Here&#8217;s how it works.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">The\nDefault Rule for Co-Ops: The Purchaser as Stockholder<\/h2>\n\n\n\n<p>A co-op is a\ncorporation that bands together to own a building and its surrounding property.\nRather than receiving deeds, buyers hold stock certificates.<\/p>\n\n\n\n<p>Stock\ncertificates are personal property. In this case, they grant&nbsp;each\nshareholder a proprietary lease on one&nbsp;living space in a building.<\/p>\n\n\n\n<p>If you buy\ninto a co-op, your share will entitle you to live in the unit you select. So,\ndo you own real estate or not? Generally not. But the answer is nuanced and\nevolving, so read on.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A\nCo-Op vs. Real Property: The Control Panels<\/h2>\n\n\n\n<p>At first\nglance, going with a traditional home or condo purchase has advantages.\nA&nbsp;home or condo buyer owns real property, and has the <a href=\"https:\/\/www.deeds.com\/articles\/how-to-prove-ownership-of-real-estate\/\">recorded\ndeed to prove&nbsp;it<\/a>.<\/p>\n\n\n\n<p>This puts\nthe owner&nbsp;in control when it&#8217;s time to sell.<\/p>\n\n\n\n<p>In contrast,\nselling a&nbsp;co-op unit hinges on\nthe&nbsp;co-op&nbsp;board&#8217;s&nbsp;green-lighting&nbsp;the&nbsp;hopeful\nbuyer.&nbsp;Co-op boards may&nbsp;say no to a prospective buyer\u2014as long as they\nstay on the good side of&nbsp;relevant anti-discrimination laws.&nbsp;<\/p>\n\n\n\n<p>Once the\npurchasers are in, they might be barred from&nbsp;subleasing&nbsp;their units.\nThis keeps investor buyers out of the picture.<\/p>\n\n\n\n<p>On the other\nside of the coin,&nbsp;co-op shareholders are in charge of the\nproperty&nbsp;management. Most co-op buyers want a hands-on role within their\nchosen community. All co-op members are&nbsp;vetted by the community\nthey&nbsp;join because&nbsp;each member is given direct&nbsp;input into the\ngroup\u2019s decisions, and a say on&nbsp;improvements that impact the\ncommunity.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Special\nConsiderations for&nbsp;Financing and Insuring Co-Op Shares<\/h2>\n\n\n\n<p>The whole\nco-op property has one deed; individual units do not. A co-op purchaser must\nwork with a mortgage specialist who offers access to <em>share loans<\/em>. Share loans\nare not obtainable through FHA or VA mortgages.&nbsp;<\/p>\n\n\n\n<p>The share\nloan simply supports the price of buying into the cooperative. It is separate\nfrom&nbsp;the mortgage on the co-op\u2019s property, which residents pay off through\nmonthly dues.&nbsp;<\/p>\n\n\n\n<p>Buyers can find listings, submit\u00a0offers, and negotiate prices for co-op properties. Yet because they must be vetted\u00a0by the co-op\u2019s board,\u00a0and because a\u00a0lender will wait until the board approves the purchaser before ordering an appraisal, co-op purchases can take months. Granted,\u00a0the process can\u00a0move\u00a0quickly in major cities where co-ops make up\u00a0a significant\u00a0part of the market.\u00a0Consider the\u00a0Seattle co-op. It will spend <a href=\"https:\/\/seattle.curbed.com\/2019\/9\/26\/20885583\/housing-cooperative-seattle-homebuying-guide\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">44 days on the market<\/a>\u2014just two weeks longer than the time it takes to sell a condo.<\/p>\n\n\n\n<p>A co-op\nbuyer can have a lien search done to look for liens filed against&nbsp;the\nco-op or against the&nbsp;seller&#8217;s proprietary lease. This process resembles\nits counterpart in real estate purchases:&nbsp;liens must be resolved before\nclosing. And while co-op buyers typically don&#8217;t buy title insurance, they can\nbuy co-op leasehold insurance as a shield against title defects.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Condo\nVersus Co-Op: Which Is Cheaper?<\/h2>\n\n\n\n<p>Co-op owners\npay substantial monthly corporation dues, as they share responsibility for the\nbuilding&#8217;s mortgage, its taxes, and community utilities and maintenance\ncosts.