In January, the state raised the price of an <a href=\"https:\/\/www.deeds.com\/articles\/home-buyers-need-title-companies-agents-shouldnt-be-getting-paid-to-select-them\/\">owners\u2019 title policy<\/a> for the first time in 24 years.<\/p>\n\n\n\n<p>This hike has taken effect throughout Ohio.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">New Title Insurance Prices Apply Statewide in Ohio<\/h2>\n\n\n\n<p>The Ohio Title Insurance Rating Bureau approves changes, and the same prices apply statewide. In other words, the core rates for title insurance are the same for all title agencies in Ohio.<\/p>\n\n\n\n<p>For a home buyer, this means any \u201cshopping around\u201d is done to get the best service\u2014not the best price. But different companies could have different special credits and offers. And they could have different fees for transfers, closing, and so forth.<\/p>\n\n\n\n<p>In any case, if you\u2019re a home buyer, you\u2019ll want to know who pays for various title services\u2014buyer or seller? Ask your agent when you\u2019re preparing to negotiate with your seller.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Impact of Ohio\u2019s 2026 Title Policy Premium Hike<\/h2>\n\n\n\n<p>With a minimum premium of $225 for a title policy, the American Land Title Association rates in Ohio now add up to $5.80 for every $1,000 in the property\u2019s value, for the first $250K. Rates on the property\u2019s value over and above $250K are calculated on a gradually easing scale.<\/p>\n\n\n\n<p>So, how does the updated rate impact sellers and buyers from 2026 on? The higher premium makes a difference for buyers adding up all the <a href=\"https:\/\/www.deeds.com\/articles\/out-of-control-title-insurance-and-other-extras-home-buyers-pay\/\">\u201cextra\u201d closing fees and costs<\/a>. Buyers may be wondering what these swelling costs do for a title. Should a buyer point out the hike and negotiate all the more for concessions from a seller? This is a question for you and your agent to discuss.<\/p>\n\n\n\n<p>Whether or not you have an agent, you might find other paths to savings. Ask your mortgage pro: Do I get a discount from the title company for buying a lender\u2019s policy and an owner\u2019s policy at the same time? (Rates for lenders have gone up in price this year, just as owners\u2019 policy rates have.) &nbsp;<\/p>\n\n\n\n<p>Also ask: Could there be a policy covering the title already? Could it be reissued when the home changes hands? The question is what possible savings can be discovered before the final loan papers get to the closing table!<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why the Hike, and Why Now?<\/h2>\n\n\n\n<p>According to Frank J. Rose, Ohio State Counsel for Old Republic Title Company, these changes\u2014the first since 2002\u2014were necessary because:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ohio title insurance rates are based on average property valuations, plus the amount of title work normally involved.\u202f<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ohio home values have just about doubled since the rate schedule was last changed. \u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Title agents deal with many more regulatory requirements today. More time and resources go into a deed transaction now.\u202f<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Claims from deed holders are on the rise. The internet has enabled sophisticated methods of fakery and fraud that weren\u2019t in play a quarter-century back.<\/li>\n<\/ul>\n\n\n\n<p>All things considered, says Rose, the new rate table is giving customers good value for the money. At the same time, Ohio title companies are getting a \u201cmore appropriate return on the work and risk involved\u201d in a deed transfer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Problems Can Title Insurance Solve?<\/h2>\n\n\n\n<p>Title insurance can cover legal costs if an issue arises with the ownership of a property.<\/p>\n\n\n\n<p>Title defects are leftovers\u2014loose ends from prior owners, prior links in the chain of title.<\/p>\n\n\n\n<p>You might think what you don\u2019t know can\u2019t hurt you. Or you just might not want to <a href=\"https:\/\/www.deeds.com\/articles\/home-buyer-turns-down-an-owners-title-policy-what-could-go-wrong\/\">pay for title insurance<\/a> at all. Still, consider this. You\u2019re paying for the lender\u2019s version of this product in any case. The lender thinks about a title and says: Yep, I want to insure this loan collateral. It stands to reason that you, as the homeowner, have a deeper, longer interest in your property\u2019s worth. So, why not make sure you, too, have coverage\u2014in your own name?<\/p>\n\n\n\n<p>Buying an owner\u2019s policy is your option. It\u2019s not mandatory. Your decision is about shouldering risk. The unknown factor? Whether anything\u2019s amiss in the title\u2019s history.<\/p>\n\n\n\n<p>Problems occasionally overlooked in the title search include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Claims on the title for unresolved tax bills, debts for services, legal judgments, or unpaid loans.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Improper transfers by an owner in the past.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Errors in the deed records (mistakes in a property\u2019s legal description, for example).<\/li>\n<\/ul>\n\n\n\n<p>Without title insurance, worst-case scenarios get serious. The value of the title is at stake. You could get mired in a court action if someone else thinks they have a claim on your title once the deed is in your hands. With a title policy written in<em> your <\/em>name, at least you\u2019ll have the title company\u2019s agreement to address any legally meaningful problems.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Standard Title Policy? Enhanced Policy? What\u2019s the Difference?<\/h2>\n\n\n\n<p>Now for the finer points. Title companies offer <em>standard<\/em> coverage, and <em>enhanced <\/em>coverage. A standard title insurance policy covers the usual problems. It\u2019s designed to help if an issue surfaces that should have been resolved before closing.<\/p>\n\n\n\n<p>Standard coverage typically protects against:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Improper filings in the county records.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Unpaid property taxes or other liens overlooked during the title search.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Unpredictable claims (from heirs, for example).<\/li>\n<\/ul>\n\n\n\n<p>So, buying a standard policy at closing protects a deed recipient from a range of possible problems that might have fallen through the cracks during title transfer.<\/p>\n\n\n\n<p>An enhanced owner\u2019s title policy has a number of extra features. A few examples are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Inflation protection. Your premiums won\u2019t rise later\u2014even though inflation will.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Protection for local code or ordinance violations. If the title has a marketability problem due to zoning infractions or safety code lapses, the policy may cover the costs of getting work redone.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Boundary or access disputes. This could apply retroactively or proactively. Ask the title agent.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Homeowner association issues. Coverage for unresolved dues, fees, and penalties recorded against the title in the past.<\/li>\n<\/ul>\n\n\n\n<p>Enhanced title coverage can address other unresolved property claims or assessments. Of course, getting the additional coverage means an extra charge. But closing day is the buyer\u2019s chance to make a one-and-done payment for a policy that lasts throughout the time of homeownership.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A Few Final Thoughts<\/h2>\n\n\n\n<p>Protecting your investment in your deed is essential. This is important\u2014just as the need for homeowner\u2019s insurance to protect your <em>physical <\/em>dwelling is important.<\/p>\n\n\n\n<p>Read the policy carefully and ask a title agent to clarify anything you find murky. Be clear about what protections you miss by <a href=\"https:\/\/www.deeds.com\/articles\/home-buyers-cover-your-assets-choosing-between-standard-and-extended-title-insurance\/\">passing up the extended coverage<\/a>.<\/p>\n\n\n\n<p>If you\u2019d like to better understand your options, call around and compare title companies. Ask the companies\u2019 representatives to explain their policies.
