Of course, a professional will be examining the title. But a title search\ndoes not include a survey. With a title search, the title company reviews the\nchain of title, up to the present ownership. It does not reveal specific\nphysical details of the property. <\/p>\n\n\n\n<p>Depending on the region of the country (and even the state)\nin which the home exists, the mortgage company might or might not require a\nsurvey. Nevertheless, either the seller or the buyer may want to hire a service\nto produce an up-to-date survey. Here, we make the case for having this done \u2014\nso you can decide for yourself.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">What Is a Property Survey?<\/h2>\n\n\n\n<p>A property survey is, as the term suggests, a diagram of boundaries,\nangles, and measurements. It shows where on Earth the real estate is. It\nprecisely sets forth the property\u2019s dimensions. It shows the key structures and\nfeatures of the real estate, and makes clear where the property owner\u2019s land stops,\nand the adjacent property owners\u2019 lands begin. <\/p>\n\n\n\n<p>A land survey also lays out the points of access to the\nproperty. Surveys can indicate changes by past owners \u2014 new structures, additions\nto the home, new pavement, new fences.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Does a Seller Need a Property Survey? <\/h2>\n\n\n\n<p>A seller might wonder if shelling out a few hundred dollars\nfor a property survey is an unnecessary expenditure. Consider the home within a\nstone wall that runs around the entire property. Or perhaps the property is a\nunit of a condo community, so the surrounding land is held by the homeowners\u2019\nassociation. <\/p>\n\n\n\n<p>The owner of the walled home might benefit from a survey if,\nsay, the property is bigger than a public listing indicates. For the condo\nunit, the interior dimensions matter, and the buyer\u2019s appraisal states those. (If\nthe condo is bigger than the listing indicates, the appraisal may say, for\nexample: \u201cPublic records state the unit is 1,000 square feet, but based on\nphysical measurements it is 1,100 square feet.\u201d)<\/p>\n\n\n\n<p>For many detached homes, hiring a surveyor can help to\nensure a transparent and informative home sale. Proactively taking this step could\nspare the seller the agony of watching a deal fall though on account of\nsomething that could have been remedied in advance, if only the seller had\nknown.<\/p>\n\n\n\n<p>Could the property have some kind of invisible hazard? Examples\ninclude:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Sinkholes.<\/strong> Could the property be vulnerable to sinkholes? Sinkholes do their biggest damage in Alabama, Florida, Kentucky, Missouri, Pennsylvania, Tennessee, and Texas, according to the<a href=\"https:\/\/www.usgs.gov\/special-topic\/water-science-school\/science\/sinkholes\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\"> U.S. Geological Survey<\/a>.\u00a0<\/li><li><strong>Flood risks.<\/strong> Updated surveys may indicate that the property potentially exists in a\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.fema.gov\/homeowners-frequently-asked-questions\" target=\"_blank\">flood risk zone<\/a>. <\/li><\/ul>\n\n\n\n<p>The seller should know what potential damage should be\nmitigated from the threat of sinkholes, floods, and other hazards, to know the\nfair market value of the home and the proper disclosures to make.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Does a Buyer Need a Survey? <\/h2>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2020\/09\/survey-fence.jpg\" alt=\"Image of a wood picket fence with a bird sitting on it.\" class=\"wp-image-983\" width=\"467\" height=\"313\" srcset=\"https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2020\/09\/survey-fence.jpg 933w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2020\/09\/survey-fence-300x201.jpg 300w, https:\/\/www.deeds.com\/articles\/wp-content\/uploads\/2020\/09\/survey-fence-768x514.jpg 768w\" sizes=\"auto, (max-width: 467px) 100vw, 467px\" \/><\/figure><\/div>\n\n\n\n<p>You\u2019re buying a home, and you know where it is and how much\nland you\u2019re getting. But do others claim the right to use, place equipment or\nvehicles upon, or travel over some part of your property? A survey will reveal\ngeographic evidence of those claims. A survey could shed light on easements\nthat weren\u2019t obvious when you toured the property with an agent or took a\nvirtual tour. Perhaps there\u2019s evidence of a hiking pathway&nbsp;that meanders\nthrough a back corner of the land. Maybe another property owner has a gate, a\nfence, or a row of hedges placed inside your future home\u2019s boundaries. <\/p>\n\n\n\n<p>In such cases, the step of hiring a surveyor will pay off.