This hideous\nand deadly virus became a major challenge to the systems that carry us through\nour everyday transactions.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Deed\nRecording in the Time of COVID-19<\/h2>\n\n\n\n<p>Spring 2020 brought a time of <a href=\"https:\/\/www.nytimes.com\/interactive\/2020\/us\/coronavirus-stay-at-home-order.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">at-home quarantine to people in most every walk of life, across most of the United States<\/a>. To shield employees and the public against the spread of the virus, many county recorders shut their offices in March. This meant they were providing the public with limited ability, at best, to record documents and complete their real estate transfers.<\/p>\n\n\n\n<p>On March 26,\n2020, Fidelity National Financial CEO Raymond Quirk, along with the company\u2019s\nchief legal officer, wrote to Mark Calabria, the director of the Federal\nHousing Finance Agency, to discuss these limits. The letter characterized property\ntransfers as \u201cthe backbone of our nation\u2019s financial health.\u201d The typical U.S.\nhousehold saves $3,300 a year through refinancing \u2014 a substantial monetary\nstimulus. And deed recorders supply essential services: shielding consumers\nfrom fraud, solidifying the lender\u2019s lien priority, and keeping titles\ndefect-free. In light of these realities, FNF urged the Federal Housing Finance\nAgency to press for exemptions to&nbsp;let&nbsp;county recorders and\nregistrars&#8217; offices&nbsp;stay open.<\/p>\n\n\n\n<p>But why\nshould that be necessary? After all, we are talking about issuing, signing, and\nrecording paperwork. Can\u2019t these processes be handled remotely?<\/p>\n\n\n\n<p>Many county recorders<em> are<\/em> able to digitally submit documents into the county records. Electronic signatures are no longer oddities, paperwork for home sales is becoming digital, and county recording offices regularly scan home deeds for online review. Nevertheless, COVID-19 obstructed Washington DC\u2019s building permit process, as declarations of covenants became nearly impossible to record. And while California, for example, allows for eRecording, it\u2019s only available to professionals, not the public.<\/p>\n\n\n\n<p>The\njurisdictions currently offering public access to eRecording services are\nleading the way to the future. A completely electronic process must become\nstandard, from online notarization to the uniform handling of mortgage\nagreements.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">In\nSearch of the Digital Mortgage<\/h2>\n\n\n\n<p>The fully\ndigital mortgage-based home purchase needs just one thing&nbsp;to become the\nnorm. It needs to automate the final phase: closing.&nbsp;<\/p>\n\n\n\n<p>A closing on\na property sale is that magic moment when the seller and the buyer come to the\ntable and sign the final title and mortgage paperwork,&nbsp;and the new owner\nreceives the title and the keys to the home.&nbsp;The main hindrance to fully\nonline closings \u2014 in addition to the need for standardized, secure <a href=\"https:\/\/www.deeds.com\/articles\/remote-notarization-of-real-estate-deeds\/\">remote\nnotarization<\/a> policies and practices \u2014 is the lack of eRecording\ncapabilities in some counties.<\/p>\n\n\n\n<p>Cook County, Illinois provides a model for others to follow. The county provides deed recording services without requiring any in-person contact. Consider its response to the virus lockdown: a Recorder of Deeds Public Notice on COVID-19. Dated\u00a0March 16, 2020, it explained\u00a0that while Recorder of Deeds offices were temporarily closed to the public, basic functions could be handled remotely:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>People could continue to record documents in Cook County by submitting documents to the Recorder of Deeds not just by mail or delivery companies, but also by selecting the eRecording option.<\/li><li>Online purchases of copies of documents recorded since 1985 could be made by following the guidance on the Recorder\u2019s website.<\/li><li>Documents recorded before 1985 also remained available, by e-mailed request.<\/li><\/ul>\n\n\n\n<p>On March 24, <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.sarasotaclerk.com\/about-us\/news-and-announcements\/updates-about-covid-19\" target=\"_blank\">Sarasota County<\/a> closed its drop box, and stopped taking hand-delivered documents. Like Cook County, Sarasota had alternate delivery options in place in addition to overnight mail, including <a href=\"https:\/\/www.sarasotaclerk.com\/e-services\/online-filing\/e-recording\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">eRecording for mortgages, deeds, and notices of commencements<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Will\nReal Estate Transactions Become Stay-at-Home Affairs?<\/h2>\n\n\n\n<p>In the\nfuture, will home sales happen entirely online? If so, the gains in convenience\nand transparency could be substantial, suiting the <a href=\"https:\/\/www.deeds.com\/articles\/buying-real-estate-are-the-generations-really-different\/\">new\ngenerations of home buyers<\/a>.