It affects wealthy or modest households. It can happen to a city penthouse or a farm in the country, a beach house or an unbuilt lot.

But today, most of all, the targets are homes of older people and Black families. Swindlers especially zero in on the homes where mortgage companies aren’t keeping watch.

Urban Renewal: A Deed Vulnerability Factor

Wherever property values shoot up, can the scammers be far behind? Deed theft is occurring in many changing urban neighborhoods throughout the country. Consider the areas of Brooklyn or Philadelphia or Chicago that have been predominantly Black for much of their history.

These are cities where TV teams used to come to televise criminal activity. Much less media attention has been given to these very same neighborhoods when white-collar schemers are taking the deeds out from under generations.

And many of these deeds at issue are hugely valuable now. The downtown neighborhoods are becoming safer, and a new generation of home buyers wants cultural, vibrant, walkable places.

How the Scheme Works

Swindlers look for financially struggling deed holders who might be willing to transfer a deed for far less than its value. And its value could be in the multimillion-dollar range. Some shady person might say:

I can help you get a loan. You’ll need to sign over the deed to your home. Then you’ll be added to an LLC and get financing.

But instead, the deed holder learns the deed is gone and the LLC people have flipped the home to some other business.

When the victimized homeowner gets evicted, any relatives and renters that rely on the home for housing have to leave too. The ripple effect of the scam can be massive.

Everything They’ve Worked For: Seniors and Other Targets

Chi Ossé, a New York City councilmember, says a deed might even be slipped into a stack of paperwork. Senior deed holders, as well as immigrant households, might not know that they’re victims.

Ossé counts the many methods of swindlers. They knock on a door. They drop off a door hanger solicitation. They call a distant relative who might agree to exert pressure on a deed holder. They fake signatures. They know just how to exploit murky chains of title in families. Older people may have left the home for nursing care, leaving no one competent in charge of the family’s core asset.

People who don’t use loans (including some immigrant communities) are susceptible. Seniors who have spent their entire adult lives working to pay off a mortgage are also more vulnerable. Paid-off homes have the most equity and don’t have a mortgage servicer paying attention to an account.

Why Deed Theft Is Such a Tough Nut, and How to Crack It

Deed schemes are hard and time-consuming for prosecutors and courts to deal with. The recording of a fraudulent deed creates an official document in the city or county. That’s hard to challenge. Recorded deeds are presumed valid.

Once a deed gets taken, the property can become the collateral for a mortgage company or the new home of an unsuspecting third-party buyer. It’s complicated to have to sort through these ripples of exploitation.

New York’s attorney general, Letitia James, has made deed theft a major focus, and state law now has criminal penalties for deed theft. But law enforcement is struggling to keep up with the growing volume of fraud. Mayor Zohran Mamdani started New York City’s new Deed Theft Prevention Office to try to stop these incidents before they occur.

The most effective approach of all would be to support people in financial trouble so they don’t feel forced to turn to scheming investors and lenders. This support would include estate planning services in the areas sought out by fraudsters.

Having a copy of your deed can be very helpful to protect your homeownership.
