If the property\u2019s value rises (or falls), then the gain (or loss) is the buyer\u2019s. the buyer pays the <a href=\"https:\/\/www.deeds.com\/articles\/could-ohio-make-property-taxes-unconstitutional-should-it\/\">property taxes<\/a>. The buyer can make alterations (within the limits of zoning or homeowners\u2019 association rules). The buyer doesn\u2019t need the lender\u2019s approval to refresh the kitchen, replace the roof, or put in a native garden.<\/p>\n\n\n\n<p>Granted, a homeowner has to keep an insurance policy on the home; the lender will insist on it. And if the borrower ever stops repaying the loan, the lender has the right to the value of the home that\u2019s collateral for the debt.<\/p>\n\n\n\n<p>In short, the buyer is a homeowner who must adhere to the terms of the mortgage. All of that acknowledged, different states have different laws on who holds the deed. Let\u2019s check \u2018em out.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Simple Answer, If You Buy a Home in a \u201cMortgage State\u201d<\/h2>\n\n\n\n<p>Some states use standard mortgage agreements. In these states, the buyers do actually hold their titles. This means a homeowner will keep the title in a drawer or file cabinet, along with the rest of the household\u2019s property documents. The lender does not hold the home\u2019s title during the term of the mortgage.<\/p>\n\n\n\n<p>The mortgage company is merely lending money, so it records a <em>lien<\/em> to show its claim in case of a borrower\u2019s default. To use the fancy legal language, states that use mortgage liens are based on the <em>lien theory <\/em>of law.<\/p>\n\n\n\n<p>Once the borrower fully pays off the loan, a <em>deed of release<\/em> goes into the public record, attesting to the mortgage satisfaction and officially releasing the lien.<\/p>\n\n\n\n<p>Here\u2019s the good part about this whole set-up, from a borrower\u2019s point of view. If the borrower becomes unable to pay the mortgage, the lender has to undertake a<em> judicial foreclosure <\/em>to take over the property. This gives a borrower the right to a day in court. Only with the court\u2019s approval may a home be auctioned off by the lender. &nbsp;<\/p>\n\n\n\n<p>States that use mortgage agreements do this because they\u2019re following in the footsteps of the lawyers who argued, in an 18<sup>th<\/sup>-century South Carolina courtroom, that a court\u2019s approval should be necessary before a lender acquires the title to someone\u2019s home. North Carolina might be \u201cfirst in flight\u201d but South Carolina is first in mortgage law!<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size\" style=\"padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\"><em><strong>Look here to see if the home you\u2019re buying is <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/articles\/youve-paid-off-the-mortgage-what-happens-now\/#:~:text=on%20your%20home.-,Mortgage%20States,-In%20%E2%80%9Clien%20theory\"><strong><em>located in a mortgage state<\/em><\/strong><\/a><em><strong>.<\/strong><\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Here\u2019s How It\u2019s Different in a \u201cDeed of Trust State\u201d<\/h2>\n\n\n\n<p>The states that use <em>deeds of trust<\/em> are the ones that didn\u2019t adopt South Carolina\u2019s reform. In these so-called&nbsp;<em>title theory states<\/em>, the title sits in a trust on behalf of the lender. Escrow companies manage these trusts. &nbsp;<\/p>\n\n\n\n<p>What is <em>title theory<\/em>? It means the lender retains title rights. Meanwhile, the borrower has the right to use the home.<\/p>\n\n\n\n<p>A deed of trust names the borrower, lender, and a trustee. The trustee holds the title as long as there\u2019s a loan on the property. So, the legal owner of the home is the lender. &nbsp;<\/p>\n\n\n\n<p>Even so, the borrower is known as a homeowner. It\u2019s just that the title isn\u2019t among the buyer\u2019s loan documents at closing. Only after the very last mortgage payment will the trustee release the title to the homeowner. That <a href=\"https:\/\/www.deeds.com\/articles\/the-golden-years-with-a-paid-off-mortgage\/\">final and complete pay-off<\/a> is called <em>mortgage satisfaction<\/em>. It triggers defeasance. Look for a&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/who-owns-your-home-you-or-the-bank-check-for-a-defeasance-clause\/\"><em>defeasance clause<\/em><\/a> in your loan documents. The clause means the lender holds onto the home\u2019s title for the duration of the home loan.