Here, we discuss what happens&nbsp;when&nbsp;a homeowner\npasses away with a loan still on the home. This can be a tough topic to\nconfront, but reviewing the potential scenarios will help you prepare for the\npossibility.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">How the Mortgage Lives On\u2014And for How Long<\/h2>\n\n\n\n<p>A deceased\nperson\u2019s mortgage has to be paid, of course\u2014just as any debt does. If there is\nno co-owner to automatically receive homeownership, and the house goes into\nprobate, the personal representative must keep paying the estate\u2019s bills.\nThis&nbsp;includes&nbsp;keeping the mortgage payments up to date. If the estate\nlacks the cash to pay the lender, the personal representative might sell the\nhouse and pay the mortgage with the proceeds.<\/p>\n\n\n\n<p>Instead,\ncould the home survive&nbsp;the probate process with its mortgage intact? It\nmight.<\/p>\n\n\n\n<p>First, check\nthe language of the mortgage itself. Acceleration clauses are standard\nin&nbsp;home mortgages, making the debt due within a very short window\nafter&nbsp;the&nbsp;borrower transfers the asset. So, by default, the mortgage\nmust be paid off when the home is transferred to a new owner.<\/p>\n\n\n\n<p>But if\ncertain people are&nbsp;named as&nbsp;beneficiaries&nbsp;to the home, pursuant\nto federal law, the mortgage lender must&nbsp;transfer the loan to the\nbeneficiary. The&nbsp;Garn-St.&nbsp;Germain Depository Institutions Act of\n1982&nbsp;exempts close relatives from acceleration clauses. The relative who\ninherits should tell the mortgage company about the deed transfer, and assume\nthe mortgage.<\/p>\n\n\n\n<p>Then:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The new owner will receive <a aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/f1098.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Form 1098<\/a> from the lender and can claim mortgage interest deductions when filing income taxes come April. <\/li>\n\n\n\n<li>The new owner will be named on the mortgage, and can initiate a loan payoff when selling or refinancing the home in the future.<\/li>\n<\/ul>\n\n\n\n<p>A new owner\nwho is happy to just keep the home may&nbsp;assume the regular mortgage payment\nschedule.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">New Mortgage Rights Are Good News for Heirs<\/h2>\n\n\n\n<p>Two vital\nrules help heirs who wish to take over a home with the mortgage intact:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Since 2014, after the mortgage borrower dies, under federal law a relative who inherits the property may take over the deceased person&#8217;s mortgage as a borrow  \u2014without triggering the Ability-to-Repay rule. <a aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.consumerfinance.gov\/about-us\/newsroom\/cfpb-clarifies-mortgage-lending-rules-to-assist-surviving-family-members\/\" target=\"_blank\" rel=\"noreferrer noopener\">This new mortgage holder is<\/a><em><a aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.consumerfinance.gov\/about-us\/newsroom\/cfpb-clarifies-mortgage-lending-rules-to-assist-surviving-family-members\/\" target=\"_blank\" rel=\"noreferrer noopener\"> not <\/a><\/em><a aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.consumerfinance.gov\/about-us\/newsroom\/cfpb-clarifies-mortgage-lending-rules-to-assist-surviving-family-members\/\" target=\"_blank\" rel=\"noreferrer noopener\">deemed a new borrower<\/a>. This allows a surviving loved one to avoid the burden of proving an ability to repay the  mortgage. The lender must work with the heir to pay the mortgage or obtain a loan modification as needed.<\/li>\n\n\n\n<li>Since 2018, a <a aria-label=\" (opens in a new tab)\" href=\"https:\/\/library.nclc.org\/effective-april-19-new-mortgage-servicing-rights-heirs-spouses-and-debtors-bankruptcy\" target=\"_blank\" rel=\"noreferrer noopener\">federal rule<\/a> requires the lender to quickly communicate with family members and heirs who have a legal interest in the home, and treat them as &#8220;successors in interest&#8221; with full rights in the mortgage. Close relatives protected by the Garn-St. Germain Depository Institutions Act of 1982 are entitled to a reasonable time period to place their names on the loan agreement, and to apply for loan modifications.