\nYou\u2019ll be equipped to negotiate an appropriate discount on the sale price, or\nget the current owner to take care of an ongoing issue so you don\u2019t have to. <\/p>\n\n\n\n<p>In any case, as the buyer, you\u2019ll want to know that the\nfences and trees surrounding the property are in the right places. You\u2019ll need\nto know where underground utilities exist, where you can dig, and where you\u2019ll\nplace shrubs, fences, your pool, a walkway, or other planned features. You\u2019ll\nwant to examine the survey for any setbacks that keep you from installing\nanything at the boundary edges.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Will the Mortgage Depend on Getting a Survey Done? <\/h2>\n\n\n\n<p>A survey, along with the title report, is a must-have for\nthe lender\u2019s insurance policy. An underwriter may insist on a survey in order\nto issue lender&#8217;s title insurance. Otherwise, the insurance will likely exclude\ncoverage for problems that could have been discovered by the survey. <\/p>\n\n\n\n<p>Yet if the current owner\u2019s survey is of fairly recent vintage,\ntitle companies in some states might simply accept a seller\u2019s affidavit as\nassurance that the property has not changed since&nbsp;the survey was done: no\nfences repositioned, no new gas lines or sewer pipes placed in the ground, etc.\nIn this case, the title company will recertify the existing survey.<\/p>\n\n\n\n<p>In other cases, a title agent might insist on a more recent\nsurvey. This is especially likely if there are uncertain or changeable features:\nthings like meandering creeks, clearings where utility work is done, questionable\ndriveway placement, or a possible right-of-way where others are regularly passing\nthrough the property. <\/p>\n\n\n\n<p>If you\u2019re paying cash, you may decide to skip the survey\nstep. Yet there are good reasons, as you can see, for investing in a survey.\nAfter all, you\u2019ll be buying the real estate and accepting the deed. With a\nsurvey, the whole idea is to ensure the continued accuracy of the <a href=\"https:\/\/www.deeds.com\/articles\/the-importance-of-a-legal-description-in-a-real-estate-deed\/\">legal\ndescription<\/a> on your deed. Being well informed will also help you&nbsp;make\nthe right decisions about the provisions that can benefit you in an&nbsp;owner\u2019s\ninsurance policy.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How Is the Survey Done?<\/h2>\n\n\n\n<p>A surveyor goes to the site with current home deed,\nincluding the current legal description, and the home\u2019s historical records and\nmaps. The existing legal description was written by a prior surveyor. This prior\ninformation enables the&nbsp;surveyor&nbsp;to identify dimensions and\nborderlines. At the same time, the new survey <a href=\"https:\/\/www.deeds.com\/articles\/how-real-estate-legal-descriptions-and-surveys-work-together\/\">checks\nthe accuracy of the current legal description<\/a>. Surveyors also inspect\nthe boundary descriptions of the adjacent properties, to see that various\nowner\u2019s documents match.<\/p>\n\n\n\n<p>The core of the job entails mapping the property lines and\nreviewing the&nbsp;metes and bounds in the prior surveyor\u2019s field notes, or, if\navailable, the <a href=\"https:\/\/land.az.gov\/mapping-services\/sco\/about-public-land-survey\" target=\"_blank\" rel=\"noreferrer noopener\">public survey<\/a>. Landmarks can change, so the surveyor\nwill actually measure the land, and note where utilities, setbacks, and\neasements are. A home beside railroad tracks, for example, needs the proper\nbounds set forth beside the tracks, so this can be written into the legal\nproperty description.<\/p>\n\n\n\n<p>Finally, to get the real estate transfer documents ready, a\ntitle company reviews the survey, and makes sure there are no discrepancies\nbetween the surveyor\u2019s field notes and the existing recorded documents. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Tips for Obtaining Your Survey<\/h2>\n\n\n\n<p>Your survey or plat map should be on file with the county\nrecorder of deeds. If you need an updated survey done, check with the prior\nsurveyor. It may be cheaper and easier for this person to retrace the steps\ndone in the previous survey and update it than to start afresh with a new\ncompany. Check the existing survey as it will tell you the name of the\nsurveyor. If the surveyor cannot be reached, your real estate agent will likely\nhave a recommendation.
