The best way of describing this in an agreement? There\u2019s no financing contingency in the purchase contract with the seller. The purchase offer says the buyer\u2019s offer is <em>not contingent on financing<\/em>.<\/p>\n\n\n\n<p>But that doesn\u2019t rule out getting a mortgage. It just means you can prove to the seller that you\u2019re ready to buy, that you have the cash on hand, whether or not anyone clears you for financing before the closing date.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">I\u2019m Selling and Want the Cash in Hand Promptly. Is a Quitclaim Good?<\/h2>\n\n\n\n<p>As the deed holder, you are free to use the approved legal <a href=\"https:\/\/www.deeds.com\/quitclaim-deed\/\">form to create a quitclaim deed<\/a>. Because there\u2019s a cash buyer, you don\u2019t have a lender insisting on a warranty deed. A quitclaim will do it.<\/p>\n\n\n\n<p>But here\u2019s the thing. The quitclaim doesn\u2019t come with a warranty. So, a quitclaim is not recommended in a sale for money. If you want to proceed, we highly recommend having a real estate attorney go over your document.<\/p>\n\n\n\n<p>And be aware that there could be sizable liens, for obligations such as unpaid taxes, that stick to the title through the quitclaim transfer.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size\" style=\"padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\"><em><strong>Among families, spouses, and co-owners, the title situation is not at such risk as it is when conveying to a third party (\u201carm\u2019s length\u201d). Use a <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/articles\/when-do-you-need-a-warranty-deed\/\"><strong><em>warranty deed<\/em><\/strong><\/a><em><strong> for an arms-length transaction.<\/strong><\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Other Documents Are Necessary for a Cash Purchase?<\/h2>\n\n\n\n<p>You\u2019ll need a purchase contract between the seller and yourself. Your attorney can also assist you with that document.<\/p>\n\n\n\n<p>Also important is a home inspection, and having an attorney or title company run a professional title search for the home.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size\" style=\"padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\"><em><strong>Conveying a deed without hiring an agent? For case-specific guidance, bring your queries to an experienced <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/articles\/can-working-with-a-real-estate-attorney-instead-of-an-agent-save-you-money\/\"><strong><em>real estate attorney<\/em><\/strong><\/a><em><strong> who works in the jurisdiction where the property exists.<\/strong><\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Is a Quitclaim a Full, Final Transfer?<\/h2>\n\n\n\n<p>Yes. Create and sign the quitclaim according to the correct procedure, and record it with the county.<\/p>\n\n\n\n<p>Once it\u2019s properly created, signed and notarized and\/or witnessed as directed by the home\u2019s state law, and then recorded, a quitclaim deed passes a <em>present interest<\/em>. That means now. Done. No takebacks.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size\" style=\"padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\"><em><strong>Please remember! Never <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/articles\/the-monster-under-the-bed-when-a-homes-past-holds-an-unrecorded-deed\/\"><strong><em>create a deed and leave it unrecorded<\/em><\/strong><\/a><em><strong>. It will not be an issue for probate, so relatives will not be able to contest the transfer, unless there was some abnormality like <a href=\"https:\/\/www.deeds.com\/articles\/quitclaim-deeds-and-senior-homeowners-convenience-with-caution\/\">fraud or undue pressure to sign<\/a>.<\/p>\n\n\n\n<p>If the new deed holder is paying off a mortgage that belonged to the past owner, repayments can continue until final payoff is made and lien release requested.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What If There\u2019s a Mortgage on the Home Being Quitclaimed?<\/h2>\n\n\n\n<p>The deed can still be transferred, and this still constitutes a full, final property transfer.<\/p>\n\n\n\n<p>The quitclaim recipient gets ownership of the real estate \u2014 or, to be exact, whatever interest the quitclaim grantor has. The mortgage is not transferred. The person named on the mortgage agreement, including any co-signers, will be responsible for resolving the debt.<\/p>\n\n\n\n<p>Let the mortgage company know of your plans in advance. Some home loans are assumable, and the company can offer details. In any case, the deed recipient needs lender permission to take over a mortgage. The mortgage lien is attached to the property, so be sure you actually do get greenlighted to assume the loan. But that constitutes two (taxable) deed transfers, and you pay for a title company\u2019s services twice.<\/p>\n\n\n\n<p>Alternatively, you could write a <a href=\"https:\/\/www.deeds.com\/articles\/funding-your-mortgage-gifts-and-gift-letters\/\">gift letter<\/a> and support your child\u2019s purchase.<\/p>\n\n\n\n<p>Or you could back up your child\u2019s purchase with cash.
