We need to\nknow the order of priority.<\/p>\n\n\n\n<p>Deals are\nmade based on these stakes, so it\u2019s essential to know how to preserve claims in\na piece of property. The best practice is to record any\nnew&nbsp;interest&nbsp;promptly. This way, should there be any conflicting\nclaim at a later date, the dispute&nbsp;can be settled.&nbsp;&nbsp;<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">The\nRace to Record: Three Different Rules<\/h2>\n\n\n\n<p>The general\nprinciple is to consider the first claimant to record an interest as the first\nin priority in relation to that asset.<\/p>\n\n\n\n<p>Once an\ninterest is recorded, the public&nbsp;is on notice that a claim exists in the\nproperty.<\/p>\n\n\n\n<p>Specifically,\nthe public has <em>constructive\nnotice.<\/em>&nbsp;The notice exists and is there to see, because it is\nin the public land records.<\/p>\n\n\n\n<p>That said,\nif multiple people claim an interest, the order of priority depends on whether\nthe state applies:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>A race statute,<\/li><li>A notice statute, or<\/li><li>A race-notice statute.<\/li><\/ul>\n\n\n\n<p>To find out\nwhich of these three rules apply in a given state, check the state&#8217;s recording\nact. There are three types of rules followed by various states.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">1.\nRace Statute<\/h3>\n\n\n\n<p>The race or\n\u201crace to the courthouse\u201d rule&nbsp;is the simplest. It is also today&#8217;s least\ncommon type of recording act. It says that whoever&nbsp;records&nbsp;first\nprevails over any later recordings.&nbsp;<\/p>\n\n\n\n<p>In Delaware, for example, imagine an owner who sells\u00a0two people an interest in the\u00a0same property. <a href=\"https:\/\/www.deeds.com\/recorder\/delaware\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Delaware is a race state<\/a>. So, in this case, &#8220;the first person to record their deed is the legal recipient of the grantor&#8217;s rights to the real estate.&#8221;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3.\nNotice Statute<\/h3>\n\n\n\n<p>States\nfollowing the notice rule take a different approach. These states consider a\nlater buyer who pays fair consideration&nbsp;for the real estate its rightful\nowner, if there were prior unrecorded interests that the buyer did not know\nabout. Sometimes an old interest isn\u2019t possible to find in the title\nexamination. So the good-faith buyer wins.<\/p>\n\n\n\n<p>A&nbsp;notice\nstatute&nbsp;encourages people to record their interests in a timely manner.\nBut it can also leave the land records incomplete as the newer buyer may not\nhave a strong incentive to record, and therefore the earlier buyer could make\nimprovements to the property and lose the investment to&nbsp;a subsequent buyer\nwho is slow in recording.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">3.\nRace-Notice Statute<\/h3>\n\n\n\n<p>This is like\nthe notice rule, with an extra incentive for a buyer to record promptly.<\/p>\n\n\n\n<p>The buyer\nwho pays a fair price for the home, knows of no earlier conflicting, unrecorded\nclaims, <em>and records first<\/em>,\nwins. Anyone wishing to record later is barred&nbsp;from\noverturning&nbsp;the&nbsp;bona fide purchaser\u2019s ownership claim.<\/p>\n\n\n\n<p>For example,\na person might have been bequeathed an interest in the property years before.\nThat interest has never been&nbsp;recorded, and therefore the buyer had no\nconstructive notice. The good-faith buyer, upon recording, divests the\nhome&nbsp;of that earlier, unrecorded&nbsp;interest.<\/p>\n\n\n\n<p>Note that\nthe&nbsp;buyer, to become a bona fide purchaser, gave fair value&nbsp;for the\nproperty, and then recorded. What is fair value?&nbsp;It does not mean the\ncurrent market value. It could significantly&nbsp;under the appraised value. As\nlong as it is more than&nbsp;nominal consideration, the buyer&#8217;s interest is\nprotected by&nbsp;the state&#8217;s&nbsp;the recording act.&nbsp;<\/p>\n\n\n\n<p>California offers an example. An unrecorded conveyance\u00a0is voided by\u00a0a subsequent purchaser taking\u00a0the property &#8220;in good faith and for a valuable consideration, whose conveyance is first duly recorded&#8221; in\u00a0<a href=\"https:\/\/www.deeds.com\/recorder\/california\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">California, a race-notice state<\/a>.<\/p>\n\n\n\n<p>There are\nsome exceptions to the rule. Race-notice states Ohio and Pennsylvania\nfollow&nbsp;the simple race rule for mortgage liens. And, despite&nbsp; the\ngeneral recording rules, assessments and taxes imposed by&nbsp;local\ngovernments take priority and must be paid. Certain mechanic\u2019s liens must be\npaid, and when the work started is the key time for establishing&nbsp;priority\nover later liens.&nbsp;<\/p>\n\n\n\n<p>Unpaid\ncondo&nbsp;fees and special assessments must be paid, but case law can impact\nthis. Thus, an unrecorded condo lien may, in&nbsp;some cases, be voided.\nHomeowners&#8217; associations are well advised to file liens promptly\u2014regardless of\nlocal practices.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Public\nPolicy&nbsp;and Limitations<\/h2>\n\n\n\n<p>Recording\nacts do not force anyone to record a real estate document. In most states, the\nacts&nbsp;do help&nbsp;good-faith buyers receive and keep the value they\nbargained for. They do this by driving&nbsp;customary practice, supporting the\ncreation of public records, and rewarding prompt recorders with legal\nprotection.<\/p>\n\n\n\n<p>In a\nrace-notice state especially, anyone granted a recordable interest is motivated\nto record promptly, keeping the county&nbsp;records constantly updated.<\/p>\n\n\n\n<p>Other policy\nbenefits include the keeping of good records that serve as evidence of title\nfor court challenges. Recording acts also make tax collection easier,&nbsp;by\nclarifying who holds taxable interests in real estate.<\/p>\n\n\n\n<p>As for\nlimitation, note that the recording acts protect&nbsp;good-faith purchasers\nonly against <em>recordable<\/em>\nclaims, traditionally related to conveyances. These include&nbsp;deeds, liens,\nmortgages, land contracts, and financing statements.<\/p>\n\n\n\n<p>Note also\nthat someone who receives the property as a gift, or for nominal consideration,\nor as a beneficiary to a will is not considered a bona fide purchaser.\nRecording acts were&nbsp;not designed to&nbsp;protect such a person against\nunrecorded claims. &nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The\nKey Takeaway? Recording a&nbsp;Claim Is Vital<\/h2>\n\n\n\n<p>Recording\ncreates a reliable chain of title, ensuring transparency and&nbsp;public\nnotice. When claims appear to conflict, their priority can be straightforwardly\nsorted by applying the state statute and the order of&nbsp;recording.<\/p>\n\n\n\n<p>That said, recording acts can be difficult to apply to specific situations, and they do not protect even a good-faith buyer from every possible risk.
