You\u2019ve bought a home. You walk away from the\nclosing table in triumph, a pile of documents in your arms. OK, so what are the\nkey documents, how do you keep them, and when will you need them? Let\u2019s look over\nthe documents.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Buyer-Agent Agreement? Check.<\/h2>\n\n\n\n<p>When you hired your agent, you forged an agreement so you\u2019d\nhave a representative to help you find and buy your new home. This agreement\nwith your agent sets forth the terms of your relationship, including how long\nthe agreement exists between you. It spells out whether your agent served as your\nexclusive representative, whether the seller was paying the agent\u2019s commission,\nand what cancellation terms you had. &nbsp;<\/p>\n\n\n\n<p>Hold onto this document through and after closing, until after\nits term of days runs out, and when you are sure you have no issues with your agent\u2019s\nrole in your purchase. (If your agent was fabulous, leave a good online review!\nIt will help the next hopeful home buyer, and it\u2019s the best thank-you note you\ncan give.) <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Purchase Agreement? Check.<\/h2>\n\n\n\n<p>Did the seller accept your offer? Your agent will give you a\npurchase agreement \u2014 your contract for the deal. It identifies, and is signed\nby, the seller and buyer. It includes the sale price, closing date, and terms\nsurrounding the sale. When you signed it, you put your earnest money into\nescrow. The title company transferred that deposit to the seller when all\nconditions and contingencies of the agreement were met\u2026 and the deal went\nthrough! <\/p>\n\n\n\n<p>The escrow instructions, addenda and riders may reflect\nconcessions made between the parties, amending the terms of your agreement. If,\nfor example, the inspection found obsolete or unsafe electrical outlets, and\nthe seller agreed to replace them before you took the keys, your agent may have\nformally modified your agreement with an addendum describing the work, and any\nneed for a permit or a licensed and insured contractor. Discussions on repairs\nmight work as addenda, so hold onto your communications. Request and keep\ncopies of permits and invoices. You might need them if it turns out that something\nhas not been done properly and as specified in your agreement. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Inspection Report? Check.<\/h2>\n\n\n\n<p>The&nbsp;home inspection report is a keeper. Why?<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>It helps you decide whether to buy this\nparticular home \u2014 because your purchase agreement is likely contingent on the\nhome\u2019s physical condition. If the inspection report comes back with unacceptable\nproblems, the inspection contingency provision in your purchase agreement\npermits you to withdraw from the deal. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>If you want to buy the home despite a few\nissues, the report helps you and your real estate agent decide what work the\nseller should perform before closing, or if the price should come down. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>The inspection report serves as a checklist to guide\nthe work that will later be needed on the key systems and features in your new home:\nplumbing, vents, heating and cooling, and so forth. This, in turn, helps you memorialize\nthe maintenance and repairs you\u2019ve done when, one day in the future, you\ntransfer this home to its next owner.<\/li><\/ul>\n\n\n\n<p>For all these reasons, as a buyer, you should be familiar\nwith the inspection report, use it in negotiations with the seller, and refer\nto it as you preserve the value of the home for years to come. <\/p>\n\n\n\n<p><strong><em>Pro tip:<\/em><\/strong> If you buy a home with a septic\nsystem, get a septic testing report done in addition to your standard inspection,\nso the seller will need to handle repairs under the inspection contingency.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Appraiser\u2019s Report? Check.<\/h2>\n\n\n\n<p>An appraiser sizes up the home in detail, inside and out,\nand does research on the recent sale prices for comparable homes in the same\narea. You\u2019ll likely get an electronic copy of the report you can save forever.\nYou\u2019ll be able to refer to the photos of the main features of value,\ndescriptions of the condition of each feature, and any issues the appraiser\nmight spot.<\/p>\n\n\n\n<p>If your purchase agreement contains an appraisal contingency,\nyou need not go through with the purchase if the home\u2019s appraisal value is\nsubstantially less than your agreed-upon price. If the appraisal turns out as\nexpected, place a copy on a flash drive and keep the copy with other important\nhome documents. Referring to it will help you keep track of the property value,\nand future upgrades and repairs.