But what about a&nbsp;real estate\ndeed warranty? What are the common&nbsp;deeds, and what assurances do different\ndeeds make?&nbsp;Here&#8217;s what&#8217;s at stake for a new owner,&nbsp;depending&nbsp;on\nthe deed involved in the real estate sale. &nbsp;<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">The\nQuitclaim Deed: No Guarantees<\/h2>\n\n\n\n<p>A quitclaim\nsimply conveys legal ownership of&nbsp;property from one person to another.\nThere is no&nbsp;warranty, so there can be&nbsp;no recourse to the law for a\nbreach. Simply put, the recipient has&nbsp;no&nbsp;guarantee that the property\ncomes without <a href=\"https:\/\/www.deeds.com\/articles\/category\/liens\/\">liens<\/a>\nor&nbsp;encumbrances. The recipient gets whatever&nbsp;interest and\nwhatever&nbsp;title status the&nbsp;grantor had, and no more.<\/p>\n\n\n\n<p>When the\npeople involved have&nbsp;no&nbsp;question about the ownership interest being\ntransferred, the quitclaim deed is a simple and helpful instrument.\nA&nbsp;quitclaim deed can enable one family member to&nbsp;transfer an\nownership interest to another member of the&nbsp;family. It may be used when\none&nbsp;divorcing spouse relinquishes ownership to the other. The key point is\nthat the&nbsp;title status is not in question. Insofar&nbsp;as there are no\nliens, and <a href=\"https:\/\/www.deeds.com\/articles\/category\/fraud\/\">no&nbsp;other\nissues&nbsp;that could catch you&nbsp;unaware<\/a>, a quitclaim deed can do the\njob of transferring someone else&#8217;s&nbsp;interest over to you.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The\nGeneral Warranty Deed: Preferred for Most Real Estate Sales<\/h2>\n\n\n\n<p>A\u00a0general warranty deed\u00a0(often simply called a &#8220;warranty deed&#8221;)\u00a0covers\u00a0any issues that could arise out of the\u00a0entire chain of title.\u00a0In\u00a0arm&#8217;s length (non-family) transactions, a general warranty deed is the best assurance that a seller actually does own the property you&#8217;re buying. If there are any problems later, you will have legal\u00a0grounds to sue your seller for breach of\u00a0warranty.<\/p>\n\n\n\n<p>Examples of\nproblems are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Mistakes in the legal descriptions, or recording errors. <\/li>\n\n\n\n<li>Disputed boundaries.<\/li>\n\n\n\n<li>Unrecorded <a href=\"https:\/\/www.deeds.com\/articles\/the-real-estate-easement-a-guide-and-glossary\/#more-712\">easements<\/a>.<\/li>\n\n\n\n<li>Unknown prior conveyances of interests, or unsatisfied liens.<\/li>\n\n\n\n<li>Deed forgeries.<\/li>\n\n\n\n<li>Missing wills or heirs.<\/li>\n<\/ul>\n\n\n\n<p>When you get\na warranty deed, you&#8217;re assured that no liens or encumbrances exist&nbsp;that\naren&#8217;t obvious on the deed, so you won&#8217;t be bothered by unexpected&nbsp;title\nclaims by any other claimants to your property. The seller is obliged to defend\nyou against any claimant, and compensate you for any resulting damages.<\/p>\n\n\n\n<p>Yet\nfortunately for today&#8217;s buyers, title insurance is protection against any\nproblems lurking in the chain of title.&nbsp;Insurance is important even when a\nwarranty deed is used. The insurance policy covers claims that the seller\ncouldn&#8217;t account for, such as local ordinances&nbsp;and zoning issues.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The\nSpecial Warranty Deed: Splitting&nbsp;Risk Between Grantor and Grantee<\/h2>\n\n\n\n<p>A&nbsp;special\nwarranty deed&nbsp;provides a&nbsp;lesser guarantee of&nbsp;ownership of the\nproperty, and a lower level of protection from the risk of title defects. The\nseller is liable for any title problems during the time the seller had the\nproperty, while you, the buyer, must resolve issues from earlier in the chain\nof title. Thus, special warranty deeds are also known as <em>limited warranty deeds<\/em>.&nbsp;<\/p>\n\n\n\n<p>Special\nwarranty deeds&nbsp;commonly appear&nbsp;between businesses in commercial real\nestate transactions. They also appear in probate court,&nbsp;where\na&nbsp;personal representative has no knowledge of a home&#8217;s history before the\nprobate process.&nbsp;\u200b<\/p>\n\n\n\n<p>Why do we\nsay this deed is splitting&nbsp;risk? Because when you acquire property with a\nlimited warranty,&nbsp;a&nbsp;future claim could arise from a time that dates\nback to an ownership&nbsp;at some point in the past.&nbsp;In that case you\nmight have no&nbsp;recourse against the person who conveyed the home to you.\nYour title insurance may not extend coverage&nbsp;back to a lien or mortgage\nclaim against an earlier owner, and you may have no choice but to resolve the\ndebt.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The\nGrant Deed: Not a Title Warranty<\/h2>\n\n\n\n<p>A few\nstates, such as&nbsp;California, permit the use of grant\ndeeds.&nbsp;A&nbsp;grant deed gives you protections a lot like those of a\nwarranty deed. You&#8217;re safe from claims that someone else still owns an interest\nor has a lien on your home.<\/p>\n\n\n\n<p>But\nyour&nbsp;grant deed is <em>not<\/em>\na warranty against third-party claims.&nbsp;Specifically, the&nbsp;grant deed\nassures you that the seller did not transfer an interest in the property to\nanyone else, and it means that the property has no encumbrances that aren&#8217;t\nobvious on the deed. It is not a&nbsp;warranty of title.&nbsp;<\/p>\n\n\n\n<p>Because of\nthis limitation, it&#8217;s vital to speak with a title insurance company&nbsp;and an\nexperienced&nbsp;attorney, to understand your recourse in the case of a future\nthird-party claim or unknown title defects.<\/p>\n\n\n\n<p>Why do\npeople use grant deeds? They require no property tax value assessment. Where\nstates allow them, they&nbsp;often come into play during divorce proceedings.\nThey assure you, the&nbsp;grantee, that you aren&#8217;t getting property that&#8217;s\nalready been purchased by someone else.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Words\nto the Wise<\/h2>\n\n\n\n<p>When you&#8217;re\nbuying a home, a title search is an&nbsp;important tool for spotting issues\nthat could date back to&nbsp;past&nbsp;ownerships. If the title company is\nsatisfied with the results of the search, it will offer a title policy. This\ncan provide vital coverage,&nbsp;relieving&nbsp;you of the costs of resolving\nclaims arising at any point&nbsp;after you have bought your new home.<\/p>\n\n\n\n<p>In short, a\ntitle search assists you&nbsp;by spotting potential claims before you put the\nproperty&nbsp;in your name. (This is not the same as the lender&#8217;s title insurance. You pay for that to protect your mortgage lender.
