In many people\u2019s lives, a deed is the key asset. It can be passed along to your chosen beneficiary through a will. And no matter what other instruments you might use, <a href=\"https:\/\/www.deeds.com\/articles\/dont-be-the-intestate-homeowner-write-your-will\/\">you absolutely do need a will<\/a>.<\/p>\n\n\n\n<p>In short, the will can be your core estate planning document. Still, you might want or need more. Here are some points to consider.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">If Your Name Alone Is on the Deed, It Can Pass Through the Will<\/h2>\n\n\n\n<p>Maybe you own your home as a solo deed holder. If so, it\u2019s fine to pass your title along to your chosen beneficiary in your will. You can also use a will to transfer a co-owned title that the co-owners vested as <em>tenants in common.<\/em><\/p>\n\n\n\n<p>Of course, you could simply use a <a href=\"https:\/\/www.deeds.com\/quitclaim-deed\/\"><em>quitclaim deed<\/em><\/a>&nbsp;and pass your interest to someone now. But a will has advantages in many cases, including the possible benefit of a stepped-up cost basis (that is, lower capital gains tax) if your beneficiary wishes to sell the real estate. Probate is a public, court-supervised process to distribute your assets according to the directions stated in your will.<\/p>\n\n\n\n<p>It\u2019s good to remember that <a href=\"https:\/\/www.deeds.com\/articles\/only-my-name-is-on-the-deed-will-my-spouse-inherit-it\/\">the transfer might not be automatic<\/a>. When your will goes into probate, your named executor will need to satisfy your debts (<a href=\"https:\/\/www.deeds.com\/articles\/when-a-homeowner-dies-what-happens-to-the-home\/#:~:text=What%20If%20the%20Deceased%20Owner%20Still%20Has%20Mortgage%20Debt\">including the mortgage balance<\/a>) first, before passing along your deed (or its left-over equity).&nbsp;<\/p>\n\n\n\n<p>Even in a <a href=\"https:\/\/www.deeds.com\/articles\/moving-to-a-community-property-state-heres-what-couples-should-know\/\">community property state<\/a> (where property acquired&nbsp;<em>during marriage<\/em>&nbsp;becomes joint), a home can still be set aside or \u201creserved\u201d as sole property. If you owned the home before marrying, or if someone gifts or bequeaths a home to you, you may continue to keep it as sole and separate property. A family or estate lawyer can draft a legal agreement to this effect. Then, you can bequeath the home through your will. Your specific state\u2019s law can tell you more.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A Jointly Held Deed Won\u2019t Pass Through the Will<\/h2>\n\n\n\n<p>But <a href=\"https:\/\/www.deeds.com\/articles\/what-happens-when-wills-and-deeds-conflict\/#:~:text=In%20case%20of%20a%20conflict%2C,way%20the%20title%20is%20vested.\">what your will says about your deed<\/a> won\u2019t matter if your home is vested jointly with survivorship rights. So, check your deed.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size\" style=\"padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\"><em><strong>Get a <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/copy-of-your-deed\/\"><strong><em>copy of your real estate deed<\/em><\/strong><\/a><em><strong>.<\/strong><\/em><\/p>\n\n\n\n<p>This is the case if the deed says you co-own as joint tenants with rights of survivorship. The&nbsp;<em>tenancy by the entirety<\/em>&nbsp;vesting form also comes with survivorship rights.<\/p>\n\n\n\n<p>If another person is vested with rights of survivorship, then at the time of your passing, your interest in the deed goes to your co-owner, by law.<\/p>\n\n\n\n<p>Your co-owner will need to <a href=\"https:\/\/www.deeds.com\/articles\/when-a-homeowner-dies-what-happens-to-the-home\/#:~:text=survived%20the%20deceased%20deed%20holder\">notify the county recorder\u2019s office<\/a> to officially record their full ownership of the home you co-owned while living.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Some Property Can Bypass the Will<\/h2>\n\n\n\n<p>Perhaps you have an interest in trust property. That asset passes to the trust beneficiaries separately from a will, to bypass probate.<\/p>\n\n\n\n<p>Be careful not to consider trust property as an asset for your will to transfer. Sending mixed messages could mean leaving an important personal decision to a probate court.<\/p>\n\n\n\n<p>Similarly, if your state allows property to pass through a <em>transfer on death deed<\/em>, and you decide to use this method, the property passes outside of probate and the will.<\/p>\n\n\n\n<p>While we\u2019re on the topic, remember that life insurance proceeds and retirement account funds pass to the beneficiaries, not through your will.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Important Reminders<\/h2>\n\n\n\n<p><em>Deeds.com&nbsp;<\/em>does not offer legal, tax, or financial guidance.
