This means:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Your ownership interest is only as good as the interest conveyed to you by the last owner; and<\/li><li>Others could have dibs on your property, if you used it to borrow money.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Of course,\nwhen you bought your&nbsp;home, the title company researched the&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/what-is-the-chain-of-title-in-real-estate\/\">chain\nof title<\/a>&nbsp;to ensure previous owner&nbsp;had the right to convey to\nproperty to you.&nbsp;How do you check the chain of title now? The&nbsp;county\nkeeps records.&nbsp;Many county websites&nbsp;make the&nbsp;information\naccessible online, so you can look up&nbsp;mortgages, other liens,\nand&nbsp;deeds that pertain to your&nbsp;property.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">The\nDeed:&nbsp;Key Proof of&nbsp;Ownership<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.deeds.com\/warranty-deed\/\">general warranty deed is&nbsp;the\nstandard instrument<\/a>&nbsp;for home sales. Your notarized warranty\ndeed&nbsp;is proof of&nbsp;ownership, and that the grantor transferred complete\nand clear title to you. A <a href=\"https:\/\/www.deeds.com\/quitclaim-deed\/\">quitclaim\ndeed<\/a>&nbsp;also proves full&nbsp;land ownership\u2014<em>if<\/em>&nbsp;the person who conveyed the\ninterest&nbsp;to you had full ownership.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But where&#8217;s\nthe deed? You received it at&nbsp;closing. If you&#8217;ve misplaced it you may\npurchase copies&nbsp;from the county clerk\u2019s office.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Paid\nOff Your Mortgage? Prove It.<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If a home\nhas a <em>mortgage lien<\/em>,\na&nbsp;<em>mortgage note<\/em>&nbsp;demonstrates&nbsp;that\nthe borrower owns&nbsp;the&nbsp;property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now, say you\nwant to refinance, and the underwriter wants proof you own the property, free\nof mortgage liens. If you&#8217;ve paid off your mortgage, you (and your county\nclerk&#8217;s office) got a <em>satisfaction\nof mortgage letter<\/em>&nbsp;a few weeks after payoff. This\nproves&nbsp;you own the property&nbsp;and that you paid off the loan. If any\nother liens surface in a&nbsp;title search,&nbsp;request&nbsp;statements of the\n<em>lien settlements<\/em>.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Pro tip 1:<\/strong> Check your homeowner&#8217;s insurance declarations. Once your mortgage is paid off, no mortgagee clause shows up on your insurance policy. This can provide documentation to an underwriter that you own your property, free of mortgage liens. <\/li><li><strong>Pro tip 2:<\/strong> Another way to show an underwriter you have no mortgage is by producing a copy of Schedule E on your personal income tax returns. If it shows no interest deduction, this demonstrates you have no mortgage to declare.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Shoes\nto Fill: Becoming the Sole Owner&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Some people\nwant to be sure they have proof of ownership after their co-owing spouse or\ndomestic partner has died. Often, the couple held&nbsp;rights to the property\nas joint tenants&nbsp;with right of survivorship (&#8220;JTWROS&#8221;). As the\nsurviving spouse, you need the death certificate to&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/should-you-remove-a-deceased-owner-from-a-real-estate-title\/\">remove\nthe deceased co-owner from the title<\/a>. File an&nbsp;<em>affidavit of survivorship<\/em>&nbsp;with\nthe recorder\u2019s office. This will place&nbsp;you in the records as the sole\nowner of the property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Are you concerned\nthat a specific, living person&nbsp;still have&nbsp;an ownership claim? Ask\nthat person to fill out a quitclaim deed, by which they relinquish to you any\nrights they might have had, and file&nbsp;the deed, to ensure there is no&nbsp;<em>cloud on title<\/em>. Once the\ntitle is clear,&nbsp;a title company will be able to&nbsp;insure\nyour&nbsp;title. This will be necessary of you are ready to refinance or sell.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A\nChain Is Only as Strong&#8230;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If legal\nproblems&nbsp;entered the process of transferring the title at any point, you\nmight be concerned about the integrity of your home&#8217;s chain of title. Some\nproblems are minor, such as typos or &#8220;scrivener&#8217;s errors.&#8221; These can\nbe corrected&nbsp;without a need for&nbsp;a new deed, by way of a scrivener\naffidavit. But some are more serious, such as&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/an-error-in-the-legal-description-of-the-deed-what-happens-now\/\">mistakes\nin the property&#8217;s&nbsp;legal description<\/a>. Such&nbsp;errors require&nbsp;a <em>correction deed<\/em> to solve.\nCorrection deeds state the error, and restate the legal description correctly.\n&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A title\nsearch may turn up an old reference to an <em>unrecorded\ndocument<\/em>\u2014perhaps&nbsp;a&nbsp;restriction, an easement, or some\nother agreement made by a prior owner.&nbsp;Some unrecorded documents expire.\nNevertheless, the title search needs to take note,&nbsp;and&nbsp;underwriters\nneed to be aware.&nbsp;If&nbsp;an unrecorded mortgage is\nhaunting&nbsp;your&nbsp;property, but you didn&#8217;t know this when you bought the\nhome, you&#8217;re a <em>bona fide\npurchaser\u2014<\/em>not legally responsible for the&nbsp;unrecorded\nlien.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If there is\na real debate about the title,&nbsp;a&nbsp;court might need to solve it in a <em>quiet title action<\/em>. A\njudge can examine any break&nbsp;in the chain, and declare&nbsp;that it no\nlonger exists, enabling you to prove you have clear title to your home.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Just\nNo Substitute for a Recorded Deed<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A bill of\nsale, as a&nbsp;receipt for the purchase, is&nbsp;temporary&nbsp;proof of\nownership. But don&#8217;t rely on it, or anything else, to substitute for the actual\ndeed. The story of&nbsp;Matthew, a real&nbsp;Colorado resident, shows why.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Matthew\nbought a piece of&nbsp;land,&nbsp;filed the&nbsp;bill of sale with the county,\nand never gave it a second thought.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After Matthew\u00a0had\u00a0faithfully paid\u00a0taxes and\u00a0mortgage payments for a year and a half, <a href=\"https:\/\/www.koaa.com\/news\/news5-investigates\/man-says-county-leaders-took-his-property-and-gave-it-to-someone-else-county-responds-on-camera\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">the local\u00a0assessor&#8217;s office returned the property into the seller&#8217;s name<\/a>.\u00a0Under Colorado law, the bill of sale doesn&#8217;t transfer property.\u00a0Colorado requires the deed to be\u00a0delivered to the buyer for a valid conveyance. Unable to find\u00a0the seller and have a\u00a0deed completed\u00a0and recorded, Matthew had to file a quiet title action.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The moral of\nthe story? Avoid a Matthew problem. When you buy property, be sure it&#8217;s a deed\n(indeed!) that&#8217;s delivered and recorded.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A\nWord to the Wise<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Just because\na document is&nbsp;filed with the county, doesn&#8217;t mean it&#8217;s right. This point\nis vital to the chain of title&nbsp;and&nbsp;your ownership status. When\nthe&nbsp;county&nbsp;records a document, it&nbsp;does <em>not<\/em>&nbsp;provide legal\nadvice.
