And you\u2019re thinking of how your deed will eventually transfer your new home to loved ones. &nbsp;<\/p>\n\n\n\n<p>The way you <a href=\"https:\/\/www.deeds.com\/articles\/hows-your-property-vested-it-matters-as-much-as-your-will-or-trust\/\">vest ownership with your deed<\/a> supports your goals. Be ready when the title company poses this question.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">The Main Ways Seniors Hold Title to a Home<\/h2>\n\n\n\n<p>The most common ways seniors hold title to real estate include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Sole ownership<\/strong> \u2014 one person owns the property alone.<\/li>\n\n\n\n<li><strong>Joint tenancy with right of survivorship (JTWROS)<\/strong> \u2014 ownership automatically transfers to surviving co-owners.<\/li>\n\n\n\n<li><strong>Tenancy in common<\/strong> \u2014 owners hold separate shares that can pass to heirs.<\/li>\n\n\n\n<li><strong>Revocable living trust<\/strong> \u2014 the property is owned by a trust and transferred according to trust instructions.<\/li>\n\n\n\n<li><strong>Transfer-on-death (TOD) deed<\/strong> \u2014 names a beneficiary who receives the property without probate.<\/li>\n<\/ul>\n\n\n\n<p>Each option has different implications for probate, inheritance, and control of the property.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Sole Ownership: Holding Title to Property Alone<\/h2>\n\n\n\n<p>You alone are named as owner on the deed. This works for solo seniors.<\/p>\n\n\n\n<p><strong>Pros:<\/strong> Sole ownership is the simplest form of title holding. Your property isn\u2019t subject to a co-owner\u2019s debts. There are no other owners who must sign when you want to sell or refinance\u2014the decisions are all yours.<\/p>\n\n\n\n<p><strong>Cons:<\/strong> Naming only yourself means no one has survivorship rights. The probate court will distribute the property, ideally in accordance with a will you\u2019ve kept updated and easy to find.<\/p>\n\n\n\n<p>Can a solo owner avoid probate? Yes! See our section on living trusts below.&nbsp;<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size\" style=\"padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\"><em><strong>Where available, the <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/transfer-on-death-deed\/\"><strong><em>transfer on death deed<\/em><\/strong><\/a><em><strong> is a relatively simple form for designating a beneficiary who will automatically receive the property\u2014no probate. The owner must sign, notarize, and record the deed. (The insurer needs to know the TODD exists so your beneficiary will need to be a named insurance beneficiary when you pass.)\u00a0<\/strong><\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Joint Tenancy: Ensuring Survivorship<\/h2>\n\n\n\n<p>If you specify on your deed that you co-own the home as joint tenants with right of survivorship (JTWROS), then you share the property equally, and together.<\/p>\n\n\n\n<p><strong>Pros:<\/strong> JTWROS bypasses probate. When one co-owner dies, the share that belonged to the deceased now belongs to the survivor(s). This form of titling is a simple way to distribute property. &nbsp;It is popular among married and unmarried couples.<\/p>\n\n\n\n<p><strong>Cons:<\/strong> Co-owners with blended families must use caution that their heirs aren\u2019t overlooked when a new spouse is the surviving owner. The survivor needs to remember to do estate planning, or the property will still be going into probate eventually.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Tenancy in Common: Can Be Unequal Shares<\/h2>\n\n\n\n<p>People named as tenants in common on the deed can co-own 50-50%, or different percentages. This form of vesting the title can work for friends who each want their own share of the property. This is different from owning the home together and automatically passing the value to one another upon death (see above).<\/p>\n\n\n\n<p><strong>Pros:<\/strong> Each person\u2019s share can be transferred or willed to whomever that owner selects. This allows each senior to designate their own beneficiary. Each owner may sell their own share.<\/p>\n\n\n\n<p><strong>Cons:<\/strong> When one co-owner dies or sells to a third party, the surviving one may end up with new co-owners.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size\" style=\"padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\"><em><strong>Moving to a community property state? Creating a <a href=\"https:\/\/www.deeds.com\/articles\/can-i-quitclaim-my-house-into-a-living-trust\/\">revocable living trust<\/a> can make it happen. You, together with any co-owner(s), can&nbsp;quitclaim the home into the name of your trust. Be sure to <a href=\"https:\/\/www.deeds.com\/forms\/#:~:text=conditions%20for%20content%20and%20format\">meet the standards<\/a> for notarization, format and content.<\/p>\n\n\n\n<p>You can name yourself as trustee, and keep full control over your home and its equity. Name your spouse or other trusted person as successor trustee. This person can act for you if (and for so long as) you become incapacitated.<\/p>\n\n\n\n<p><strong>Pros:<\/strong> When you pass, your home will be distributed without probate, per the instructions in your trust. Until then, you control the revocable trust.<\/p>\n\n\n\n<p><strong>Cons:<\/strong> You\u2019ll need a lawyer to go over your trust, and a trustee to handle the trust after your passing. You\u2019ll need additional estate planning documents to address your other assets. Don\u2019t die&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/dont-be-the-intestate-homeowner-write-your-will\/\"><em>intestate<\/em><\/a>!<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">So Many Choices!
