Mortgage <a href=\"https:\/\/www.dallasnews.com\/business\/real-estate\/2020\/04\/16\/lenders-are-raising-the-credit-bar-for-homebuyers-and-refinancers\/\" target=\"_blank\" rel=\"noreferrer noopener\">lenders have really been tightening their loan approval\nstandards<\/a> these days. Lenders are cautious because so many people\nare coping with layoffs, career changes, and volatile financial situations. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some sellers are willing to help hopeful home buyers avoid\nthe mortgage process, using the <em>contract for deed.<\/em> Often, these instruments\nare put to use when the seller has a family member or close friend who\u2019d like\nto own, but has a non-traditional job or financial situation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also known as an installment sale agreement, a contract for\ndeed is a home purchase \u2014 it\u2019s just financed by the seller, not a financial institution.\nAfter the parties close on the agreement, the buyer lives in the house as the\nowner, and sends the seller monthly installments. The length of the loan and\nthe installment amounts are negotiable. There might be no down payment, or a\nrelatively modest one.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">What Sellers Need to Know About the Contract for Deed<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A contract for deed is a quick way to bypass the loan\napplication process and sell a house, while enjoying an income stream as the\nbuyer sends in monthly payments. Payments made through the term of the contract\nbelong to the seller, much as rental payments would be.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The contract is easy to end if necessary. As the seller, you\u2019ll\nstill be holding your title in the unfortunate event of a buyer breach or\ndefault. No need for a foreclosure. Should you ever need to reclaim the\nproperty, the process <a href=\"https:\/\/www.deeds.com\/articles\/a-contract-for-deed-vs-traditional-mortgage\/\">is\nsimpler and faster than the seizure of a home from under a mortgage<\/a>.\nSome sellers&nbsp;have buyers sign a <a href=\"https:\/\/www.deeds.com\/articles\/the-quitclaim-deeds-function-in-a-contract-for-deed-sale\/\">quitclaim<\/a>&nbsp;along\nwith the contract for deed, just in case any future question about ownership\nshould arise. If the seller records the quitclaim, any claim the buyer might\nhave on&nbsp;the property is straightforwardly extinguished. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The downsides? You\u2019ll hold the title, and this is a\ndouble-edged sword. You could be held responsible for any code violations or\nneglect on the part of the buyer. You\u2019ll also be waiting for some time to be\nfully paid for the house. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Of course, if there is a mortgage on the home, your name\u2019s\nstill on it, and you\u2019ll continue to be responsible for paying it through the\ncontract\u2019s term of years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Pro tip:<\/em><\/strong> Rules pertaining to contract for deed forms are state- and <a href=\"https:\/\/www.deeds.com\/forms\/new-york\/contract-for-deed\/new-york\/\">county-specific<\/a>. Know and follow your law. In some states, the seller must register the instrument with the county recorder of deeds within several months or face a fine. The seller should use <a href=\"https:\/\/www.irs.gov\/forms-pubs\/about-form-6252\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">IRS\u00a0Form 6252<\/a> for reporting\u00a0a sale by a contract for deed \u2014 and thereafter, every year that the seller takes income from the buyer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Pros, Cons, and Important Tips for Buyers<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For the right buyer and seller, the contract for deed is a\ngood alternative home sale method. It offers a way for people to handle a\ntransaction together without agents and banks in the mix. It can also give the\nbuyer with a less-than-stellar credit score time to get on better footing to\nget a mortgage in the future. For buyers who hit walls with mortgage companies,\n<a href=\"https:\/\/www.deeds.com\/articles\/what-is-a-contract-for-deed\/\">a contract\nfor deed can work<\/a>, although it lacks certain protections for the\nbuyer. With a traditional real estate purchase, there\u2019s the inspection, the appraisal,\nand a title search. These steps are vital safeguards for the buyer. Get your seller\u2019s\nagreement that they\u2019ll be performed in your contract for deed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A couple of words to the wise. As the buyer, you will not receive\nthe title before paying all the installments required in the contract. If you\u2019re\nbuying a home this way and want to do home improvements before you\u2019ve paid in\nfull, you\u2019re taking a risk that you could lose the money you invest. Also,\nunless the contract is properly filed with the county recorder of deeds, the\nowner could saddle the house with mortgages or other secured loans. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before signing a contract for deed, study the terms, the\ncosts, risks and responsibilities. The terms usually hold the buyer responsible\nfor paying for homeowner\u2019s insurance. A buyer may also have to deal with repairs\nand weather damage costs, routine maintenance and landscaping. The buyer may\nalso be paying the property taxes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under your state law, it\u2019s possible that if you can\u2019t pay or otherwise adhere to the terms, investors may begin an eviction as early as two months from the time of default. (See Minnesota\u2019s \u201c<a href=\"http:\/\/www.commerce.state.mn.us\/UCB\/30.4.1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Cancellation of Contract for Deed<\/a>\u201d form here (PDF). If you believe you have a countervailing claim, you\u2019ll have to go to court to try to protect your interests.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Obviously, it\u2019s better to successfully manage the payments\nand all the costs involved. But have a backup plan in case, at any point, you\ncan\u2019t. How many days do you have to leave the home in the event that you cannot\nkeep up your payments? These contracts tend to require a lump-sum or \u201cballoon\u201d payoff\nin a few years. Is your plan to apply for a traditional mortgage by then? Get\nyour credit score in shape for the application process well in advance!<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Pro tip:<\/em><\/strong> You might be able to sell your\ninterest in the contract for deed, unless the terms forbid it. &nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Companies Offering Contract for Deed Sales: Benefits and Risks<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There are reputable groups out there that use the contract for deed model. Some help struggling people get on track to homeownership \u2014 like <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"http:\/\/www.clclt.org\/what-is-a-land-trust\/\" target=\"_blank\">this group<\/a>, whose stated purpose is to obtain property and remove it from \u201cthe speculative, for-profit,\u00a0real estate market.\u201d Collaborating with nonprofit entities, homeowner assistance groups may use the contract for deed as one <a href=\"http:\/\/www.clclt.org\/responsible-people-focused-contract-for-deeds\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">method of helping people of limited means<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now, what about the for-profit market? Proceed with caution,\nand the knowledge that a contract for deed lacks many of the formalities and\nprotections supplied through the conventional sale process. Research the\ncompany. Watch for people who take the buyers\u2019 installment payments but don\u2019t\npay mortgages on the homes. Scam sellers deliberately fail to pay mortgages, so\nthe homes go into foreclosure, and the buyers lose their homes and all the\nmoney they paid into them by that point.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are plenty of less extreme but still troubling abuses. In June 2020, the <a href=\"https:\/\/www.consumerfinance.gov\/about-us\/newsroom\/cfpb-settles-companies-engaging-deceptive-acts-practices-violating-credit-reporting-rules\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Consumer Financial Protection Bureau<\/a> settled a case against several companies that collected foreclosed homes and sold them using the contract for deed model. When buyers questioned the inaccurate details that started appearing in their credit reports, the companies refused to investigate or help. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In some areas, investors use contract for deed sales to get\naround landlord-tenant law. Cities and even states have confronted this, and acted\nto protect buyers in various ways. For example:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>In Texas, under the state property code and the Deceptive\nTrade Practices Act, sellers must give buyers proof of tax and insurance coverage,\na current property survey, and a disclosure notice involving many issues \u2014\nabout utility services, other people\u2019s claims on the property, and the detailed\ncontractual terms \u2014 before an agreement can be signed.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Minneapolis and St. Paul require the seller to\nproduce a Truth in Sale of Housing report for the buyer, disclosing the results\nof a home inspection. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>In Trumbull County (Warren, Ohio), a new service offered by the recorder of deeds is <a href=\"https:\/\/www.tribtoday.com\/news\/local-news\/2020\/08\/new-fraud-detection-service-helps-with-land-contracts\/\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">AlertMe<\/a>. Buyers can register to get emails telling them their contracts were actually recorded in the county. That makes it harder for sellers to take out loans on contract for deed homes without informing the buyers. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Our Key Takeaway<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Both seller and buyer must know exactly what\u2019s in the\ncontract and why, and the seller should clearly set forth the contract\u2019s terms\nin the parties\u2019 purchase agreement.
