They can also make it a challenge to keep. Before we get to the mortgage foreclosure timeline, let\u2019s work backwards and think about what can be done if you believe foreclosure could be in your deed\u2019s future.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Is Foreclosure My Only Way Out?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s one way. But it has its own set of costs. It\u2019s a time drain. It\u2019s stressful. And it\u2019s rough on a credit profile.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Act early to try to recover your mortgage loan and save your deed. By \u201cact\u201d we mean call the mortgage company. Lending companies are used to guiding customers through alternatives to foreclosure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Read your \u201caction items\u201d on the company website and open your mail. Stay on top of notifications. They have contact information for discussing your options. And you do need to know if the company is preparing to take steps in the direction of foreclosure. As an account holder you\u2019ll be expected to know the status of your loan.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Timeline for a Foreclosure? It Follows These 5 Steps<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Here\u2019s how the process happens, roughly. Each state will have laws that impact the timeline.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The first month the mortgage goes unpaid: Your mortgage company contacts you. If you don\u2019t anticipate a quick catch-up, speak to the company now about a possible payment plan. Line up a housing counselor.<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The second month leaving the mortgage unpaid: Can you make one payment, to stop the loan from falling three months behind? A housing counselor can advise you on your options.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The third month leaving the mortgage unpaid: Your company sends its Demand Letter. This will tell you how much debt is delinquent. You have 30 days to bring your mortgage current. You still have time to work out a plan with your mortgage company.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The fourth month leaving the mortgage unpaid: You\u2019re approaching the Demand Letter\u2019s deadline for repaying the past-due debt or working out alternative arrangements. After the deadline, the mortgage lender\u2019s lawyers take over your case. You\u2019ll be charged for their work. Do not walk away from the matter. A housing counselor can still help you.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The lender\u2019s attorney will schedule and publicize the actual foreclosure sale. You may be notified of the date by mail or a door poster. You have until the date of sale to make arrangements with your lender, or pay the total amount owed, including attorney fees.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Even after the sale date, you may have a redemption period. It\u2019s best to ask for a housing counselor\u2019s guidance as soon as needed, but don\u2019t hesitate to ask at <em>any <\/em>point in the process.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\"><strong><em>Mortgage lenders in some states can skip the court process. In these states, foreclosure is easier and faster for lenders. These are <\/em><\/strong><a href=\"https:\/\/www.deeds.com\/articles\/who-owns-your-home-you-or-the-bank-check-for-a-defeasance-clause\/\"><strong><em>deed of trust states<\/em><\/strong><\/a><strong><em>. <\/em><\/strong><strong><em><\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Will Mortgage Companies Work With Me to Avoid Foreclosure?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Banks and mortgage servicers want you to keep your mortgage on track. So, what\u2019s in your lender\u2019s \u201closs mitigation\u201d toolbox? A repayment plan could be available. Especially if your financial <a href=\"https:\/\/www.deeds.com\/articles\/whats-a-hardship-affidavit\/\">hardship<\/a> is likely to be temporary:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If you can catch up with missed payments through a lump sum, the lender might reinstate the mortgage.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The lender might agree to allow delayed payments. In some circumstances, lenders offer loan modifications to extend a loan term, easing the borrower\u2019s monthly payment burden.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Ask if there\u2019s help available from the lender to get rehoused if necessary. Line up a place to live <em>before <\/em>your credit profile takes a hit due to your mortgage changes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">If You Can\u2019t Save the Deed<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-full is-style-rounded is-style-rounded--2\"><img loading=\"lazy\" decoding=\"async\" width=\"636\" height=\"513\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2026\/06\/if-you-cant-save-the-deed.webp\" alt=\"\" class=\"wp-image-7556\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2026\/06\/if-you-cant-save-the-deed.webp 636w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2026\/06\/if-you-cant-save-the-deed-300x242.webp 300w\" sizes=\"auto, (max-width: 636px) 100vw, 636px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Short of foreclosure, you can apply for loss mitigation. You\u2019ll need to submit a package of personal financial information to work with the lender. Options are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A\u00a0<em>pre-foreclosure<\/em>\u00a0sale. In this time when homes are so valuable, this could be the best way out. Ask the mortgage company if you may apply to undertake a\u00a0<a href=\"https:\/\/www.deeds.com\/articles\/what-is-a-short-sale-and-what-does-it-mean-for-home-buyers\/\">short sale<\/a>. This can make sense if you can find a buyer and sell the home, although the purchase price falls short of your debt. There are real estate agents who know how to move fast and make this kind of sale work.