<\/p>\n\n\n\n<p>At this point, generally within three weeks (check the requirements under the state\u2019s law)&nbsp;the lender signs and notarizes a&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/the-deed-of-reconveyance\/\"><em>deed of reconveyance<\/em><\/a>, passing title to the homeowner, free and clear.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size\" style=\"padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\"><em><strong>Look here to see if the home you\u2019re buying is in one of the <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/articles\/youve-paid-off-the-mortgage-what-happens-now\/#:~:text=Deed%20of%20Trust%20States\"><strong><em>deed of trust states<\/em><\/strong><\/a><em><strong>.<\/strong><\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">In Deed of Trust States, Lenders Have an Edge Over the Borrowers<\/h2>\n\n\n\n<p>What\u2019s the edge? Imagine a struggling borrower, who stops paying off the loan balance at some point. The loan account goes into default. Because the lender has access to the title through the trust, the lender need not go to court before reclaiming the title from the escrow company and auctioning the home off.<\/p>\n\n\n\n<p>The lender submits proof of the borrower\u2019s default to the trustee, and requests a foreclosure proceeding. If the borrower misses the lender\u2019s final call to resolve the debt, the trustee takes control of the title, and the loan, and auctions the property to recoup the lender\u2019s outstanding funds.<\/p>\n\n\n\n<p>This is what\u2019s known as <em>non-judicial foreclosure<\/em>. The procedures are laid out by state law. The law will say how much time the borrower gets to resolve the default before receiving notice of a trustee sale. Notice of the sale will be publicly recorded. It will be printed in the local legal newspaper.<\/p>\n\n\n\n<p>Unlike with a regular mortgage, the borrower won\u2019t be called to appear in court. A judge won\u2019t hear the struggling borrower\u2019s story.<\/p>\n\n\n\n<p>At auction, the trustee will convey ownership to a bidder with a&nbsp;<em>trustee\u2019s deed<\/em>. Sale proceeds will resolve the lender\u2019s balance, if possible.<\/p>\n\n\n\n<p>As you can see, a deed of trust in place of&nbsp;a mortgage is&nbsp;the lender\u2019s preference. Meanwhile, a buyer is in a somewhat stronger position with a regular mortgage.<\/p>\n\n\n\n<p>In hybrid or \u201cintermediary\u201d states, preference matters, because the parties have options. Yes, some states allow either a mortgage or a deed of trust in home financing transactions. If you get a mortgage with a&nbsp;<em>power-of-sale clause<\/em>, that\u2019s an indication of a hybrid. The lender can bypass the court and hold a trustee sale \u2014 <em>after <\/em>obtaining a court order.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size\" style=\"padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\"><em><strong>Check here to see if the home you\u2019re buying happens to be located in a <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/articles\/youve-paid-off-the-mortgage-what-happens-now\/#:~:text=West%20Virginia-,Hybrid%20States,-As%20it%20expedites\"><strong><em>hybrid state<\/em><\/strong><\/a><em><strong>.<\/strong><\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Anyway, After the Final Payoff, the Home\u2019s All Yours, Right?<\/h2>\n\n\n\n<p>Yes, although\u2026<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>As long as you own real estate, you\u2019ll be paying property taxes to fund local government and services.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You should still be paying for homeowners\u2019 insurance, even though you\u2019ll no longer have a lender looking over your shoulder to insist on it.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You\u2019ll need to keep up with your local homeowners\u2019 association assessments.<\/li>\n<\/ul>\n\n\n\n<p>These obligations will need your ongoing attention.
