Parents pass on, and then the adult children aren\u2019t speaking.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It can happen in any family. Well, you might think, I won\u2019t have to deal with such matters once I\u2019m gone. True. But your heirs (called \u201cbeneficiaries\u201d if you use a will or a <a href=\"https:\/\/www.deeds.com\/articles\/transfer-on-death-deed-second-thoughts\/\"><em>transfer on death deed<\/em><\/a>) will be here and you can give them a great gift. Plan in a way that derails disagreements before they ever begin.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here are eight planning ideas to help maintain family harmony after you\u2019re gone.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">1. Be Crystal Clear (Repeat).<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Use your will and other documents to speak to potential concerns. Precise wording in your estate documents makes your intentions clear. And expressing clear intentions makes it much less likely that your beneficiaries will question the distribution of property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An unclear will leads to disputes when you\u2019re no longer around to clarify. So be clear now. Repeat and flesh out your desires if there\u2019s any way to misunderstand them. Repeat them verbally to your beneficiaries at various times throughout your life and theirs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. Be Fair (Explain Your Decisions).<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Even when it makes sense in your heirs\u2019 situation, be careful with unequal distributions of property among your children. Deciding to leave the home to a particular adult child? Communicate your intentions. Repeat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Or just don\u2019t do it. You are perfectly free to leave instructions that the home is to be sold and the proceeds divided among your beneficiaries. Have a talk with the beneficiaries now, to get a buy-in for what you are planning.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Which leads us to how important it is to\u2026<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">3. Communicate (Repeat).<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Even if parents have sensible reasons for giving one child more than another (which is perfectly OK), resentment can surface among siblings after their parents are gone. Especially if there\u2019s little or no solid explanation for the way your property is passed on.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is one reason family meetings matter so much.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Get the family together and explain what led to specific decisions. This will impress upon your beneficiaries that thought went into your will. Hash out concerns now. It can save family ties later.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4. Consult an Estate Planning Attorney (Make a Plan).<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Deed holders should seek a full understanding of available options given their own circumstances. An attorney can offer guidance\u2014plus support for updating an estate plan later.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On that note, heirs don\u2019t do well with surprises. An added beneficiary? A change in your plan? A late decision to give to charity? These kinds of things can unsettle surviving family members. To make sure your loved ones know what\u2019s coming, and are prepared to handle their inheritances, a good lawyer can be a major help.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\"><strong><em>A lawyer can tell you if a trust is a good option. A <\/em><\/strong><a href=\"https:\/\/www.deeds.com\/articles\/can-i-quitclaim-my-house-into-a-living-trust\/\"><strong><em>home in a trust<\/em><\/strong><\/a><strong><em> bypasses the county probate court. Trusts can be designed to shield inherited property from third parties\u2019 claims, or to protect minors\u2019 inheritances.<\/em><\/strong><strong><em><\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">5. Pick the Right Rep (and Rest Easy).<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Someone will be the personal representative for your estate. To head off family battles, pick a person who will be regarded as fair, trustworthy, and financially astute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You could hire a lawyer or a professional executor\u2014from a bank and trust company, for example, or an estate planning law firm. Professional oversight can ensure that the property is distributed according to plan. This strategy can ensure that cool heads prevail at an emotionally charged time. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Name a successor in case your first choice isn\u2019t ready, willing, and able when the time comes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">6. Name Your Stepchildren (If They\u2019re Beneficiaries).&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Stepchildren aren\u2019t automatically legal heirs. You might not have to undertake a complete do-over. A codicil is a written amendment to an existing will that spares you the need to revoke your will.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Destroy old wills and give your beneficiaries and representative the new versions.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\"><strong><em>Probate is the \u201cproving\u201d of your will in court after you pass on. Homeownership that passes through a will goes to the chosen beneficiary by way of an <\/em><\/strong><a href=\"https:\/\/www.deeds.com\/personal-representative-deed\/#:~:text=executor%20or%20administrator%20deed\"><strong><em>executor\u2019s deed<\/em><\/strong><\/a><strong><em>. <\/em><\/strong><strong><em><\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">8. Put It in Writing (and in Your Own Voice).<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A will or a trust is hard to overturn\u2014but challenges do happen. Challengers might say someone put pressure on you, or that you weren\u2019t of sound mind, or that the will wasn\u2019t properly created and notarized. Consider recording the signing if your capacity, free will, or clear intent could later be questioned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Personal messages explaining your decisions can become strong support for legal documents. Most states allow you to refer in your will to a signed <em>personal property memorandum<\/em> that says who should receive specific personal belongings.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Our Relationships Matter More Than Our Homes. Mindful Estate Planning Matters.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Receiving your property is an honor for your beneficiaries. Often, it\u2019s a lifeline. And yet family relationships are important lifelines too\u2014at least as important as a deed.
