Today, a force is challenging that rule, and we all need to know about\nit before heading for the closing table. It involves the risk of weather damage\nand disasters. &nbsp;<\/p>\n\n\n\n<p>Emergencies are affecting more real estate as the years go\non. Whether a catastrophe is defined as natural, human-driven, or both \u2014 as\nwith today\u2019s storm surges and floods \u2014 it can lead to default on mortgages or <a href=\"https:\/\/www.deeds.com\/articles\/category\/deed-of-trust\/\">deeds of trust<\/a>.\nHere, we look at the risks, industry responses, and how homeowners can protect\nthe value of their titles.<\/p>\n\n\n\n<!--more-->\n\n\n\n<p>When a virus threat looms large, other risks might seem to fade. Yet more than a fourth of U.S. homes face the prospect of a <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/eos.org\/opinions\/do-you-know-your-homes-flood-risk\" target=\"_blank\">one-in-a-hundred year flood<\/a>. That\u2019s far more than projected by the Federal Emergency Management Agency (FEMA), which bases its forecasts on historical occurrences. Climate is a complicating factor. One of the effects of climate disruption is sea level rise, which has already washed out billions of dollars in property value appreciation along the Gulf and Atlantic coasts. Nonprofits are warning home shoppers about the <a href=\"https:\/\/www.marketwatch.com\/story\/sea-level-rise-wont-affect-my-house-even-flood-maps-dont-sway-florida-coastal-residents-2020-02-07\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">potential a decrease in home\u00a0values<\/a> if they buy coastal\u00a0properties.<\/p>\n\n\n\n<p><strong><em>Disappearing act.<\/em><\/strong> What happens to the title if\na rise in the water level completely takes over a property? As a matter of\nlong-settled law, when coastlines change, the boundaries of coastal properties change\nwith them. If the land erodes and becomes submerged, the title is extinguished.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Sometimes, \u201cUnder Water\u201d Is All Too Real for a Mortgage Borrower.<\/h2>\n\n\n\n<p>Most weather-damaged homes can be salvaged, but for a\nhomeowner facing a flood restoration project, monthly mortgage payments can\nbecome unbearable. Mortgage companies\u2019 responses vary according to the nature\nof the emergency and how financial hardships unfold: <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>If the mortgage account was in good standing\nuntil disaster struck, homeowners should call to negotiate loan modifications.\nIf arranging a workable plan is simply not possible, the homeowner will need to\nunderstand <a href=\"https:\/\/www.deeds.com\/articles\/i-cant-pay-my-mortgage-any-more-whats-next\/\">deeds\nin lieu of foreclosure and other options<\/a>.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>If the homeowner\u2019s mortgage payments were in\narrears for several months before a catastrophe struck, unless the parties\nworked out a repayment plan, foreclosure is a possibility. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>General rules can change in unusual circumstances. For example, in 2020, in response to the widespread economic impact of the coronavirus pandemic, federal <a href=\"https:\/\/www.consumerfinance.gov\/coronavirus\/mortgage-and-housing-assistance\/mortgage-relief\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">forbearance<\/a> allowances were made. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>A mortgage company servicing a loan backed by Freddie\nMac can suspend foreclosure, on a case-by-case basis, for up to 90 days after an\nemergency starts. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Companies providing Veterans Affairs (VA) mortgages\nmust assess the damage, counsel the borrowers, and report on actions taken for property\nowners. The VA might expect the company to allow a 90-day payment moratorium. <\/li><\/ul>\n\n\n\n<p>Where a mortgage company has discretion, it will take into\naccount the borrower&#8217;s loss of income and increased costs of living, including costs\nof finding and paying for other housing if necessary.<\/p>\n\n\n\n<p>In the worst cases, properties cannot\nbe saved. <a href=\"http:\/\/www.ouazad.com\/resources\/paper_kahn_ouazad.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Research\nshows<\/a> that some lenders, concerned about securing debt with assets\nthat could be washed away, drop mortgages with high climate change exposure and\nsell them off to Freddie Mac and Fannie Mae.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><em>It\u2019s Storm Season. Do\nYou Know Where Your Deed Is? <\/em><\/strong><\/h2>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2020\/08\/real-estate-document-natural-disasters.jpg\" alt=\"Image of a row of safety deposit boxes. Sometimes, people inherit houses without keeping track of the title. But clearing and safeguarding the house title is a basic need for homeowners at any time \u2014 and especially now. It\u2019s a key criterion for disaster assistance applications.