Here are the basics to explore with your\nestate planning expert.&nbsp;&nbsp;<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">What\nMedicare Recipients Need to Know<\/h2>\n\n\n\n<p>Medicare, as\na rule, does&nbsp;not&nbsp;cover long-term care settings. So, Medicare in\ngeneral presents no challenge to your clear home title.<\/p>\n\n\n\n<p>Most people\nin care settings&nbsp;pay for care themselves. After a while, some deplete\ntheir liquid assets and qualify&nbsp;for&nbsp;Medicaid assistance.<\/p>\n\n\n\n<p>Check your\nstate website to learn about qualifications for Medicaid. If you are likely to\nreturn home after a period of care,&nbsp;or your&nbsp;spouse or\ndependents&nbsp;live in the home, the state generally cannot&nbsp;take your\nhome in order to recover payments.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What&nbsp;Medicaid\nRecipients Need to Know<\/h2>\n\n\n\n<p>Our population is getting older. And\u00a0long-term care isn&#8217;t getting any cheaper. People who can&#8217;t afford care can <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.medicaidplanningassistance.org\/medicaid-eligibility\/\" target=\"_blank\">apply for\u00a0Medicaid<\/a>. Applicants may need to\u00a0spend\u00a0down\u00a0to meet the limit. The limit varies\u00a0by state, but is usually just $2,000 per person. Yet married applicants can transfer up to $126,420 in assets to a spouse under the\u00a0Community Spouse Resource Allowance (<a href=\"https:\/\/www.medicaidplanningassistance.org\/community-spouse-resource-allowance\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">state limits may vary<\/a>).\u00a0The value of the applicant\u2019s primary home isn&#8217;t counted if\u00a0the\u00a0spouse lives in it and the couple&#8217;s\u00a0home equity is not more than $585,000 ($878,000 in some states;\u00a0California imposes no limit).<\/p>\n\n\n\n<p>Your home is\nalso shielded from recovery if a spouse or sibling has an equity interest in\nit, and has lived in it for the legally specified time, or if it&#8217;s the home of\na&nbsp;child who is under&nbsp;21 or lives with a disability. But Medicaid may&nbsp;try\nto recover funds at a future date, before your home is conveyed to a new\nowner.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The\nFederal Government Has Pressed People to Rely on Private Funds<\/h2>\n\n\n\n<p>Medicaid\nliens on homes have become common since&nbsp;the federal Omnibus Budget\nReconciliation Act (OBRA) of 1993,&nbsp;which forces&nbsp;estate recovery\nif&nbsp;the homeowner:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Relied on Medicaid at age 55+. <\/li><li>Left the home, at any age, for a permanent care setting. <\/li><li>Has no dependents with valid claims to the house.<\/li><\/ul>\n\n\n\n<p>States must\nrecover for nursing,&nbsp;hospital, and drug&nbsp;services\u2014or they\nforfeit&nbsp;federal Medicaid funding. States <em>must <\/em>recover from probate assets of the\ndeceased.&nbsp;States <em>may <\/em>recover\nother assets.&nbsp;All states must offer&nbsp;Medicaid recipients the chance to\napply for undue hardship waivers.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">When\nAccepting Medical Assistance Means a Lien on the&nbsp;Home<\/h2>\n\n\n\n<p>A lien\nprovides&nbsp;the right to take property to resolve an unpaid debt. Most people\nare familiar with liens on homes, especially the mortgage lien. After a lien\nis&nbsp;recorded&nbsp;by a county&#8217;s registry of deeds, title&nbsp;may&nbsp;not\nbe transferred without the creditor&#8217;s knowledge. The creditor\u2014and this might be\nMedicaid\u2014can then claim the&nbsp;right to collect funds.<\/p>\n\n\n\n<p>Medicaid\nuses two lien types:&nbsp;TEFRA,&nbsp;and&nbsp;estate recovery liens.<\/p>\n\n\n\n<p>Under the\nTax Equity and Fiscal Responsibility Act (TEFRA) of 1982, states\nmay&nbsp;prevent Medicaid&nbsp;recipients from giving away the&nbsp;home that\nthey leave when they go into a long-term care setting. Intent&nbsp;to return\nhome should be legally sufficient to keep the home an exempt asset. And states\nmust&nbsp;dissolve&nbsp;TEFRA liens for Medicaid recipients who do go back\nhome.&nbsp;<\/p>\n\n\n\n<p>Homes that\nlong-term Medicaid recipients try to transfer&nbsp;are considered available\nassets for state liens. And Medicaid gets first dibs\u2014even over a&nbsp;mortgage\nlender. Should the&nbsp;homeowner die&nbsp;with the lien in place, Medicaid recovery\nbecomes a&nbsp;part of probate. In many cases, an adult child of the deceased\nis forced to&nbsp;pay&nbsp;the Medicaid&nbsp;claim when taking&nbsp;title to a\nparent&#8217;s&nbsp;property.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">When\nProbate Meets Medicaid<\/h2>\n\n\n\n<p>States may\nmake claims on the estates of people who died in&nbsp;permanent care settings,\nand&nbsp;those of anyone who, aged 55+, accepted Medicaid benefits\u2014wherever\nthey lived. As noted above,&nbsp;these &#8220;post-death liens&#8221; come into\nplay during probate. Yet there are states\u2014notably Texas and&nbsp;Florida\u2014that\nput&nbsp;certain interests of surviving loved ones&nbsp;ahead of liens,\nMedicaid included.<\/p>\n\n\n\n<p>The main\npoints to know are these. A&nbsp;state-imposed, post-death lien&nbsp;on a house\noccupied by the loved ones of&nbsp;a deceased recipient of Medicaid will get\nmoney back to the&nbsp;government, but not while a&nbsp;spouse or\ndependent\/disabled child is still living\u2014anywhere. And the spouse may sell the\nhome,&nbsp;overriding the Medicaid lien.<\/p>\n\n\n\n<p>Recovery is\nalso barred when:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>A sibling has an equity interest in the home and has lived in it continuously since a year prior to the Medicaid application.<\/li><li>An adult child lived in the home continuously, since at least two years before the deceased went into care, having helped the deceased to keep living at home for as long as possible. <\/li><\/ul>\n\n\n\n<p>Some states will then\u00a0waive claims to future recovery. <a href=\"https:\/\/www.medicaid.gov\/about-us\/contact-us\/contact-state-page.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Call your Medicaid office<\/a>\u00a0to find out what\u00a0your state\u00a0does.\u00a0\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Transferring\na Home With a Lady Bird Deed<\/h2>\n\n\n\n<p>Texas,\nFlorida, Michigan, West Virginia, and Vermont&nbsp;have lady bird deed\nprovisions.&nbsp;<\/p>\n\n\n\n<p>Here&#8217;s how\nlady bird deeds can shield your home value.<\/p>\n\n\n\n<p>Medicaid has a\u00a0<a href=\"https:\/\/www.medicaidplanningassistance.org\/medicaid-look-back-period\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">look-back period<\/a>.\u00a0The government scrutinizes asset transfers in the years leading up to a\u00a0Medicaid application, looking for people who\u00a0gave away assets or sold them at low prices to qualify for the Medicaid asset limit. People found to have done this will have to wait for their eligibility.<\/p>\n\n\n\n<p>Yet with a\nlady bird deed, the homeowner keeps&nbsp;owning the home for life, and the\nbeneficiary only takes title later. For this reason, using a lady bird deed to\ngive away the home in the look-back period doesn&#8217;t count against the owner.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Finding\na Supportive Community&nbsp;<\/h2>\n\n\n\n<p> Having supportive people around can sweeten our days and help seniors age in place.
