So you transferred the deed to your home into the name of your child. Why wouldn\u2019t you? Now, your child will be able to enjoy the home. The transfer is done. No need to drag the home through the local probate court after you\u2019re gone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Later on, you learned that the gift could cost your child significant capital gains taxes. Maybe that\u2019s OK. But you\u2019re hearing your child will want to sell the home. And you wish you could have given your child a step-up in tax basis.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">What\u2019s the Step-Up in Tax Basis?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When you transfer your deed to your child during your lifetime, your child receives your original <a href=\"https:\/\/www.irs.gov\/publications\/p551\" target=\"_blank\" rel=\"noopener\">cost basis<\/a>. Why is this significant? Upon selling, your child will be hit up for taxes on any appreciation in the property\u2019s value since you first acquired the deed. Given the rate of inflation over recent years, that could mean a hefty tax bill for your child. Recall that federal long-term capital gains can be taxed around the 20% mark, and states also tax capital gains!<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you had kept your deed for life and bequeathed it to your child, the IRS would give your recipient a \u201cstep-up\u201d in the property\u2019s tax basis. So, your child wouldn\u2019t be taxed on the appreciation that accumulated while you owned the home, up to your date of death. (<strong><em>Note:<\/em><\/strong> In some situations, an estate\u2019s executor <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/26\/2032\" target=\"_blank\" rel=\"noopener\">elects<\/a> on Form 706 to value all of the estate\u2019s assets as of six months <em>after<\/em> the date of death. This does not apply to estates that owe no federal estate tax \u2014 estates worth below $15 million per individual, as of 2026.)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So, the property\u2019s accumulated gain wouldn\u2019t be subject to capital gains tax for your child if you\u2019d bequeathed the home. And this differentiates a gift from an inheritance. If you use a will or a living trust to pass your home to family, your beneficiary will benefit from the preferred tax status.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In some states, a <a href=\"https:\/\/www.deeds.com\/transfer-on-death-deed\/\"><em>transfer on death deed<\/em><\/a> (TOD deed) is another way to pass a home along after you die, while keeping the tax advantages of an inheritance. The TOD deed names a particular beneficiary, such as your adult child, who will receive the deed when you pass away. Like a trust, a TOD deed bypasses probate. And a TOD deed is simple to create.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In contrast, leaving your home in a will does steer it into probate. Probate sucks up time (and fees) for the recipients of your assets. An executor will oversee the distribution of assets to creditors, and then to the person or people named in your will. Your adult child will receive an executor\u2019s deed, which carries the court\u2019s approval. Indeed, using a will is the most common method of passing along homes to the next generation.<strong><em><\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But no matter which method you choose for passing a home along, your home is probably not your sole asset, and writing a will is still essential. After you transfer or receive any deed, update your will accordingly. Be sure the language in your will doesn\u2019t contradict what\u2019s in a trust, a TOD deed, or some other instrument (a <a href=\"https:\/\/www.deeds.com\/articles\/life-estate-deed-or-living-trust-which-path-is-right-for-your-home\/\"><em>life estate deed<\/em><\/a>, for example) that you might use to pass your home to your adult child.<\/p>\n\n\n\n<p class=\"has-accent-5-background-color has-background has-small-font-size wp-block-paragraph\" style=\"padding-top:var(--wp--preset--spacing--30);padding-right:var(--wp--preset--spacing--30);padding-bottom:var(--wp--preset--spacing--30);padding-left:var(--wp--preset--spacing--30)\"><strong><em>Read more from Deeds.com on<\/em><\/strong> <a href=\"https:\/\/www.deeds.com\/articles\/for-home-sellers-capital-gains-tax-101\/\"><strong><em>capital gains tax and gift exemptions<\/em><\/strong><\/a><strong><em>.<\/em><\/strong><strong><em><\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Is the Gift of Your Deed Reversible?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If you already signed a warranty deed or a quitclaim deed that transferred full ownership of your home, that\u2019s a completed gift. Your child has <em>already<\/em> received your original tax basis. If your child has entered into an agreement to sell the home, or borrowed against it, or does not wish to return it now, the answer is no. The gift of your deed is not reversible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The only way to change the future tax situation for your child is to find out whether your child is willing to transfer the home\u2019s deed back to you. Because you\u2019d be receiving the deed back without purchasing the home, your child should file an IRS Form 709 gift tax return to report the property transfer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the experienced professionals at Laughlin Legal Estate Planning, \u201cYou must legally retitle the property in your name and document that the original transfer was not intended to be permanent.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your child must be able to give full and voluntary consent to re-deeding the home into your name. Therefore, don\u2019t use this method if your child is subject to court judgments or involved in bankruptcy or divorce proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also, avoid such a transfer if you have reason to believe the transfer would occur near your date of death. A valid re-deeding and your overall estate plan should be completed well in advance, never in haste. Those close to you should know your intentions to prevent misunderstandings later.
