It Declares How Your Ownership Is Vested &nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Check the deed for vesting language.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If you co-owned the home as <strong><em>tenants by entireties<\/em> <\/strong>(available in some states to married\/life partners), your deed should be fine. If you want to sell or borrow against the home, inform your agent or mortgage consultant that your co-owner has passed.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Same goes for the many couples, in many states, who own homes as <strong><em>joint tenants with the right of survivorship<\/em><\/strong>. Probate is unnecessary. The late owner\u2019s property interest vests in the surviving spouse, legally, even if the deceased owner\u2019s name is still on the deed.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If the deed says you were <strong><em>tenants in common<\/em><\/strong>,\u00a0there\u2019s a different scenario. You each held a certain percent of the property. The deed will state the percentages: 50-50, 80-20, or some other split. Here, the late owner\u2019s interest\u00a0goes into\u00a0probate court, which removes the late owner\u2019s name from the title. The personal representative distributes the property\u00a0to the will\u00a0beneficiary (or the\u00a0heir under the state\u2019s <a href=\"https:\/\/www.deeds.com\/articles\/dont-be-the-intestate-homeowner-write-your-will\/\">intestacy<\/a> law).<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">What If Your Home Is in a Community Property State?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If you and your life partner have resided in a <strong><em>community property<\/em><\/strong> state, then your home legally goes to the surviving co-owner upon the first owner\u2019s death. Normally the co-owners will have created a <strong><em>community property agreement<\/em><\/strong><em>. <\/em>This is the instrument that affirms that all present and future assets of each partner are, in fact, community property, and should go to the survivor when the first partner dies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Take this agreement to the county clerk or recorder of deeds. Have it publicly recorded. A probate court\u2019s oversight is not necessary for the transfer of&nbsp;title into your name. The title goes right from the deceased spouse or domestic partner to you, the living homeowner.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In short \u2014 as with joint ownership or tenancy by the entireties \u2014 it\u2019s best to clear the title.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Bypassing Probate? That&nbsp;Doesn\u2019t Mean Doing Nothing.&nbsp;<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full is-style-rounded is-style-rounded--2\"><img loading=\"lazy\" decoding=\"async\" width=\"856\" height=\"465\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/09\/bypassing-probate.webp\" alt=\"\" class=\"wp-image-6812\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/09\/bypassing-probate.webp 856w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/09\/bypassing-probate-300x163.webp 300w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/09\/bypassing-probate-768x417.webp 768w\" sizes=\"auto, (max-width: 856px) 100vw, 856px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">While you\u2019re OK with the deed as-is for joint ownership or tenancies by entireties, it\u2019s best to&nbsp;record&nbsp;the transfer of the property interest.&nbsp;This can be done by signing an&nbsp;<em>affidavit of survivorship<\/em>&nbsp;for the county recorder of deeds. Once it becomes a public record, it notifies the public that the former owner no longer has a vested interest.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Check state and local rules for requirements. Typically, the survivor brings a copy of the&nbsp;title, the spouse\u2019s or life partner\u2019s death certificate, a&nbsp;<em>lack of probate affidavit,<\/em>&nbsp;and&nbsp;an<em>&nbsp;excise tax affidavit<\/em>&nbsp;(showing a non-taxable transfer) to the local recorder\u2019s office.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In California? Title changes between spouses or after a spouse\u2019s death require a <em>preliminary change of ownership report<\/em>, or PCOR.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Check with your county clerk to learn about fees and what filings you need so that your title is clearly updated. This will make it easier for you or your heirs to sell or borrow against the property.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">In Short\u2026<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Co-owners as tenancies by&nbsp;the entirety, joint owners, and community property owners all have <em>right of survivorship<\/em>&nbsp;interests.&nbsp;That means the property interest of a deceased co-owner legally goes to the surviving co-owner. The deed need not be updated for this to happen. Some surviving&nbsp;co-owners&nbsp;never change their deeds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Still, there could be a good reason to update the deed for the sake of clarity and public notice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You might simply wait and <a href=\"https:\/\/www.deeds.com\/forms\/\">create a new deed<\/a> when you refinance, or when you do formal estate planning.