&nbsp;Note that some co-ops require a hefty share price down payment\u2014in\nsome cases it&#8217;s half the unit\u2019s value\u2014and&nbsp;cash reserves beyond the closing\ncosts.<\/p>\n\n\n\n<p>Most buyers, though, will find co-ops at lower prices than condos, especially if they&#8217;re looking in big cities. In 2018, New York City co-ops were fetching $1,077 per square foot\u2014$700 <a href=\"https:\/\/www.cityrealty.com\/nyc\/market-insight\/features\/get-to-know\/how-co-ops-became-housing-option-choice-new-yorkers\/20423\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">less per square foot<\/a> than the average NYC\u00a0condo.\u00a0<\/p>\n\n\n\n<p>For\ninvestors, condos are the better buys. Over a recent&nbsp;15-year period, <em>CityRealty.com <\/em>reports,\nNew York co-ops ascended&nbsp;127% in price, while&nbsp;condo values\nskyrocketed 179%.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Innovations\nin Titling Co-Op Units<\/h2>\n\n\n\n<p>New York has embraced an innovation in its\u00a0<a href=\"https:\/\/codes.findlaw.com\/ny\/estates-powers-and-trusts-law\/ept-sect-6-2-2.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Estates, Powers &amp; Trusts Law<\/a>. Under this provision, marriage\u00a0partners are deemed to own a\u00a0New York co-op apartment as tenants by the entirety unless the interest is expressly declared a joint tenancy or a tenancy in common.<\/p>\n\n\n\n<p>The\nprovision went into effect in the 1990s, and made&nbsp;cooperative apartment\nownership tantamount to owning real estate.&nbsp;Each tenant by the entirety owns\nan undivided, whole interest that cannot be reduced or sold by the other. When\none co-owner dies,&nbsp;the survivor obtains&nbsp;full&nbsp;title to the shares\nand the proprietary lease.&nbsp;<\/p>\n\n\n\n<p>Any liens\nattached to one spouse&#8217;s interest survives as long as that individual does; the\nsurviving spouse&#8217;s interest is not encumbered. Should the marriage be\ndissolved, the proprietary lease, by operation of law, becomes a&nbsp;joint\ntenancy.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Trends\nand Amenities<\/h2>\n\n\n\n<p>New York City&#8217;s housing market is, as its law suggests, a key co-op market. More than\u00a0<a href=\"https:\/\/www.cityrealty.com\/nyc\/market-insight\/features\/get-to-know\/how-co-ops-became-housing-option-choice-new-yorkers\/20423\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">2,500\u00a0cooperatively owned apartments exist in Manhattan<\/a>\u00a0alone.\u00a0Compared to\u00a0the apartment market, cooperative living\u00a0offers a greater range of amenities and features, including design aspects more typical of the average house than a city\u00a0apartment.\u00a0<\/p>\n\n\n\n<p>Today\u2019s cutting-edge co-ops embrace coworking. Many offer a <a href=\"https:\/\/mtairynexus.spaces.nexudus.com\/en\/bookings\/calendar\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">schedule of presentations<\/a>\u00a0courtesy of local authors and experts.\u00a0<\/p>\n\n\n\n<p>Sustainability\nconcerns bring many people to cooperative housing. Mt. Airy Nexus in Philadelphia,\nfor example, partners with the nonprofit group Sustainability Nexus to provide\na home&nbsp;for sustainability&nbsp;and entrepreneurship communities,\nplus&nbsp;like-minded retirees.<\/p>\n\n\n\n<p>Indeed,\nsenior co-ops are on the rise, as a growing population of baby boomers takes\nsenior living into its own hands. Fitness rooms and trainers, community\nkitchens and laundry rooms, event halls, swimming pools, gardens&nbsp;and parks\nare all desirable features. So is the plan to age in a mutually supportive\ncommunity.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Buying\na Co-op: Key Takeaways<\/h2>\n\n\n\n<p>Buy a co-op,\nand you&#8217;ll likely get shares rather than a real property deed. Given the\nspecial mission of your chosen co-op, it will likely take extra time to sell\ndown the road.<\/p>\n\n\n\n<p>Nevertheless,\nfor rich and varied reasons, co-ops are desirable&nbsp;primary residences.
