{"id":84,"date":"2018-07-23T00:12:44","date_gmt":"2018-07-23T00:12:44","guid":{"rendered":"https:\/\/www.deeds.com\/articles\/?p=84"},"modified":"2024-04-25T23:21:08","modified_gmt":"2024-04-26T03:21:08","slug":"transferring-real-property-from-a-probate-estate-in-vermont","status":"publish","type":"post","link":"https:\/\/www.deeds.com\/articles\/transferring-real-property-from-a-probate-estate-in-vermont\/","title":{"rendered":"Transferring Real Property from a Probate Estate in Vermont"},"content":{"rendered":"\n<p>When a person dies, her\ndebts and assets become part of her estate and are subject to a legal process\ncalled probate. \u201cProbate\u201d means to prove the validity of a will, but the\nprimary objectives of probating an estate are settling the estate\u2019s debts and\ndistributing the remaining assets to beneficiaries according to the terms of\nthe decedent\u2019s will. A will is insufficient to pass title to real property\nunless it has been proved in a Vermont probate court (14 V.S.A. 101). If a\ndecedent dies intestate (without a valid will), her estate is distributed in\naccordance with Vermont\u2019s laws of descent and distribution, codified at 14\nV.S.A. 301, et seq.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>In addition to testate\nand intestate estates, the probate court oversees ancillary probates, where a\ndecedent resides outside of the state but owns property in Vermont, and small\nestates, where the estate involves no real property and the value of decedent\u2019s\nassets is less than $10k. Assets titled solely in the decedent\u2019s name are\nsubject to probate, while assets titled with a survivorship or beneficiary\ndesignation transfer outside of probate by operation of law. Action is still\ntypically required to legally change ownership of nonprobate assets. Consult an\nestate lawyer to discuss what is required for your specific situation.<\/p>\n\n\n\n<p>Following a death, open\nan intestate or testate estate by filing a petition in the probate court\n(probate division of the superior court) in the county where the decedent\nmaintained permanent residence at the time of death. A petitioner is typically\nthe estate\u2019s executor \u2013 the person named in the decedent\u2019s will to serve as the\nestate\u2019s fiduciary. A petitioner may also be any interested person, including\nheirs, devisees, beneficiaries, or person affected by the probate proceeding,\nas defined at 14 V.S.A. 204(1).<\/p>\n\n\n\n<p>If the decedent left a\nwill, the executor or petitioner files this at the time of petition to be\nvalidated. Some testators may file their wills upon execution with the court;\nthe first duty of the executor is to check to see if the will has been filed\nwith the court. The executor must present a certified copy of the death\ncertificate to the court. If the decedent dies intestate (without a will), the\ncourt appoints an administrator according to the order of priority established\nat 14 V.S.A. 903. The executor or administrator of an estate may also be\nreferred to in more general terms as a personal representative (PR).<\/p>\n\n\n\n<p>The court formally\nappoints the executor or administrator by issuing letters testamentary or\nletters of administration, respectively, once the appointee has given bond as\ndirected by 14 V.S.A. 906. The letters evidence the personal representative\u2019s\nauthority to represent and conduct business on behalf of the estate. The\nexecutor or administrator files an inventory of the estate with the probate\ndivision within 30 days of his or her appointment, and then annually as\nrequired. The PR must also publish a notice to creditors unless excused under\n14 V.S.A. 1201. The payment of claims against the estate may commence four\nmonths after initial publication of notice to creditors (14 V.S.A. 1207); this\nis the statute of limitations on filing claims against the estate (14 V.S.A.\n1203).<\/p>\n\n\n\n<p>If the decedent\u2019s assets are\ninsufficient to pay claims, then the PR may need to sell the estate\u2019s property.\nPursuant to Vermont Title Standards 13.1, 13.2 and by operation of law, the title\nof a decedent passes to her devisees or heirs upon death, subject to a lien of\nthe administrator for payment of debts, expenses of administration, and other\nexpenses legally chargeable against the estate. The PR may sell real property\nand execute an executor\u2019s or administrator\u2019s deed 14 V.S.A. 1652 only after an\norder by the probate court.<\/p>\n\n\n\n<p>First, the executor or\nadministrator submits application to the probate division of the superior court\n(at the county level) for a license to sell real estate for payment of debts or\nother charges of administration (14 V.S.A. 1613). The Register of the probate\ndivision for the relevant district executes the license, which is then recorded\nin the land records (at the local level). The license describes the property\nthe executor or administrator is authorized to sell or convey. The court may\nalso grant a license to sell real estate, even though the personal property of\nthe decedent is not exhausted, if it has obtained consent from the heirs and\ndevisees and has determined that a sale will not prevent any specific devise by\nwill and is in the best interest of the interested parties (14 V.S.A. 1612).<\/p>\n\n\n\n<p>Following a sale of\nreal property, the PR executes a deed to convey title. A deed by executor or\nadministrator typically carries a limited warranty of title, meaning the PR does\nnot warrant to defend against title defects that existed before the decedent\u2019s\nownership of the property. A deed by executor or administrator is \u201cas valid to\nconvey the real estate of a deceased person, thereby authorized to be sold, as\nif the deed had been executed by the deceased in his or her lifetime\u201d 14 V.S.A.\n1652. <\/p>\n\n\n\n<p>The deed should specifically\nreference the order giving license to sell the within described property, along\nwith meeting standards of form and content for recorded deeds in Vermont. To\nproperty transfer title to the grantee\/purchaser, the PR signs the deed in the\npresence of an authorized officer before recording in the city or town clerk\u2019s\noffice where the subject realty is situated.<\/p>\n\n\n\n<p>For a distribution after the estate\u2019s debts and expenses of administration are paid, the probate division \u201cshall assign the residue of the estate to the persons entitled\u201d to it through court order (14 V.S.A. 1721). The order or decree names the distributees and the proportions or parts to which each is entitled, to be distributed to them by the executor or administrator. It also establishes how all heirs taking the property will vest title [1]. A decree \u201cis\u2026evidence of the finality of a transfer of property\u201d from decedent to heir or devisee and establishes marketable title.
