Perhaps you\u2019re buying after a foreclosure, or from an estate or a\ncourt-ordered sale. If so, the entity granting the deed to you might lack\nknowledge of the property&#8217;s history. Basically, the deed means a buyer is\nexpected to accept the house as-is. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">How does this differ from a quitclaim deed? What rights and\nprotections <em>does<\/em> the bargain and sale deed give you, the new owner?\nLet\u2019s take a look.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Comparing and Contrasting the Deeds<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Bargain and sale deeds tend to be used to transfer property among family members and family trusts in Colorado,\nNew York, Vermont, Washington, and Wyoming, too. So, you might wonder, is a\nbargain and sale deed just my state\u2019s version of a <em>quitclaim deed<\/em>? <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s the quitclaim deed that\u2019s most widely associated with property\ntransfers without warranties. But there are key differences between the two\ndeeds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Quitclaim deeds<\/strong> are commonly seen when family members\ntransfer houses to each other, into an LLC, or into or out of a trust.\nSometimes they are used as release deeds, to clear up ambiguities in the chain\nof title. Subsequently, the interest can be conveyed through a warranty deed.\nQuitclaim deeds can shift the deed into a new name after the owner has a name\nchange. When are they not typically used? To sell houses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The quitclaim deed provides no warranties; it conveys the\ninterest the grantor had in the property\u2014nothing more. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A quitclaim deed is used either when the grantor has no need\nto guarantee title, or when the grantor\u2019s title is unclear. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Quitclaim deeds are most often used when there is no sale\u2014to\ntransfer property between friends, partners, or family members, or between\nowners and their LLCs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person might also sign a quitclaim to clear up a title\nambiguity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Bargain and sale deeds<\/strong>, as the term suggests, is used\nin a sale. Unlike a quitclaim, the bargain and sale deed indicates that the\ngrantor has the title and can convey it to a buyer. The grantee\u2014you, if you\u2019re receiving\nthe deed\u2014gets not only the property, but also any significant liens and\nencumbrances it might carry.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bargain and sale deeds are used in real estate deals and to\ntransfer seized property. In a foreclosure or tax sale, the entity transferring\nthe title does not occupy the land, and makes no assurances about its title history.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The bargain and sale deed indicates that the grantor has\ntitle; but property might come with encumbrances and defects.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Receiving any non-warranty deed can affect your ability to\nobtain title insurance coverage and guard against future claims.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Warranty deeds<\/strong>, unlike the two non-warranty deeds\nwe\u2019ve just described, are standard when a seller transfers a title to a buyer in\na regular sale through the real estate market. With a warranty deed, the buyer\ngets guarantees that the seller has full rights to transfer the home, an no\nother party has any claim or lien on the house or its land that could\njeopardize the buyer\u2019s rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>In short, a bargain and sale deed offers more protection\nagainst title defects than a quitclaim deed does, but is not as ironclad as a\nwarranty deed.<\/strong> <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Can You Insure a Quitclaim or Bargain and Sale Deed?<\/h2>\n\n\n\n<figure class=\"wp-block-image alignright size-medium\"><img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"241\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2020\/07\/bargain-and-sale-vs-quitclaim-deed-300x241.jpg\" alt=\"Close up image of a dark red door on a house. Different types of deeds offer different levels of protection to the\nnew owner. Debts and defects aren\u2019t always obvious. So, to prevent any claims\nin the future, can a title company <a href=\"https:\/\/www.deeds.com\/articles\/defending-a-quitclaim-deed\/\">insure a non-warranty\ndeed<\/a>?&nbsp; <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Getting insurance for a non-warranty deed can take extra\nsteps. In some situations, an owner might need to undergo a certification\nprocess to verify that the title\u2019s integrity was maintained through the seizure\nand sales processes. As a final recourse, an owner may pursue a <em>quiet title\naction <\/em>so the county court can affirm that no one else has a stake in that\nproperty, and the owner is rightfully placed in the&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/what-is-the-chain-of-title-in-real-estate\/\">chain\nof title<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A bargain and sale deed may or may not be insurable. It may come with or without covenants (as explained further in the section below). If it comes without covenants, it provides weak protection for the buyer. It will not be accepted by lenders in some states\u2014<a href=\"https:\/\/www.nyhome.com\/new-york-property-deeds.html\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">New York<\/a>, for example\u2014if you are trying to finance the home.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Pro tip: <\/em><\/strong>Before buying a home to be conveyed\nwith an instrument other than a warranty deed, a buyer can reach out to a title\ninsurance specialist and a real estate attorney. Accepting either a bargain and\nsale deed or a quitclaim deed could adversely complicate the process of getting\nyour own title insurance and protection against unanticipated claims in the\nfuture. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Bargain and Sale With Covenants<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If a bargain and sale deed comes with expressly stated guarantees\nbeyond simple ownership rights, it is known as a bargain and sale deed with\ncovenants. The grantor of such a deed is guaranteeing the property against any\npossible claims expressly covered by the covenant. It might, for instance, offer\na covenant to protect the buyer against the grantor&#8217;s acts. It may contain\nassurances that no outstanding liens or encumbrances exist. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here are a few frequent examples of the liens and\nencumbrances you\u2019d want to avoid.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Tax liens.<\/strong> Unpaid taxes on the real\nestate can lead to a tax lien. Should you try to sell the home at some point,\nthe government lien will have priority and must be paid off with any penalties\nand interest charged. Ultimately, a tax lien can lead to foreclosure. <\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Judicial liens.<\/strong> Court cases can survive\nthe bargain and sale conveyance. Old judicial liens, though, can expire when\nenough time passes under the limit set by the state.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Local<\/strong> <strong>assessments, fines, and fees. <\/strong>If\na prior owner failed to pay off debts for common infrastructure and services,\nthere could be a variety of liens on the house.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Homeowners\u2019 association fines and dues.<\/strong> A\ncondo property considers various forms of unresolved debts and fines for\nhomeowner violations lienable, subject to recording at the county\ncourthouse.&nbsp; <\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Mortgage liens.<\/strong> Do not neglect the possibility\nthat another mortgage company, bank, or other party has a claim. The property\nmight have had mortgages or secured loans lurking at the time of sale that\ncould lead to foreclosure if left unresolved.&nbsp; <\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Mechanics\u2019 liens.<\/strong> Bargain and sale deeds\ncan transfer homes that have had repairs or construction which the previous\nowner never resolved. A valid bargain and sale deed states the name of the grantor\nand grantee (parties transferring and taking title), and a declaration that the\ngrantor is conveying the title to the named grantee. It sets forth the complete\nlegal description of the property, and is signed and dated by the grantor.\nState law has specific requirements to follow.&nbsp;\n<a href=\"https:\/\/www.deeds.com\/forms\/oregon\/bargain-and-sale-deed\/\">Here\nare Oregon\u2019s<\/a>, which exemplify the way a&nbsp;bargain and sale\ndeed&nbsp;transfers the grantor&#8217;s interest in the property without supplying\nfurther guarantees. Generally, the deed must be signed by the parties and two disinterested\nwitnesses (not spouses) before a notary public.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For the strongest protection, ask your realtor to press the\nseller to provide you with a warranty deed. If you are financing your purchase,\nthe lender will insist on title insurance, which you will pay for. To be sure\nyou can insure your purchase, a title company will likely need the warranty\ndeed. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you are unable to purchase your new home with a general warranty deed, we recommend consulting with a real estate lawyer who can assist you with negotiations and the purchase.
