Battered by the\npandemic, facing snowballing debts and possible defaults, many people are now\nconsidering risks they would have rejected in the past. Deed fraudsters can be\ncounted on in times like these to aggressively seek new opportunities. <\/p>\n\n\n\n<p>Any wiring directions or changes to money transfer requests over\nthe phone or by email should arouse suspicion today. Rather than act or answer,\nrecipients should call the company and deal with a real person. And rather than\nuse phone numbers supplied in messages, recipients should take the extra step\nof visiting the company\u2019s website, copying the published number, and calling\nthat number. Personal details should be volunteered only after the identity of\nthe party making the request if verified, or by physically going to the\ncompany\u2019s office.<\/p>\n\n\n\n<p>Of course, COVID-19 itself is making in-person meetings less\npossible or at least less palatable. Part of the fraud risk involves the way\nonline transmission of our personal and financial data can be so easily and rapidly\nhandled.&nbsp; &nbsp;<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Doing Business Online: Special Caution Needed<\/h2>\n\n\n\n<p>Real estate deals are becoming more convenient for buyers and sellers alike, as transactions move online. County recording offices, to varying degrees, have <a href=\"https:\/\/www.deeds.com\/articles\/pandemics-property-transfer-breakdowns-the-digital-real-estate-industry-is-coming\/\">continued<\/a> to support and facilitate deed filings through the pandemic. New York made remote notarization possible through an executive order \u2014 expressly <a href=\"https:\/\/www.nytimes.com\/2020\/03\/23\/realestate\/coronavirus-home-buying-mortgage-refinancing.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">to address the coronavirus lockdown<\/a>. <\/p>\n\n\n\n<p>The shift to online transactions, helpful as it is, also\nopens new fraud vectors. If a deed can\u2019t immediately be recorded at the close\nof a transaction, for example, there\u2019s a temporary gap in the public record that\nscammers can exploit to resell a house. And duplicity in the online market is\nall too common. Some scammers go so far as to lift images and property descriptions\nfrom real estate sites, then pretend to be legitimate sellers. <\/p>\n\n\n\n<p>Melissa Pippin-Carson and Roger Carson, who have both served as officers for the Santa Fe Association of Realtors, <a href=\"https:\/\/www.santafenewmexican.com\/life\/home\/spouses-selling-houses-beware-of-real-estate-fraud\/article_37cbe504-5595-11ea-b3d3-4beb0905de52.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">relay<\/a> the story of an online home sale in which the scam artist was the buyer. To close on the New Mexico property, the buyer sent a cashier\u2019s check, which happened to be written out for a $20,000 surplus over the agreed-upon price. The title company found the mistake, and wired the excess payment back to the buyer. The $20,000 ended up at a closed bank account with no available contact information. The cashier\u2019s check turned out to be fraudulent.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Voiding Fraudulent Deed Transfers<\/h2>\n\n\n\n<p>In one form of ongoing deed fraud, amounting to hundreds of\ncases a year, distressed property \u201cconsultants\u201d seek out people facing\nfinancial setbacks, offering to help them modify the terms of their mortgage\nloans. Some owners inadvertently sign their home deeds over to these \u201cmortgage\nrelief\u201d specialists. The homeowner may believe assurances that the consultant\nwill take care of the mortgage payments and the homeowner\u2019s credit rating will\nimprove if the owner would just transfer the deed temporarily, and stay in the\nhouse as a renter for a few months. The scammer\u2019s intent is to evict the swindled\nowners and keep their deeds. <\/p>\n\n\n\n<p>Of course, the people who hand over their deeds under\npressure are rarely in the position to hire lawyers and go to court to have an\nill-gotten deed voided.