_blank\" rel=\"noreferrer noopener\">federal agencies closing down enforcement actions<\/a> brought under prior leadership. \u00a0<\/p>\n\n\n\n<p>The Harvard-based <em>Journal of Law &amp; Technology<\/em> (<em>JOLT Digest<\/em>) reminds readers that the Equal Credit Opportunity Act, in 1974, changed a system in which women were denied loans without male co-signers. After addressing discrimination based on sex or marital status, the Act expanded. Congress extended its equal opportunity provisions to minority borrowers, and also barred age discrimination.<\/p>\n\n\n\n<p>The term <em>redlining<\/em>, says the <em>JOLT Digest,<\/em> comes from red lines on maps used by the U.S. government to designate minority neighborhoods as too \u201crisky\u201d for lending, and discourage the issuance of mortgages to minority applicants.<\/p>\n\n\n\n<p>The federal government\u2019s new assault on fair lending \u201cgoes beyond merely reversing half a century of work to revert to a world where banks are permitted not to lend in particular neighborhoods,\u201d the Harvard-based journal states. That\u2019s because lenders now have the capacity to digest data from online sources and engage in a high-tech kind of racial and financial profiling.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Meanwhile, in Arkansas\u2026<\/h2>\n\n\n\n<p>There\u2019s a group that owns some 150 acres \u2014 no minorities allowed.<\/p>\n\n\n\n<p>The Arkansas attorney general\u2019s office says it\u2019s looking into the white supremacist group. The whites-only, anti-Jewish community is named Return to the Land.<\/p>\n\n\n\n<p>Its co-founder says the group is now considering an expansion into Springfield, Missouri.<\/p>\n\n\n\n<p><em>KOLR-TV<\/em>, a CBS outlet in Springfield, quotes the co-founder as saying:<\/p>\n\n\n\n<p><em>Whites should have the ability to live among their own people if that\u2019s what they want to do, and mass immigration is quickly making that nearly impossible in many Western nations.<\/em><\/p>\n\n\n\n<p>Orwoll told the CBS outlet of his hopes to acquire land in every state in the nation.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size\" style=\"padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\"><em><strong>Excluding anyone from property due to their perceived religion, ethic background, or race offends federal law. Simpson: Florida Singles Out Chinese Migrants<\/h2>\n\n\n\n<p>In April, the U.S. Court of Appeals for the 11th Circuit heard the case of <em>Shen v. Simpson<\/em>, a challenge to Florida\u2019s Senate Bill 264. The law excludes many people of Chinese heritage from buying homes across much of the state. To a less extreme extent, S.B. 264 also unfairly impacts immigrants from Cuba, Venezuela, Syria, Iran, Russia, and North Korea.<\/p>\n\n\n\n<p>The law clashes with several federal provisions, including the Fair Housing Act, and the Equal Protection and Due Process Clauses of the U.S. Constitution\u2019s Fourteenth Amendment.<\/p>\n\n\n\n<p>Civil liberties groups and multiple law firms have taken on the case, named for four people of Chinese descent, raising their families in Florida. The families are now barred from owning real estate there. The law, effective July 1, 2023, prohibited persons from \u201cforeign countries of concern\u201d from owning real property within 10 miles of any military installation or critical infrastructure in the state. Additionally, China-specific restrictions bar China-based politicians and business organizations from directly or indirectly owning any interests in Florida real estate.<\/p>\n\n\n\n<p>The law includes civil and criminal penalties (including imprisonment) for violations. It punishes both buyers and sellers.