<\/p>\n\n\n\n<p>What else\ncan homeowners do to be sure their ownership stays clear? Some choose to pass\ntheir homes on with <a href=\"https:\/\/www.deeds.com\/articles\/update-the-state-of-the-transfer-on-death-deed\/\">transfer\non death deeds<\/a>, where permitted by state law. &nbsp;Also known as a <em>beneficiary deed<\/em>, it is short, easy, and inexpensive to create and record.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Your Homeowner\u2019s Insurance Company: Will It Be There During a Disaster? <\/h2>\n\n\n\n<p>Forbearance from an insurance company is not easily given,\neven in the harshest circumstances. As the&nbsp;<a href=\"https:\/\/www.pewtrusts.org\/en\/research-and-analysis\/blogs\/stateline\/2020\/07\/13\/financially-stretched-homeowners-might-skimp-on-insurance-and-hurricane-season-is-here\" target=\"_blank\" rel=\"noreferrer noopener\">Pew Trust<\/a> noted:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>A minority of states&nbsp;directed insurance firms\nto hold off cancelling policies for struggling customers during the 2020\ncoronavirus pandemic. The cancellation suspensions were short-lived. To make\nmatters worse, lenders sometimes foreclose on homeowners whose insurance\npayments lapse. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Ninety percent of disasters involve water, but\nbecause flood insurance is so pricey, just 15% of U.S. homeowners have flood\ninsurance. <\/li><\/ul>\n\n\n\n<p>When a house is outside of the Federal Emergency Management Agency (FEMA) flood hazard zones, mortgage applicants don\u2019t need to buy flood insurance. But they can <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/www.propublica.org\/article\/millions-of-homeowners-who-need-flood-insurance-dont-know-it-thanks-to-fema\" target=\"_blank\">research flood insurance<\/a> their companies might offer, and learn about the benefits of getting <a href=\"https:\/\/www.proplogix.com\/blog\/how-elevation-certificates-help-determine-your-property-flood-risk\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">an\u00a0elevation\u00a0certificate<\/a>, even where it\u2019s not required. While typical home policies may cover sewer backups, that\u2019s not enough for owners of inundated homes.<\/p>\n\n\n\n<p>Following a disaster, property restoration can involve adding\nwater-resistant elements \u2014 higher electrical outlets, pumps, protective berms. Newer\nhomes may have higher foundations, with storm surges in mind. New materials and\ndesigns can make roofs capable of withstanding gale-force winds.<\/p>\n\n\n\n<p>Meanwhile, what can the average homeowner do to lower risk? Insurance\ncompanies might be in the best position to advise us. Read on to find out how\nup-and-coming insurance companies aim to help owners keep their policies, spend\nless on restoration, and recover more quickly from catastrophes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A Riskier Future Is Inevitable. And in the years ahead, we\u2019ll see the rise of <a href=\"https:\/\/www.brinknews.com\/climate-change-is-now-driving-flood-resilience-investments-insurance-covid-risk-resilience-business-continuity\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">disaster preparedness tech<\/a> in the insurance world. <\/p>\n\n\n\n<p>High-tech insurance (\u201cinsurtech\u201d) startups want to <a href=\"https:\/\/www.ozy.com\/the-new-and-the-next\/the-insurers-running-toward-the-climate-change-fire\/257749\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">disrupt traditional home insurance<\/a> with their services for homeowners in disaster-prone areas. Equipped with data analytics, keen on dealing with catastrophes proactively, they are in the business of informing as well as insuring. Because there will always be those people who never let an emergency go to waste. The <em><a href=\"https:\/\/www.wsj.com\/articles\/the-new-storm-chasers-real-estate-disaster-investors-11564498767\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Wall Street Journal<\/a><\/em> has taken note of a new breed of disaster investors. Owners of badly damaged homes, especially uninsured or underinsured homes, may see no other choice but to let their houses go to these home flippers for absurdly low prices.<\/p>\n\n\n\n<p><strong><em>Pro tip:<\/em><\/strong> Some states have flood disclosure laws. But be sure to undertake due diligence when studying the risks inherent in any home for sale. <a href=\"https:\/\/wusfnews.wusf.usf.edu\/post\/sea-rise-wont-sink-all-floridas-real-estate-market-experts-say-just-parts-it\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Florida<\/a>, one of the most susceptible to rising sea levels, has traditionally lacked a disclosure mandate. This kind of risk might be beneath the radar for home shoppers, yet it matters profoundly to all of us who <a href=\"https:\/\/www.deeds.com\/articles\/buying-a-house-to-save-money-its-a-tried-and-true-method\/\">invest in real estate to build wealth<\/a>. <\/p>\n\n\n\n<p>We can ignore climate change and its impact on\nhomeownership, but that\u2019s not a resilience plan.
