Of course, co-ops can be found nationwide. What are the rules for bequeathing these units to an unmarried partner? Does the co-op board have to approve the beneficiary when the time comes?<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">First, Read the Directions<\/h2>\n\n\n\n<p>A co-op comes with documents. There\u2019s a share agreement and a proprietary lease. What does the legal paperwork tell you about how shares can be passed along? Does it allow you to pass your share to an unmarried partner?<\/p>\n\n\n\n<p>In many cases, married people, or couples in domestic partnerships, can leave each other their co-op shares with no need for a board to sign off. Some co-op documents say a transfer of the co-op share cannot be barred without a good (legal or financial) reason.<\/p>\n\n\n\n<p>Traditional co-op rules may restrict property inheritance to legal or biological family members. And some may accept transfers to<em> immediate<\/em> relatives\u2014but not to others.<\/p>\n\n\n\n<p>If you become married or domestic partners, a board may be fine with adding your partner to the paperwork and lease. First, there\u2019d be a financial review. Expect administrative fees. In other words, you\u2019d need to go through the board approval process again\u2014this time, together. If the board does issue an approval, you would become joint tenants.<\/p>\n\n\n\n<p>If your partner already lives with you, and becomes known to the board, this could be a smooth transition. But would simply leaving the share through a will be sufficient, regardless of whether the board approves?<\/p>\n\n\n\n<p>It\u2019s typically more complicated than that. Getting married and creating survivorship rights could mean having to submit a new application to the co-op board. So, board approval is likely to be necessary, no matter which way you go.<\/p>\n\n\n\n<p>A good starting point is to approach the board and request approval for your partner to be a present or successor shareholder. The board may wish to meet your partner, review their ability to pay, and sign off on a change of shareholder. Whereas you were previously the sole shareholder of record, there would now be two shareholders.<\/p>\n\n\n\n<p>In short: Ask the board if a path can be made for your partner. If there are any questions at all, have an attorney with co-op experience guide you.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size\" style=\"padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\"><em><strong>Whether you\u2019re young or young at heart, it\u2019s never too soon to make your ultimate intentions clear. <\/strong><\/em><a href=\"https:\/\/www.deeds.com\/articles\/only-my-name-is-on-the-deed-will-my-spouse-inherit-it\/#:~:text=What%20Happens%20If%20You%20Leave%20No%20Will\"><strong><em>Write a will<\/em><\/strong><\/a><em><strong>.<\/strong><\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Does It Matter What I Say About the Co-op Property in My Will?<\/h2>\n\n\n\n<p>You can leave assets to anyone through your will. That alone does not mean anyone can move into your co-op unit by presenting the will.<\/p>\n\n\n\n<p>Bequeathing a co-op share for the purpose of the beneficiary <em>selling<\/em> the share upon your passing could be acceptable under the terms of your share agreement. Your will might name an executor who sells upon your passing. Assuming any loans or debts on the property can be paid off, your partner could then use the co-op sale proceeds to shop for a different home.<\/p>\n\n\n\n<p>Could your partner be the co-op buyer? Possibly. Yet co-op boards can turn down a hopeful buyer\u2014as long as relevant anti-discrimination laws are followed.&nbsp;Your county and state fair housing laws can inform you further on that.<\/p>\n\n\n\n<p>But why would this be a tough question? First, note that a co-op collectively owns the building(s) and land. Rather than receiving a deed to property, you received a stock certificate in the corporation.<\/p>\n\n\n\n<p>That said, you hold a title to the shares and a proprietary lease. And <a href=\"https:\/\/www.deeds.com\/articles\/hows-your-property-vested-it-matters-as-much-as-your-will-or-trust\/\">your title is vested<\/a>.<\/p>\n\n\n\n<p>In New York, the default form of vesting co-op titles (for couples) is tenants by the entirety.&nbsp;Each person has an undivided interest in the entire share; neither can sell their share alone. When one co-owner dies,&nbsp;the survivor takes title to the shares and the proprietary lease.&nbsp;(Divorce turns the ownership into a&nbsp;joint tenancy.)&nbsp;<\/p>\n\n\n\n<p>Now, unlike condo unit owners, co-op shareholders don&#8217;t own their interior space. Generally, both names of a couple must appear on the stock certificate if the couple intends to have survivorship rights.<\/p>\n\n\n\n<p>Being named in a will does not automatically give a partner rights on the stock certificate. Co-ops need to review the financial capacity of a prospective new shareholder. So, even heirs have to pay a fee, submit an application, and wait to be vetted before they are accepted into the co-op. A board has a fiduciary duty to the whole community to make sure every new shareholder can afford the co-op lease. The board is free to reject any applicant\u2014even one who happens to be an heir of a longtime shareholder.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What About a Trust or LLC Arrangement?<\/h2>\n\n\n\n<p>Here again, your goal is to bring your partner in as a shareholder, and as a holder of the proprietary lease. Usually this means having paperwork reissued to become tenants by the entirety or joint tenants with survivorship rights.<\/p>\n\n\n\n<p>Some couples may ask if it\u2019s helpful to place the shares in a <a href=\"https:\/\/www.deeds.com\/articles\/holding-real-estate-in-a-trust-or-an-llc\/#:~:text=The%20Revocable%20(Living)%20Trust\">revocable trust<\/a>. The partner could then be named as the co-trustee and beneficiary in the trust instrument.<\/p>\n\n\n\n<p>Some may wonder if a limited liability company (LLC) could be a means of holding and managing shared assets.<\/p>\n\n\n\n<p>These are incomplete strategies, though. Placing your shares in an LLC or a trust (even an irrevocable trust) will not help you bypass any rules established by the co-op. This is because setting up the trust or conveying the shares to an LLC would not be allowed without the co-op board\u2019s approval.<\/p>\n\n\n\n<p>Plan for what you\u2019ll do when\/if you receive the co-op\u2019s go-ahead. Your attorney might advise you to place your shares into a revocable trust. When you pass, your beneficiary can bypass the probate court.<\/p>\n\n\n\n<p>Either way, you and your partner would be wise to have a separate legal agreement in place that speaks to what will happen if you part ways. &nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Each Co-op Agreement Is Unique<\/h2>\n\n\n\n<p>Your simplest path is to transfer your titled interests (the proprietary lease and co-op shares) from yourself to you and your partner with survivorship rights. But do get case-specific legal advice first.<\/p>\n\n\n\n<p>There is no one set answer to a co-op inheritance question. And if you\u2019re considering entering into a marriage or legal partnership, that will have other legal impacts in your lives. It\u2019s important to speak with an estates-and-trusts lawyer and a real estate lawyer who\u2019s experienced in co-op law in your state. And no matter your marital status, it\u2019s vital to meet with a financial adviser or tax expert and walk through the situation-specific points of sharing real estate.<\/p>\n\n\n\n<p>Legal assistance may be available in your area.