&nbsp;Even before COVID-19, wire payments,\nonline collaboration and the use of&nbsp;teleconferencing&nbsp;was rapidly\nincreasing. Other digital real estate transaction trends include:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Mortgage apps.<\/strong> Quicken Loans pressed innovation ahead by introducing Rocket Mortgage, an online mortgage process, in 2015. Today\u2019s <a rel=\"noreferrer noopener\" href=\"https:\/\/www.nerdwallet.com\/reviews\/mortgages\/rocket-mortgage\" target=\"_blank\">mortgage apps<\/a> can check a user\u2019s bank account information and state how much the user qualifies to borrow.  <\/li><li><strong>The iBuyer market:<\/strong> Redfin, Keller Williams, Zillow and other companies are driving the <a rel=\"noreferrer noopener\" href=\"https:\/\/www.bankrate.com\/real-estate\/ibuying\/\" target=\"_blank\">iBuyer<\/a> market, which offers an option for homeowners who want cash for their homes in days, not weeks or months. <\/li><li><strong>Automation:<\/strong> As more functions occur through automated technology instead of manual entries, the need for services that charge recording fees, escrow fees, and other costs decreases.<\/li><li><strong>Paperless eClosings:<\/strong> The trajectory of progress in a digital era is leading to fully automated closings. Wescor Land Title Insurance Company, in partnership with Notarize.com, has lauded the advent of a fully electronic closing process in which there is \u201c<a rel=\"noreferrer noopener\" href=\"https:\/\/www.businesswire.com\/news\/home\/20180111005806\/en\/Notarize-Westcor-Partner-Support-Online-Notarization-16\" target=\"_blank\">no scheduling required that disrupts your life and no driving to the closing<\/a>.\u201d<\/li><li><strong>Blockchain in real estate:<\/strong> <a href=\"https:\/\/www.deeds.com\/articles\/the-real-estate-deal-decluttered-blockchain-and-deed-recording\/\">Blockchain technology<\/a> can ensure title integrity. And when closings are fully automated, the <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.forbes.com\/sites\/nataliakarayaneva\/2020\/03\/05\/real-estate-digital-asset-trends-coronavirus\/\" target=\"_blank\">tokenized deed<\/a> could emerge, says Natalia Karayaneva, whose business focuses on blockchain-based home transactions. Home ownership might one day be represented by digital tokens that could be transferred peer-to-peer. One category of property transaction has already been tokenized, Karayaneva notes: the home equity line of credit (HELOC).<\/li><li><strong>The rise of liquidity in real estate:<\/strong> The <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/medium.com\/brikkapp\/blockchain-and-the-democratization-of-real-estate-investing-7c5822b6d644\" target=\"_blank\">real estate sector<\/a> has a global valuation higher than that of any other asset class in existence. Expect to find more innovations focused on liquidity in this market over the decade ahead, as up-and-coming generations of home buyers come to expect direct, digital control over their assets.  <\/li><li><strong>Artificial intelligence (AI):<\/strong> <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/magazine.realtor\/daily-news\/2019\/05\/16\/you-re-not-being-replaced-by-ai\" target=\"_blank\">Digital assistants<\/a> can help real estate agents gauge a home buyer\u2019s interest in certain properties, based on their location, their social ties, tastes, and needs. It can also match the delivery of information to the clients\u2019 online browsing and home-shopping schedules. Expect AI to sync up with home shoppers\u2019 smartphone calendars, collect user preference data, offer parking directions, and even unlock the home using a secure code.<\/li><\/ul>\n\n\n\n<p>Expect\nbrokers and real estate agents to become increasingly proficient in digital\ntechnologies \u2014 if only to avoid becoming replaced by them.&nbsp;Agents who have\na strong and interactive online presence, and know how to use new technologies\neffectively, will be the&nbsp;winners. And, on the other side of the coin, a\ndigital real estate market promises to demystify&nbsp;the real estate market\nand make property assets easier to transfer for ordinary people, not just\nindustry experts. Much will depend on how diligently recording offices and\npolicy-makers work to create accessibility in real estate technology. &nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Remote Notarization of Real Estate Deeds <\/h2>\n\n\n\n<p>Notarizing a\ndocument, by definition, means&nbsp;witnessing a&nbsp;signature in real time.\nThe notary\u2019s witnessing role serves to verify to the public that a person who\nsigned a document was actually identified as that person, and actually observed\nin the act of signing the document, knowingly and without coercion. Yet many\nkey real estate documents are&nbsp;now handled electronically. How, then, does\nremote notarization work?<\/p>\n\n\n\n<p>Technology\nis changing the role and the definition of&nbsp;witnessing.&nbsp;We now have\nwebcams. And we have tech-savvy legislators. Today, notaries in several states\nremotely witness signatures and verify documents. It\u2019s a process is known as\nRON: remote online notarization. With RON, notarizing \u2014 a key step in the valid\nproperty transfer \u2014 can happen without in-person meetings.