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>A deed in lieu.<\/em> Quicker than a short sale, a <a href=\"https:\/\/www.deeds.com\/articles\/category\/deed-in-lieu-of-foreclosure\/\">deed in lieu<\/a> means giving up control of your deed to the lender.<em> In lieu <\/em>means\u00a0instead. This means the lender will take the house deed <em>instead<\/em> of foreclosing. \u00a0You transfer your home\u2019s title to your lender, typically by <a href=\"https:\/\/www.deeds.com\/quitclaim-deed\/\">quitclaim<\/a>. And you get released from your loan.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Note that most mortgage companies\u2014or buyers\u2014won\u2019t want your deed unless and until it\u2019s otherwise free and clear of liens. &nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">My Loan Is Under Water. Will I Be Stuck With a Deficiency Judgment?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Could you wind up with a&nbsp;<em>deficiency judgment<\/em> if your arrangement doesn\u2019t fully pay off your loan debt? In some states, yes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In those states, your lender would need to waive the right to go after you for the rest of the funds. Find out the legal situation in your state before applying for a short sale or deed in lieu. Foreclosure with no deficiency judgment, or filing for&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/can-filing-for-bankruptcy-save-a-home-from-foreclosure\/\">bankruptcy<\/a>, could make better sense. Get a counselor (see the Case-Specific Guidance section below) to walk you through the pros and cons of possible decisions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lenders can\u2019t go after borrowers for deficiencies in every state. Borrowers have more protection in what\u2019s called&nbsp;<em>non-recourse states<\/em>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Where Do I Turn for Case-Specific Guidance Now?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Looking for help and support? Look for an approved counselor. For advice and help negotiating with your lender, there is:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>FEDERAL HELP. \u00a0Contact a\u00a0federally approved <a href=\"https:\/\/hud4.my.site.com\/housingcounseling\/s\/?language=en_US\" target=\"_blank\" rel=\"noreferrer noopener\">housing counselor<\/a>\u00a0working in your area. Call (800) 569-4287 and review the\u00a0<a href=\"http:\/\/www.hud.gov\/helping-americans\/avoiding-foreclosure\" target=\"_blank\" rel=\"noreferrer noopener\">Department of Housing and Urban Development<\/a>\u00a0website to learn more. Got an FHA-backed loan? Get in touch with the Federal Housing Administration\u2019s Resource Center: (800) CALL FHA (225-5342). For a VA-insured loan, pull up the VA Foreclosure Alternatives webpage.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>ALTERNATIVE HELP. Call the Homeowners Hope Hotline at (888) 995-HOPE.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>STATE-FUNDED HELP. Check your state\u2019s homeowner assistance resources. Learn as much as possible from your state housing department on foreclosure law and assistance.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Local legal aid can be helpful. But watch out for \u201cmortgage consultants\u201d promising \u201cforeclosure rescue.\u201d If a for-profit company offers to negotiate for you, you\u2019ll have to pay for it\u2014in some cases, much too high a price. Don\u2019t believe a business that <a href=\"https:\/\/www.deeds.com\/articles\/struggling-with-your-mortgage-payments-in-a-harsh-economy-not-all-promises-of-help-are-legit\/\">says it can get a better mortgage relief deal<\/a> than your own mortgage company.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">If There\u2019s No Way to Save My Mortgage, What\u2019s My Next Move?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Looking ahead, if there\u2019s no way to take on a renter or otherwise save the mortgage, you\u2019re going to need to make a move. Financial support for your move (cash for keys), may be available to you after you give up your deed. Ask the mortgage company.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Understand that foreclosures are visible in credit checks for seven years. This can affect job applications. A foreclosure can make future mortgage applications harder and the mortgage rates higher.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After a deed in lieu or short sale, you could apply for a conventional loan again sooner than if you let foreclosure happen.&nbsp;Still, an FHA loan may be available three years after a foreclosure <em>or<\/em> a foreclosure alternative.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Right now, though, if you\u2019re behind in your payment and may be headed for a&nbsp;default situation, proactivity is your best policy. Take action. Connect with the resources available to you.
