It had a&nbsp;purpose: to stop\nswindlers from cheating buyers, by ascertaining that land was, in fact, owned\nby the person selling it.<\/p>\n\n\n\n<p>Since then,\nit has grown into a multi-billion-dollar&nbsp;business.&nbsp;<\/p>\n\n\n\n<p>And while\ntoday&#8217;s&nbsp;title insurance&nbsp;industry ostensibly protects homeowners from\ndefects in their deeds, some believe it&nbsp;has been rendered practically\nobsolete in the digital age. Today,&nbsp;a&nbsp;record search&nbsp;can be done\nfor less than a tenth of the prevailing&nbsp;rate of title insurance\u2014which can\nexceed&nbsp;$2000, depending on the home&#8217;s price and the state in which the\nproperty&nbsp;sale occurs.&nbsp;<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Outdated\nand&nbsp;Overpriced?&nbsp;<\/h2>\n\n\n\n<p>Imagine you&#8217;re refinancing your\u00a0home. Check out the price of the title\u00a0insurance you might expect for your own state and township with this\u00a0<a href=\"http:\/\/facc.firstam.com\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">calculator<\/a>\u00a0from First American.<\/p>\n\n\n\n<p>You will pay\nfor this&nbsp;insurance in order to comply with the rules of secondary mortgage\ncompanies, and a dated set of state laws. Many of these laws first took effect\nin the name of consumer protection, after a spate of\nDepression-era&nbsp;insurance company bankruptcies left buyers stranded with\ntheir title claims. Even today, most states prohibit general insurance\ncompanies from moving in on the title giants, or from&nbsp;providing guarantees\ntantamount to title insurance.&nbsp;<\/p>\n\n\n\n<p>Thus insulated from normal competition, title insurers\u00a0slid into a <a href=\"https:\/\/www.latimes.com\/archives\/la-xpm-1999-oct-15-fi-22484-story.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">troubling history<\/a> of inducing mortgage reps, developers, and real estate agents to steer\u00a0business their way.<\/p>\n\n\n\n<p>California-based\nFirst American Title<sup>TM&nbsp;<\/sup>is the industry&#8217;s largest company. First\nAmerican started&nbsp;copying and&nbsp;delivering records back in 1894, and\nbecame&nbsp;a&nbsp;title guaranty&nbsp;provider in 1924. Today, First American\nmakes heavy use of automation and offshore data entry personnel. It is highly\nunlikely to overlook&nbsp;missing heirs, unknown easements, outstanding liens,\nor any glitches in the public records. Modern&nbsp;technology has made latent\ndefects in deeds\u2014and thus insurance payouts\u2014rare.<\/p>\n\n\n\n<p>Yet the industry\ncontinues to profit greatly, for reasons increasingly out of step with the\ntimes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Owner&#8217;s\nPolicy Sold Separately\u2014Except in Iowa<\/h2>\n\n\n\n<p>If home\nbuyers need any further reason to question&nbsp;the monopoly of a handful of\ntitle insurers throughout the country,&nbsp;here it is.&nbsp;These companies\nare selling the buyer a&nbsp;<em>lender&#8217;s<\/em>\ntitle&nbsp;insurance policy. This protects the financial institution, not the\nbuyer, from incurring costs should any unknown title claims arise after the\nclosing. Thus, the homeowners foot&nbsp;the bill&nbsp;to cover&nbsp;their\nmortgage lender&#8217;s peace of mind and not their own.<\/p>\n\n\n\n<p>Buyers can\nget title insurance to protect themselves as well, but they have to buy that\nseparately. There are, in other words, two&nbsp;types of title insurance\nproducts: the lender&#8217;s, which must be paid,&nbsp;and owner&#8217;s title insurance,\nwhich is typically&nbsp;optional.<\/p>\n\n\n\n<p>Many buyers decide to obtain an owner&#8217;s insurance policy (indeed, the U.S. government <a href=\"https:\/\/www.consumerfinance.gov\/ask-cfpb\/what-is-owners-title-insurance-en-164\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">encourages<\/a>\u00a0it)\u00a0to avoid getting stuck with the\u00a0costs of possible clouds on the title. Common problems that plague titles can\u00a0involve past incidents of\u00a0<a href=\"https:\/\/www.deeds.com\/articles\/category\/deed-fraud\/\">deed fraud or forgery<\/a>. \u00a0<\/p>\n\n\n\n<p>Home buyers\nin Iowa are already covered. The policy from Iowa Title Guaranty covers owners\nat&nbsp;no extra charge, for houses valued up to&nbsp;$500,000, as long as the\nbuyer&nbsp;intends to live in the home&nbsp;as a&nbsp;primary residence.