<\/p>\n\n\n\n<p>Enter the coronavirus crisis. Now, there\u2019s a powerful sense of urgency for remote online notarization. Online collaboration and verification capabilities facilitate social distancing as well as the avoidance of dangerous weather, travel restrictions, or political unrest. Of course, any form of&nbsp;notarization of records involving mortgage loans must adhere to industry standards. And&nbsp;the Mortgage Industry Standards Maintenance Organization, expressly responding to the COVID-19 crisis, has published a <a href=\"http:\/\/www.mismo.org\/standards-and-resources\/digital-mortgage-resource-center\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">list of RON providers<\/a> on its website, citing remote notarization capacity as \u201cone important tool\u201d to support public safety and the continuity of business.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Industry\nExperts Weigh In on&nbsp;Remote Notarization<\/h2>\n\n\n\n<p>As notaries <a href=\"http:\/\/forum.notarycafe.com\/t\/remote-notarization\/3788\" target=\"_blank\" rel=\"noreferrer noopener\">point\nout<\/a>, remote online notarization needs special concern, because it goes beyond\nelectronic notarization. Electronic notarization, or eNotarization, can&nbsp;be\nhandled in the physical presence of the parties, using&nbsp;paper\nor&nbsp;an&nbsp;electronic journal. In&nbsp;remote notarization, in contrast,\nthe signing happens at&nbsp;a distance. The notary cannot pick up and examine\nthe signers&#8217; physical IDs.&nbsp;Thus, the&nbsp;<a href=\"https:\/\/www.nationalnotary.org\/notary-bulletin\/blog\/best-practices\" target=\"_blank\" rel=\"noreferrer noopener\">National Notary Association<\/a> has recommended in-person\nnotarization.&nbsp;In-person signing, the Association asserts, protects the\npublic and the integrity of the signing.<\/p>\n\n\n\n<p>Yet the\nMortgage Bankers Association (MBA) and the American Land Title Association\n(ALTA) have jointly supported&nbsp;remote online notarizations as an attractive\nconsumer benefit. These groups express concerns that different states have\ntaken different approaches. They call for uniform standards to&nbsp;be adopted.\nAt <em>Deeds.com<\/em>, we\nconcur. Their stance has proven itself&nbsp;forward-thinking, and their call\nfor uniform standards is ripe. Today, a deadly virus is converging with the\nhuman technological capacity to push new social and legal norms into being. The\ncall from the MBA and ALTA for a uniform acceptance and approach to remote\nnotarization is now&nbsp;likely to be heeded.<\/p>\n\n\n\n<p>The most\nimportant reason for uniform standards is exactly what the National Notary\nAssociation stressed. <a href=\"https:\/\/www.deeds.com\/articles\/category\/deed-fraud\/\">Deed fraud<\/a>&nbsp;and\nrelated crimes are increasingly common. Fraudsters are always on the lookout\nfor new opportunities. Proper, careful notarizations comprise a key element in\npreventing&nbsp;fraud that can end up&nbsp;invalidating&nbsp;mortgages and\nembittering lives. To ensure the integrity of&nbsp;land title records and the\nsecure treatment of documents, laws should require notarization&nbsp;to\ninvolve:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Uniform means of verifying signers\u2019 identities whether for RON, in-person eNotarization, or paper.<\/li><li>The continuing education of notaries public, with an eye to helping notaries detect duress, undue influence, fraudulent intent, or fake identification, and prevent defects in notarizations.<\/li><li>Research into occurrences of RON fraud.<\/li><li>Support for the development of online fraud prevention mechanisms.<\/li><li>A notation on all notarized documents indicating whether RON or in-person notarization took place. This would be especially helpful in any fraud analysis.<\/li><li>Online recording of the full action, to make every element easily traceable.<\/li><li>Significant periods for retaining recordings.<\/li><\/ul>\n\n\n\n<p><a href=\"https:\/\/www.alta.org\/media\/pdf\/ron\/remote-online-notarization-checklist.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ALTA offers a thorough checklist&nbsp;<\/a>for developing state\nlaws.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Remote Notarization Early Adopters<\/h2>\n\n\n\n<p>A uniform,\naccessible, yet safe approach will be a boon for society, as it greatly\nimproves the experience of real estate transactions for buyers and sellers. Several\nstates have pioneered remote online notarizations, or RON, using leading-edge\naudio-video conference technology:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Virginia.