It&nbsp;shows the names of all the owners, how\nlong each held title, and what each&nbsp;paid for the property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The abstract\nis used for verifying a property&#8217;s&nbsp;marketability. The abstract offers\nassurance that the property is just as the seller represents it, both in the\naccuracy of its physical description and the integrity of its title.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The classic\ntitle abstract goes back in history to the earliest available records\u2014sometimes\nas far back as the original land grant&nbsp;or&nbsp;patent deed from the U.S.\ngovernment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The&nbsp;<em>abstractor of title<\/em> is the\nperson who researches this history, summarizes the relevant documents, and\ncertifies the binder as true and complete.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Who\nIs&nbsp;the Abstractor?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The first abstractors were attorneys. Today&#8217;s\u00a0abstractor studies\u00a0under an experienced abstractor and may be licensed by the state.\u00a0For example, an\u00a0<a href=\"https:\/\/www.ok.gov\/abstractor\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Oklahoma abstractor is\u00a0licensed<\/a> by the\u00a0state board.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In other\nstates, an attorney who earns a commission on the title insurance product is\nthe same person who prepares the abstract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Today&#8217;s abstractors typically research a property by searching county records and by using records already stored in their abstract plants\u2014sites managed by\u00a0title-insurance companies to hold\u00a0copies of documents.\u00a0Counties typically store their records by year. A property&#8217;s complete title history may be contained by numerous record books, and is time-consuming to find. (That said, expect the process to evolve as\u00a0<a href=\"https:\/\/map.zva.cc\/webmap\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">real estate market data<\/a>\u00a0generally becomes more accessible and high-tech.)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The abstractor must have sharp analysis skills. Abstractors must recognize which documents could be erroneous or void. For example, an abstractor in Ohio might find a recent transfer on death deed. The provision of the <a href=\"http:\/\/codes.ohio.gov\/orc\/5302.22\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Ohio Revised Code<\/a> that governs the deed\u00a0requires the grantor to file an\u00a0affidavit with the county prior to death. If the deceased did not record the legally required affidavit before death, the abstractor must determine\u00a0that the\u00a0deed is void and that the real estate remained\u00a0vested in the grantor\u2019s estate.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What\nElse&nbsp;Does the Abstraction Process Uncover?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A seller\ncould be asked to produce an abstract to uncover any&nbsp;interests others\nmight have in the property, or whether some unknown party could have reason to\nchallenge a&nbsp;buyer\u2019s ownership. Thus, the abstractor is responsible for\nfinding&nbsp;all major transactions&nbsp;and legal issues, and for including:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Mortgages and liens. Liens for property taxes, mortgage loans, homeowners\u2019 association dues, or any other lenders\u2019 interests must be resolved or good title could be destroyed.<\/li><li>Subdivision and homeowners&#8217; association restrictions. The buyer needs to know what can and cannot be done with a property.<\/li><li>Lot and block diagrams; plat maps.<\/li><li>Surveys. Any encroachments, such as fences over the boundary, should appear in the surveyor&#8217;s notes. <\/li><li>Easements. Right of ways or utility access can create areas the buyer is restricted from fencing off or developing.<\/li><li>Pertinent wills, deeds, lawsuits, or tax sales.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Once the\nabstractor finishes, a title company has a comprehensive summary of&nbsp;the\ncondition of the title, and can insure it accordingly.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How\nDoes an Abstract Differ From a Title Report?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A recorded property deed specifies\u00a0on its face whether it is recorded with the county recorder or the office of the registrar. If it is the registrar, and the deed is kept through a <em><a href=\"https:\/\/co.cook.mn.us\/index.php\/2016-04-07-14-28-14\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">torrens<\/a><\/em> system, there is no abstract. In this case the court issues a Certificate of Title.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No\nstate&nbsp;requires an abstract&nbsp;to effect a legal property conveyance. Yet\nlenders nationwide do make loans contingent on a<em> title insurance report.<\/em> In some states, a\ntitle insurer prepares (and is responsible for&nbsp;the accuracy of)\nthe&nbsp;report, which&nbsp;is treated as tantamount to an abstract.&nbsp;The\nabstract, though, is designed to rule out any clouds on title. In contrast, the\ntitle report simply enables the&nbsp;purchase of title insurance. This runs the\nrisk over simply \u201cinsuring over\u201d the title defects.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On the other\nhand, it is possible that defects in title may escape the abstractor\u2019s\nattention. Title insurance protects the buyer, and is normally available based\non a&nbsp;cost-effective&nbsp;title report through which the title insurer\ninspects the title&#8217;s condition. The insurance covers resolution&nbsp;costs for\nunknown defects covered by the policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Another process that applies in some states is the<em> 40-year search<\/em>. Information gleaned from this process can serve as the basis for title insurance. For example, <a href=\"http:\/\/codes.ohio.gov\/orc\/5301.51\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Ohio&#8217;s marketable title provision states<\/a>\u00a0that &#8220;any person claiming an interest in land may preserve and keep effective the interest\u201d by filing a notice for the record\u00a0\u201cduring the forty-year period immediately following the effective date of the root of title\u00a0of the person whose record title would otherwise be marketable.&#8221; \u200bIn some states the marketable title act could require checking back over a different term of years.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who\nMay Obtain an Abstract of Title?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Abstracts,\nor updated abstracts,&nbsp;are expensive, bound documents. The&nbsp;real estate\nattorney who certifies a title orders and obtains them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yet,\nassuming an abstract exists, anyone may read most&nbsp;documentation it\ncontains at the county courthouse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Many people do this when researching <a href=\"https:\/\/uwm.edu\/libraries\/archives\/genealogy\/property-abstracts\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">history of genealogical or architectural significance<\/a>. For example, a researcher may wish to nominate a property to the National Register of Historic Buildings. The abstract may reveal connections with significant historical figures, and the early\u00a0names of a property as well as the construction and renovation dates.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For ordinary\nproperties, the county recorder of deeds can tell the seller if an abstract is\navailable, based on the property\u2019s legal description.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Abstract\nStates?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Regardless\nof whether a state has a reputation as an &#8220;abstract state,&#8221; every\nstate requires an expert review of a title&#8217;s history. Therefore, a&nbsp;title\nreport and an abstract of title will include much similar information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Which is\nneeded?
