But does your deed assure you that you hold the title free and clear of a past owner\u2019s obligations?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A title search looks at court documents, bankruptcies, deaths and divorces, and unpaid secured debts. Any title problems should surface during the title search if you\u2019re getting a mortgage. Once problems are found, they should be resolved before you close and receive the keys.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But now and then, something gets missed. And missed details can surface days, weeks, months, or years after closing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So let\u2019s talk about the value of an&nbsp;<em>owner\u2019s title insurance policy<\/em>.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">True Story: Betty\u2019s Unpleasant Surprise<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Here\u2019s a real story from the American Land Title Association (ALTA) about Betty, who purchased a home, financing half of its value.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Betty had to pay for a <em>lender\u2019s title insurance policy<\/em>, to cover the bank\u2019s interest in the good title of the lender\u2019s collateral \u2014 Betty\u2019s new home. Paying for the lender\u2019s title coverage is a standard part of a mortgage borrower\u2019s closing costs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When the question came up, Betty declined to buy an optional <em>owner\u2019s policy<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This proud new home owner soon found out that a court recorded a $20,000 lien on the seller\u2019s title just before she closed and recorded her new deed. Her seller, who owed the money, was nowhere to be found. Betty was forced to pay $20,000 to avert foreclosure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This didn\u2019t have to happen. Betty could have bought an owner\u2019s title policy, just in case a party had filed a lien that didn\u2019t show up in the search. Then the title policy would protect Betty in case of legal action to resolve the lien. Betty could have even ordered an add-on to cover the gap from the title search to the formal deed transfer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Betty\u2019s case was a rare fluke, right?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not exactly. Last year, says ALTA, title insurers spent $673 million in payouts on behalf of shocked deed holders like Betty. In other words, some buyers do wind up using their title insurance policies.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\"><em><strong>When a seller gives you a <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/articles\/when-do-you-need-a-warranty-deed\/\"><strong><em>warranty deed<\/em><\/strong><\/a><em><strong>,&nbsp;that\u2019s an assurance you\u2019re getting a marketable title. Ask the title company that issued the warranty for assistance resolving title disputes.<\/strong><\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Title Insurance Is a Hedge Against Unpleasant Surprises<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full is-style-rounded is-style-rounded--2\"><img loading=\"lazy\" decoding=\"async\" width=\"892\" height=\"594\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/10\/title-insurance-is-a-hedge-against-unpleasent-surprises.webp\" alt=\"\" class=\"wp-image-6907\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/10\/title-insurance-is-a-hedge-against-unpleasent-surprises.webp 892w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/10\/title-insurance-is-a-hedge-against-unpleasent-surprises-300x200.webp 300w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2025\/10\/title-insurance-is-a-hedge-against-unpleasent-surprises-768x511.webp 768w\" sizes=\"auto, (max-width: 892px) 100vw, 892px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Your lender isn\u2019t taking chances. Lenders hold title policies (which buyers pay for) as shields from risk.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As the home buyer pays the loan down, the lender\u2019s risk diminishes. And the coverage shrinks. A paid-off mortgage has no lender\u2019s coverage left at all. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In contrast, a policy that names the<em> home buyer <\/em>as its beneficiary is good throughout ownership.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This <em>owner\u2019s title policy<\/em> will be there for the homeowner if it turns out that the title company missed something when it ran the title search. The policy covers a deed holder in case of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Any liens left unresolved by a prior owner. These might involve unpaid property taxes, fines imposed by a homeowners\u2019 association, or a contractor\u2019s unresolved bill.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Unknown breaches of zoning or local regulations.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An overlooked co-owner or heir.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Disputed access rights, or an unexpected easement that keeps the owner from doing what they\u2019d planned to do on the land.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An old court order, left unresolved by a prior deed holder.