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why\nIowa&#8217;s Model Stands Out<\/h2>\n\n\n\n<p>Iowa is\nunique. The state doesn&#8217;t just&nbsp;keep&nbsp;records of property transactions;\nit&nbsp;guarantees them.&nbsp;<\/p>\n\n\n\n<p>In 1947, Iowa abolished\u00a0title insurance. By 1987, the state had established\u00a0<a href=\"https:\/\/www.curbed.com\/2018\/2\/26\/17017142\/title-insurance-scam-government-takeover\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Iowa Title Guaranty\u2014the only title insurance purveyor allowed to operate in the state<\/a>. (There are some exceptions. A\u00a0buyer who opts to use\u00a0an out-of-state lender might be paying a title insurance company based outside Iowa.)<\/p>\n\n\n\n<p>Because the\nstate is the insurance purveyor, an Iowa home buyer can have a title insured\nfor&nbsp;around a tenth of what most people throughout the country are forced\nto agree to at closing. There are no title insurance agents needed, as\nstate-certified <a href=\"https:\/\/www.deeds.com\/articles\/the-abstract-of-title-in-real-estate-what-is-it\/\">abstractors<\/a>&nbsp;perform\na thorough examination of the home&#8217;s history. Any title issues&nbsp;must be\nremedied&nbsp;before closing.<\/p>\n\n\n\n<p>In short, Iowa\u2019s state-managed\u00a0title insurance offers at least the same\u00a0level of protection private companies do, for a fraction of the cost.\u00a0For a\u00a0<a href=\"http:\/\/www.iowafinanceauthority.gov\/TitleGuaranty\/Residential\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">residential transaction<\/a>, $140 covers a title of a home valued at $500,000 or less, with\u00a0an additional $1 per thousand for more expensive homes.\u00a0Most endorsements are free.<\/p>\n\n\n\n<p>The system&#8217;s\u00a0<a href=\"http:\/\/www.iowafinanceauthority.gov\/TitleGuaranty\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">profits are then re-invested<\/a> in Iowa, to fund affordable housing initiatives for Iowans.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Nationwide\nTransformation to Come<\/h2>\n\n\n\n<p>The\ntransformation made possible through digital advancements couldn&#8217;t happen to a\nbetter industry. Already, real estate title&nbsp;records, traditionally\navailable&nbsp;to the public, are becoming truly accessible online. Today, it\ntakes seconds&nbsp;to look up a home&#8217;s price and transaction history, appraised\nvalue, applicable taxes, and physical description. As property records become\nopenly accessible,&nbsp;accurate, and comprehensive, title insurance would\nappear to be less of an imperative. &nbsp;<\/p>\n\n\n\n<p>We can\nexpect the trend to continue. For example, <a href=\"https:\/\/www.deeds.com\/articles\/the-real-estate-deal-decluttered-blockchain-and-deed-recording\/\">blockchain\nis poised to create&nbsp;solutions that improve&nbsp;title accuracy<\/a>, and\nminimize&nbsp;the risk&nbsp;of defects. Once the blockchain records an accurate\ntitle, it will continually record and protect,&nbsp;in real time,\nevery&nbsp;transaction to come. Should the real estate&nbsp;sector follow\ninnovative counties and broadly adopt&nbsp;blockchain technology, homes will\ntake on traits of&nbsp;liquid commodities.&nbsp;Watch for the&nbsp;title\ninsurance industry to reinvent itself&nbsp;yet again, with big&nbsp;companies\nbecoming&nbsp;data gatekeepers to stay relevant.&nbsp;<\/p>\n\n\n\n<p>This\ntransformation will take a few years to happen. Hundreds of counties are just\nstarting to embrace online document recording and&nbsp;digital notarization.\nYet the industry&#8217;s trajectory is already clear.