<\/strong> In 2011, Virginia was first to enact a law allowing remote notarizations. An <a rel=\"noreferrer noopener\" href=\"https:\/\/www.commonwealth.virginia.gov\/official-documents\/notary-commissions\/enotary-faq\/\" target=\"_blank\">Electronic Notary in Virginia<\/a> may electronically notarize a document in the physical presence of the signer, or use audio-video conference technology to perform a remote notarization online. While most states that since adopted RON expect the notary and the people signing documents to perform the action within the state, Virginia recognized interstate remote notarizations as valid. Mortgage and notary services promoting eClosings arose, promoting services carried out online by Virginia notaries. Whether states other than Virginia must acknowledge the validity of this practice raised new legal questions and illustrated the need for uniformity on the emerging practice.<\/li><li><strong>Texas.<\/strong>&nbsp;An&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.sos.state.tx.us\/statdoc\/gettingstarted.shtml\" target=\"_blank\">Online Notary Public<\/a>, as commissioned in Texas, may perform remote notarization using audio-visual conference technology. Rather than a physical ID, verification of the signer\u2019s identity employs knowledge-based authentication, involving a requisite number of correct answers to personal questions. This follows the example set in Virginia.<\/li><li><strong>Montana.<\/strong> Since 2015, within Montana\u2019s borders, notaries public may <a rel=\"noreferrer noopener\" href=\"https:\/\/sosmt.gov\/notary\/enotarization\/\" target=\"_blank\">perform remote notarizations<\/a> using real-time webcam technology. Remote notarization can be paired with eNotarization or traditional paper notarization. Notaries must save recordings for a significant span of time \u2014 10 years \u2014 lest any future disputes arise about a given signature.<\/li><li><strong>Nevada.<\/strong>&nbsp;A <a rel=\"noreferrer noopener\" href=\"https:\/\/www.nvsos.gov\/sos\/licensing\/notary\/enotary-faqs\" target=\"_blank\">Nevada Electronic Notary Public<\/a> may perform notarization services using electronic tools or with RON through live, online audio-video calls.<\/li><li><strong>Kentucky.<\/strong> Kentucky\u2019s commissioned notaries can perform eNotarizations with the DocVerify e-Notary platform, which removes the need for paper or a rubber stamp. The National Notary Association observed that Kentucky thus positioned itself among <a rel=\"noreferrer noopener\" href=\"https:\/\/www.nationalnotary.org\/notary-bulletin\/blog\/2019\/02\/19-more-states-propose-remote-notarization-in-2019\" target=\"_blank\">the growing number of U.S. states<\/a> to facilitate remote online notarizations by way of audio-visual conferencing technology.<\/li><li><strong>Ohio. <\/strong>New legislation moved the commissioning of <a rel=\"noreferrer noopener\" href=\"https:\/\/www.nationalnotary.org\/knowledge-center\/news\/law-updates\/oh-senate-bill-263\" target=\"_blank\">Ohio<\/a> notaries from county courts of common pleas to the Ohio Secretary of State, whose office now sets the standards for online notarizations and online notaries. This brought the authority over both in-person and RON notarization into one single government office.<\/li><li><strong>Minnesota.<\/strong> In 2019, the state of Minnesota enacted a <a rel=\"noreferrer noopener\" href=\"https:\/\/www.sos.state.mn.us\/notary-apostille\/notary-help\/remote-online-notarization-authorization\/\" target=\"_blank\">remote online notarization <\/a>provision. The notary must be registered with, and authorized by, the Minnesota Secretary of State.<\/li><\/ul>\n\n\n\n<p><strong>Florida<\/strong> has just stepped to <a href=\"https:\/\/www.floridabar.org\/the-florida-bar-journal\/danger-will-robinson-the-new-frontier-of-remote-online-notarization-and-electronic-wills\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">the frontier of remote notarization<\/a>, and&nbsp;several additional states are making the transition, including <strong><a rel=\"noreferrer noopener\" href=\"https:\/\/www.michigan.gov\/sos\/0,4670,7-127-1638_8736-257964--,00.html\" target=\"_blank\">Michigan<\/a><\/strong>, as well as <a rel=\"noreferrer noopener\" href=\"https:\/\/www.nationalnotary.org\/notary-bulletin\/blog\/2018\/07\/5-more-states-approve-remote-notarization\" target=\"_blank\"><strong>Indiana, Vermont,<\/strong> and <strong>Tennessee<\/strong><\/a>. Significantly, Tennessee decided to enable its in-state notaries to perform remote online notarizations wherever the signature physically occurs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Way Forward<\/h2>\n\n\n\n<p> Given the realities of our&nbsp;interconnected population, and the unknown factors influencing diseases in a changing climate, the novel coronavirus&nbsp;<a href=\"https:\/\/www.weforum.org\/agenda\/2020\/03\/coronavirus-global-epidemics-health-pandemic-covid-19\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">won\u2019t be over when it\u2019s over<\/a>. What does that mean for property transactions? Expect to see the&nbsp;real estate industry implementing&nbsp;automation. Expect better&nbsp;online&nbsp;access to real estate&nbsp;document recording. Resilience will require the adoption of&nbsp;technological advancements \u2014 with appropriate consumer protections in place. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>The latest impetus to digitalize real estate might just turn out to be the tipping point.