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Errors in paperwork, such as a missing signature on a past deed transfer or a&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/an-error-in-the-legal-description-of-the-deed-what-happens-now\/\">mistake in the property description<\/a>.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s possible that a home has undisclosed but recorded liens stemming from local services provided to a past deed holder, or any of the above-listed issues.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An&nbsp;<em>extended<\/em>&nbsp;(sometimes called&nbsp;<em>enhanced<\/em>) owner\u2019s title policy covers more than a company\u2019s standard policy covers. This sample comparison, published by Federal Title, breaks down one company\u2019s&nbsp;<a href=\"https:\/\/www.federaltitle.com\/title-insurance\/compare-policies\/\" target=\"_blank\" rel=\"noreferrer noopener\">standard and enhanced title policy coverage<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Check with an agent about the policy you\u2019re looking at buying. Ask if you\u2019re getting coverage for inflation, trust beneficiaries, post-policy forgery, swindlers who impersonate deed holders to exploit their home equity, <a href=\"https:\/\/www.deeds.com\/articles\/hey-back-off-when-an-encroaching-neighbor-wants-a-piece-of-your-property\/\">encroachments after the purchase<\/a>, certain local restriction problems, a prior owner\u2019s&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/diy-renovations-everything-you-wanted-to-know-or-not-about-permits\/\">missing work permits<\/a>, unrecorded easements, or <a href=\"https:\/\/www.deeds.com\/articles\/the-property-survey-do-you-need-one\/\">property survey<\/a> mistakes. Make it a point to understand what deductibles come into play, and what endorsements you might need for your own situation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bottom line: an owner\u2019s title policy provides support in restoring clear title. A home buyer should find out what the policy offers, what it excludes, and whether the <em>continuing coverage<\/em> clause protects heirs or other future owners.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How Much Does an Owner\u2019s Policy Cost a Home Buyer?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Some states like Florida, New Mexico, and&nbsp;<a href=\"https:\/\/www.tdi.texas.gov\/tips\/title-insurance.html\" target=\"_blank\" rel=\"noreferrer noopener\">Texas<\/a> regulate title policies and pricing. In Iowa, a buyer can have a title searched and insured for&nbsp;a very small sum because <a href=\"https:\/\/opportunityiowa.gov\/housing\/iowa-title-guaranty\" target=\"_blank\" rel=\"noreferrer noopener\">Iowa provides the title protection<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In some states, the seller customarily covers the title insurance cost. Ask your agent who covers the premium.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Elsewhere, you may&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/buying-a-home-should-you-pick-your-own-title-insurance-policy\/\">shop around for title coverage<\/a>&nbsp;from a company licensed in the state. Let your real estate agent know early in your house-hunting if you plan to work with an insurer of your choosing. Otherwise, your agent or mortgage company will choose in advance. On <a href=\"https:\/\/www.deeds.com\/articles\/closing-on-a-home-fast\/\">closing day<\/a>, it\u2019ll be too late to specify your preference. &nbsp;Your closing costs will pay for the title insurer\u2019s work. The cost can be up to 1% of the home price.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You could go with the same insurer your lender uses. This is a common approach. Lenders offer discounted costs when they bundle the lender\u2019s and owner\u2019s policies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And don\u2019t overlook the possibility that your seller already holds an owner\u2019s title policy. You might be able to substitute yourself as the beneficiary for a discounted premium.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\"><em><strong>Insurance policies contain deductibles, conditions, and exclusions. A buyer who has a <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/articles\/the-property-survey-do-you-need-one\/\"><strong><em>survey<\/em><\/strong><\/a><em><strong>&nbsp;done may increase their coverage and avoid some exceptions. The survey can uncover physical title issues impacting the owner\u2019s use of the land as it\u2019s described on the deed.<\/strong><\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">In a Nutshell\u2026<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You\u2019ll get an opportunity to buy a title insurance policy for yourself when signing a mortgage or refi agreement. Getting an&nbsp;<em>owner\u2019s title policy<\/em>&nbsp;is optional, but not very expensive, given the risk reduction it offers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There\u2019s a single payment upfront, and no premiums after that. The owner keeps the policy papers with other <a href=\"https:\/\/www.deeds.com\/articles\/new-homeowners-document-checklist-storage-plan\/\">real estate documents<\/a>, so it\u2019s handy in case of unexpected issues. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Policies vary by state and by company.