<\/p>\n\n\n\n<p>This is why New York <a href=\"https:\/\/www.nysenate.gov\/newsroom\/press-releases\/velmanette-montgomery\/governor-cuomo-signs-montgomery-weinstein-deed-theft\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">enacted a deed theft bill<\/a> in 2019. Now, when the District Attorney\u2019s office convicts a swindler, the DA can also have the fraudulent deed voided, to help make ripped-off owners whole again. The new bill also toughens New York\u2019s Home Equity Theft Prevention Act by:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Prohibiting harassment as well as deceptive\nstatements suggesting the consultant works with a government or police agency.<\/li><li>Disallowing temporary transfers of deeds.<\/li><li>Banning upfront charges, to stop bad actors from\ntaking the fees and vanishing. <\/li><\/ul>\n\n\n\n<p>Struggling homeowners should be wary of foreclosure prevention &#8220;auditors&#8221; or consultants who purport to represent law firms or the homeowner\u2019s mortgage servicer. They should carefully verify such claims and report them when they\u2019re false. The New York attorney general urges targets of deceit and deed fraud to <a href=\"https:\/\/ag.ny.gov\/loan-modification-scam-online-complaint-form\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">file official complaints<\/a>. <\/p>\n\n\n\n<p><strong><em>Pro tip: <\/em><\/strong>Demands for upfront payments are signals that something is wrong. At the federal level, <em><a href=\"https:\/\/www.consumer.ftc.gov\/articles\/0100-mortgage-relief-scams\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Regulation O<\/a><\/em> bars consultants from charging a homeowner unless and until the homeowner actually receives and agrees to an offer of relief from the mortgage lender. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Coronavirus-Driven Real Estate Ploys to Avoid<\/h2>\n\n\n\n<p>The North American Securities Administrators Association (NASAA) notes the existence of scams that exploit fear caused by the stock market\u2019s volatility to promote \u201csafe\u201d investments, from precious metals to real property. Some of these promotions target seniors by claiming they can offer recession-proof retirement portfolios or guarantee recovery of profits in an IRA. Advertisements for \u201c<a href=\"https:\/\/www.nasaa.org\/54534\/covid-19-related-investment-schemes-anticipated\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">buy low\u201d investment offerings<\/a> have strong appeal now, when people feel driven to make up for virus-related financial losses. <\/p>\n\n\n\n<p>Other scams may involve sales of discounted properties, or\nshares in properties, with assurances that buyers will reap profits when the&nbsp;housing\nsector rebounds. Watch for people selling courses on buying houses in a\nrecession, with a view to selling them for top dollar in a market revival that\nno one can time. The Federal National Mortgage Association (Fannie Mae)&nbsp;urges\npeople to work with reputable real estate agents when buying and selling real\nestate, and to take the necessary time to understand the paperwork before\nsigning any deed or agreement.<\/p>\n\n\n\n<p>There are also the <a rel=\"noreferrer noopener\" href=\"https:\/\/www.homeownerhelpny.com\/scams-explained\" target=\"_blank\">deceptive mortgage offers<\/a>\u00a0that skip any meaningful vetting of the borrower\u2019s credit, offering <a href=\"https:\/\/www.interest.com\/personal-finance\/staying-one-step-ahead-of-covid19-financial-scams\/#mortgage-specific\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">low-interest mortgages but switching them out for loans with higher rates<\/a> later. To some extent, the federal moratorium on foreclosures of FHA-insured mortgages\u00a0will curb desperate mortgage decisions. <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.forbes.com\/sites\/andrewdepietro\/2020\/03\/31\/banks-suspending-foreclosures-covid-19\/\" target=\"_blank\">Banks<\/a> began announcing they would suspend foreclosures in March 2020, and by April 6% of mortgages were on pause, thanks to <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/thehill.com\/policy\/finance\/494504-more-than-6-percent-of-us-mortgages-in-forbearance-analysis\" target=\"_blank\">forbearance<\/a> plans. Then again, this means homeowners are racking up months of debt. A steadily growing population of financially insecure people adds up to a lot of low-hanging fruit for the fraudsters who feed on fear.