As the <a href=\"https:\/\/www.deeds.com\/articles\/a-silver-tide-of-boomers-will-pass-their-deeds-along-and-its-rolling\/\">baby boomer generation<\/a> continues to get older, it will likely happen even more. But it\u2019s one thing that\u2019s likely <em>not<\/em> on a home buyer\u2019s radar as the closing date draws near. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">First, rest assured. Your deed transaction should move on, even after the seller has departed. Of course, someone new will have to act for the late homeowner now, but usually this situation can be worked through.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now for the details.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Will the Person Holding Power of Attorney Continue the Sale?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If your late seller was transferring the home through a representative with power of attorney, then you were working with the late deed holder\u2019s adult child, or perhaps a sibling, or someone else. Whoever was working with you on behalf of the seller has now legally lost the power of attorney. Bottom line here: a power of attorney ends when the person being represented passes away.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, either the seller <em>or<\/em> the seller\u2019s legal representative can no longer represent the seller\u2019s side of the deed conveyance. So, now what?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now, you can expect the estate to go under the oversight of the probate court.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\"><em><strong>Some deed holders, if their states allow this, avoid probate through a <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/articles\/can-co-owners-use-a-transfer-on-death-deed-for-real-estate\/\"><strong><em>transfer on death deed or affidavit<\/em><\/strong><\/a><em><strong>. This instrument conveys a property interest to a designated \u201cbeneficiary.\u201d It has to be recorded with the county before the deed holder passes on. <\/strong><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So, what\u2019s your role? It\u2019s largely about communication. Call or have your agent call your title and escrow company. Its staff can discuss estate settlement steps with your agent. Let\u2019s walk through this.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once a person passes away, the county probate court oversees the distribution of that person\u2019s estate. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a buyer has to wait for probate to finish before getting the real estate deed from the court, your real estate agent &nbsp;can have the purchase contract extended.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You are now wondering how long the probate court will take to conclude its work and allow for the distribution of assets. Probate can take weeks, months, or, in some court proceedings, more than a year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Does this mean you\u2019re stuck waiting perhaps a year to get a home? We hope not! A trust could help a home move after the owner passes away. As we can see, that could constitute very good planning when the end of life becomes a distinct possibility.