<\/p>\n\n\n\n<p><strong><em>Pro tip:<\/em><\/strong> Never throw away home improvement\nreceipts. Take before-and-after photos. Documentation of the extent and cost of\nan upgrade or appliance can come in handy later, to show added value should you\nlater decide to sell your home.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Warranty and Insurance? Check.<\/h2>\n\n\n\n<p>Your seller might have covered a home warranty&nbsp;plan as\npart of your negotiations. It identifies your policy number and the number to\ncall for repairs, as well as what&#8217;s covered, if you\u2019ll need to make a co-pay,\nand so forth. Keep it with your homeowner&#8217;s insurance policy and make sure your\ninsurance is on automatic debit so your coverage never lapses. If you ever need\na copy of your policy, simply ask your insurance agent to send you a portable\ndocument file (PDF).<\/p>\n\n\n\n<p>Along with this documentation, hold on to your title\ninsurance policy. It states your choice of <a href=\"https:\/\/www.deeds.com\/articles\/hows-your-property-vested-it-matters-as-much-as-your-will-or-trust\/\">vesting<\/a>\nand coverage details, and may be needed if anyone claims an existing interest\nin, or a lien against, your home.<\/p>\n\n\n\n<p>Here we must differentiate between the\nlender\u2019s&nbsp;title&nbsp;insurance policy and an owner\u2019s policy. The latter protects\nthe buyer in case there are undiscovered clouds on the title. The federal government&nbsp;<a href=\"https:\/\/www.consumerfinance.gov\/ask-cfpb\/what-is-owners-title-insurance-en-164\/\" target=\"_blank\" rel=\"noreferrer noopener\">urges<\/a>&nbsp;buyers to get their own policies, in\norder to guard against the risk of having to clear their titles from\nencumbrances ordinary title searches can miss. Titles can&nbsp;have everything\nfrom small errors to <a href=\"https:\/\/www.deeds.com\/articles\/category\/deed-fraud\/\">deed fraud or forgery<\/a> in\nthe chain of title. <\/p>\n\n\n\n<p>Keep your insurance policy documents at least as long as you\nown the home. You might have a future need to find your agent\u2019s contact\ninformation, your account number, and the details of your coverage.<\/p>\n\n\n\n<p><strong><em>Note:<\/em><\/strong> If you buy your primary residence in Iowa, up to $500,000 in home value is <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/iowatitleguaranty.org\/Public\/ResourceDesk.aspx?ReturnUrl=%2f\" target=\"_blank\">protected by Iowa Title Guaranty<\/a> for you already at\u00a0no extra charge. Nice perk, Iowa! <a href=\"https:\/\/iowatitleguaranty.org\/Public\/ITGRateSheet.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\">Check your rates [PDF] here<\/a> if your Iowa home costs more than $500,000.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Real Estate Disclosure Statement? Check.<\/h2>\n\n\n\n<p>Sellers must disclose information about the home\u2019s history that\nmight impact its fair value. Real estate disclosure statements tell you about\nrenovations done without permits, repairs needing to be done, planned development\naround the home, any history of property line disputes, lead paint, liens on\nthe property, and so on. State and county laws on required disclosures vary.\nCalifornia has especially strict disclosure standards and documents, and also\nrequires a pest inspection.<\/p>\n\n\n\n<p>Buyers must sign off on all disclosures and reports. If\ndisclosures contain any dealbreakers, the buyer may withdraw from the deal. Sellers\nwho are on the ball will save everyone that anguish and just let buyers know\neverything they need to know up front. If major problems crop up with your home\nafter you move in, you\u2019ll need these disclosures in order to take action\nagainst the seller for any failures to notify. Save them for at least ten years\nafter your home purchase. <\/p>\n\n\n\n<p><strong><em>Important:<\/em><\/strong> Unapproved repairs and renovations may\nbe dangerous, and may subject sellers to legal responsibility.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Mortgage and Closing Documents? Check.<\/h2>\n\n\n\n<p>Your mortgage (or <a href=\"https:\/\/www.deeds.com\/articles\/what-is-a-deed-of-trust\/\">deed of trust<\/a>,\ndepending on the common practice in your state) represents the lender\u2019s interest\nin your property. You keep the promissory note \u2014 your promise to pay back a\nmortgage loan according to its terms. The lender has filed your mortgage lien with\nthe county in which your home exists, and your title company also kept a copy.