<\/li>\n<\/ul>\n\n\n\n<p>Given these\nprotections, you can leave&nbsp;your home to a loved one in your will without\nworrying that the lender will refuse to deal with your beneficiary. &nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Some Mortgages Might Not Make Sense to Keep<\/h2>\n\n\n\n<p>What if the\nproperty, at its current market value, isn\u2019t worth the mortgage? If no one is\nkeen to take over the debt, and the estate itself can&#8217;t cover it either, then\nthe estate&#8217;s personal representative might ask the mortgage lender about\npossibly accepting a lesser payoff than what&#8217;s due. Then the house would be\nsold in&nbsp;a short sale. A lender might agree to this in order to avert the\ntime-consuming process of foreclosure. The personal representative should be\nsure to engage an&nbsp;attorney to determine the legal&nbsp;ramifications of a\nshort sale.<\/p>\n\n\n\n<p>In some cases,\nbeneficiaries walk away.&nbsp;On the other hand, someone who co-signed&nbsp;the\nloan agreement&nbsp;is&nbsp;liable for paying it off\u2014whether that person&#8217;s name\nis&nbsp;on the deed or not.<\/p>\n\n\n\n<pre class=\"wp-block-preformatted\"><strong><em>Pro tip:<\/em>\u00a0A beneficiary is allowed to\u00a0<a href=\"https:\/\/www.deeds.com\/articles\/refusing-to-accept-a-deed\/\">refuse the deed<\/a>\u00a0without credit damage or financial penalty. As long as\u00a0heirs are\u00a0not already on the mortgage agreement, they do not become liable for the loan without their consent. If no one steps up to accept the deed,\u00a0it is up to the mortgage lender to initiate a foreclosure.\u00a0<\/strong><\/pre>\n\n\n\n<h2 class=\"wp-block-heading\">Planning Ahead: Looking Out for a Surviving Loved One\u00a0<\/h2>\n\n\n\n<p>Is your\nmarriage partner already on your mortgage? Then, the&nbsp;likely scenario is\ngreatly simplified.<\/p>\n\n\n\n<p>Granted, the\ndeath of one spouse can leave&nbsp;the remaining homeowner financially\nvulnerable. A surviving partner who cannot continue making the payments might be\ncompelled to sell, then pay off the mortgage with the sale proceeds. If you\nco-own your home, and this problem&nbsp;could occur, you might take one of the\nfollowing precautions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Buy a mortgage life insurance policy. If you pass away with a mortgage in place, It will cover the balance due to your mortgage lender. Proceeds from your home sale will make funds available to your loved one, who will need cash to maintain and pay taxes on the smaller property you buy. <\/li>\n\n\n\n<li>Using your current income, <a href=\"https:\/\/www.deeds.com\/articles\/the-golden-years-with-a-paid-off-mortgage\/\">pay off your current mortgage quickly<\/a>, for your peace of mind.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>If you do\ndie leaving a surviving co-borrower, you can expect&nbsp;a simple transition of\nthe loan the survivor, so the mortgage can stay in place.&nbsp;If&nbsp;you are\nin the fortunate position of leaving&nbsp;enough wealth in your&nbsp;estate,\nusing your will to&nbsp;instruct&nbsp;your personal representative to&nbsp;pay\noff the mortgage will allow your loved one to receive the home free of\ndebt.&nbsp;<\/p>\n\n\n\n<pre class=\"wp-block-preformatted\"><strong><em>Pro tip:\u00a0<\/em>Most people leave general instructions in their wills that the estate should pay off debts. But does that mean secured debt? How can your executor know for sure? It's better to be clear, and expressly state that you want the executor\u00a0to send a final mortgage payoff, if that is your intent.\u00a0<\/strong><\/pre>\n\n\n\n<h2 class=\"wp-block-heading\">Should You Transfer a Mortgage Through a Transfer-on-Death Deed?<\/h2>\n\n\n\n<p>If state law\nallows for a&nbsp;beneficiary deed or transfer-on-death deed&nbsp;for\ntransferring real estate, the general process goes this way. You&#8217;ll place the\nname of your beneficiary, and&nbsp;copy the&nbsp;legal description of your\nproperty&nbsp;from your current deed, onto the <a href=\"https:\/\/www.deeds.com\/transfer-on-death-deed\/\">Transfer-on-Death&nbsp;deed<\/a>.\nThen you&#8217;ll&nbsp;record it, taking care to follow&nbsp;your state&#8217;s required\nformalities.&nbsp;Then, when you pass away, the deed&#8217;s beneficiary receives not\nonly the home, but also its debts (mortgages,&nbsp;home equity loans, and so\nforth).&nbsp;<\/p>\n\n\n\n<p>State laws\noffer a range of estate planning tools that help you plan to transfer your\ntitle straight to a beneficiary without probate. For example, the use of\na&nbsp;transfer-on-death deed&nbsp;can effect the title transfer. These\ndeeds&nbsp;can work if&nbsp;the person designated in them outlives the homeowner\nand is&nbsp;willing to take on the house and its debt as it stands when the\nowner&nbsp;passes away.&nbsp;<\/p>\n\n\n\n<p>Because of\nthe complex interplay between state laws,&nbsp;loan&nbsp;rules, and your\nown&nbsp;financial and relationship dynamics, we recommend consulting with a\nlawyer experienced in wills, estates and trusts if you opt to transfer real\nproperty with a special deed.