\u00a0<\/p>\n\n\n\n<p><strong><em>Pro tip: <\/em><\/strong>Before engaging anyone\u2019s help to\nmanage loan debts, check with your&nbsp;existing mortgage company. A mortgage\ncompany wants to avoid defaults, and may modify the terms of a loan.&nbsp; <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How Con Artists Make Contact<\/h2>\n\n\n\n<p>The Federal Home Loan Mortgage Corporation (Freddie Mac) recommends\nnot giving out sensitive information in response to a phone call or email. Red\nflags include misspellings, suspicious links, and contacts coming from actors\nyou don\u2019t already work with but who are requesting your personal details. These\nmessages are data harvesting ploys. Some contain malware that can be deployed\nby hackers and thieves.<\/p>\n\n\n\n<p>Sometimes there are no red flags. Fake messages and emails\ncan appear to be coming from Freddie Mac or some agency of the government. If\nsomeone is advertising a mortgage or refinancing product over the phone, steer\nclear. And if the caller claims to work with or for Freddie Mac, <a href=\"https:\/\/sf.freddiemac.com\/working-with-us\/fraud-prevention\/feedback\" target=\"_blank\" rel=\"noreferrer noopener\">report\nthe call<\/a>.<\/p>\n\n\n\n<p>Freddie Mac further notes reasons to distrust caller ID.\u00a0Scammers can \u201c<a href=\"http:\/\/www.freddiemac.com\/blog\/notable\/20200325_avoiding_fraud_call_spoofing.page\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">spoo<\/a>f\u201d numbers to make incoming calls appear to be from a local or known caller. <a rel=\"noreferrer noopener\" href=\"https:\/\/www.consumer.ftc.gov\/blog\/2020\/03\/ftc-coronavirus-scams-part-2\" target=\"_blank\">Robocalls<\/a> can spell trouble, too. The best practice is to avoid pressing any numbers, and to let these callers simply leave a voicemail. Rather than use the numbers in texts and emails, it\u2019s a good habit to call companies back through the number on their official websites, to avoid identity theft.<\/p>\n\n\n\n<p>Be just as wary of contact <a href=\"https:\/\/www.businessinsider.com\/scams-people-most-likely-fall-for-online-2019-10\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">over social media<\/a> or offers on websites. Sometimes, a company checks out perfectly well on the internet, and even has glowing reviews. It\u2019s best not to take a set of close-to-perfect reviews at face value automatically. It\u2019s not unheard of for reviewers to be pressed into <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.yelp-support.com\/article\/What-should-I-do-if-a-business-pressures-or-pays-me-to-change-or-remove-my-negative-review?l=en_US\" target=\"_blank\">removing<\/a> negative reviews. <\/p>\n\n\n\n<p>If you\u2019re dealing with fraud in the course of the COVID-19 pandemic,\nthere are actions you can take:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Stop responding to the scammer. <\/li><li>Call your financial institutions and any online\npayment services you have used, and alert them to the security breach. <\/li><li>Change your passwords.<\/li><\/ul>\n\n\n\n<p>Depending on the nature of the fraud, key contacts for\nreporting it include:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The <a href=\"https:\/\/www.ftccomplaintassistant.gov\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Federal Trade Commission<\/a>.<\/li><li>The <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.ic3.gov\/default.aspx\" target=\"_blank\">FBI<\/a>\u2019s Internet Crime Complaint Center.<\/li><li>The office of your state Attorney General and <a rel=\"noreferrer noopener\" href=\"https:\/\/www.usa.gov\/state-consumer\" target=\"_blank\">consumer protection<\/a> authority.<\/li><li>The Financial Industry Regulatory Authority (<a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.finra.org\/sites\/default\/files\/InvestorDocument\/p011944.pdf\" target=\"_blank\">FINRA<\/a>).<\/li><\/ul>\n\n\n\n<p>Reporting fraud helps keep everyone safer. <\/p>\n\n\n\n<p>The bottom line? Just as there is no miracle cure for COVID-19, there is no magic wand to undo the economic damage it has inflicted on so many small investors and innocent homeowners.