<\/p>\n\n\n\n<p>At closing, you\u2019ll receive a statement&nbsp;that tallies up\nall charges, refunds, and credits related to the home sale, escrow account, and\nmortgage. Your&nbsp;mortgage company prepared your closing\ndisclosure&nbsp;(CD), which breaks down your mortgage and closing costs, three\nbusiness days or more before closing. Keep all this paperwork throughout the\nlife of the loan. If you ever need certified copies, contact your closing\nagent. Here again, if you make your loan payments every month by automatic\ndebit, you\u2019ll keep your payment record in great shape, and have no need to\ncollect paper statements. All account information is online, at your loan\nservicer\u2019s website.<\/p>\n\n\n\n<p><strong><em>Pro tip:<\/em><\/strong> When making your first annual tax\nreturn appointment with your accountant or tax preparer after your purchase,\nask what to bring to the office. You will need your annual mortgage statement,\nand possibly certain closing documents (such as documentation of points you\npaid at closing) and receipts for any home repairs, energy-efficient upgrades,\nor medically necessary accommodations.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Deed? Check.<\/h2>\n\n\n\n<p>Your deed is the written, signed legal instrument that\nrepresents the title transfer from seller to buyer, and proves you own your\nhome! It shows how your property ownership is vested, and sets forth the full\nand accurate&nbsp;<a href=\"https:\/\/www.deeds.com\/articles\/the-importance-of-a-legal-description-in-a-real-estate-deed\/\">legal\ndescription<\/a>. After you buy your house, the county will record the\ndeed and send it to you. Keep the original in a portable safe, as discussed\nbelow. Your house deed is one of the most important documents you have. &nbsp;<\/p>\n\n\n\n<p>If you need to retrieve your deed and cannot find it, some counties\nmake property records available online.&nbsp;You can also <a href=\"https:\/\/www.deeds.com\/copy-of-your-deed\/\">get a copy\nof your house deed<\/a> through this site. <em>Deeds.com<\/em> can pull the\nmost recent deed for most properties within minutes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Documents Down the Road: After Your Mortgage Payoff<\/h2>\n\n\n\n<p><a href=\"https:\/\/www.deeds.com\/articles\/youve-paid-off-the-mortgage-what-happens-now\/\">Paid\noff your mortgage<\/a>? Again, congrats! It\u2019s time to call your county\nrecorder\u2019s office to see that the mortgage has been released and your house is\nlien-free. Depending on the state\u2019s rules, your lender may mail you your\noriginal promissory note, marked PAID, and you&#8217;ll receive a certificate of\nsatisfaction (release). Hold on to these documents. &nbsp;<\/p>\n\n\n\n<p>Next on the list? Update your homeowner\u2019s insurance to remove\nthe lender from the policy, and show your name as homeowner and your bank\naccount as the payment source. Be sure you\u2019re now paying property tax if your\nlender was previously paying it out of your escrow account. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Storing Important Documents<\/h2>\n\n\n\n<p>Don\u2019t sweat if you\u2019re not immediately organized. It\u2019s OK\nthat you got home from closing and stashed everything in a drawer \u2014 as long as\neverything\u2019s together, and easy to locate. But do mark your calendar and take a\nday to organize and protect your key paperwork.<\/p>\n\n\n\n<p>Hurricanes, coastal floods, and fires in recent years might have\nyou wondering about portability as well as safekeeping for your documents. There\nare briefcase-sized, portable, fire-resistant safes perfect for storing your\nmost important papers, including documents with original signatures or\ncertified copies. Consider shopping for a fire-resistant, locking briefcase \u2014\nthis can be found by doing an online search for the phrase \u2014 and using it for\nthe critical documents, such as the deed to your home. <\/p>\n\n\n\n<p>Replaceable papers can go into sheet protectors in a\ndedicated file drawer: the purchase agreement, mortgage paperwork, closing documents\nand receipts. Back these documents up by getting a scanner app and placing them\non a flash drive as well as keeping a secure, cloud-based backup. Store\ndocuments in a place away from the kitchen, and accessible if you are quickly\nleaving the house. What about a safety deposit box? If you\u2019re concerned about\ntheft, that might be your answer; just keep in mind these boxes can defeat your\npurpose if no one knows or recalls where the box or key is after you pass away.\n<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">And There You Have the Basics. <\/h2>\n\n\n\n<p>Even if you\u2019ve owned your home a while, it\u2019s a good idea to take stock of what you\u2019ve stashed away, and be sure it\u2019s digitally copied, organized, and securely stored.
