This form is typically used when the deceased did NOT leave a will or estate plan. The Affidavit of Heirship is a sworn statement used to establish the heirs of a property, with a goal of putting the property in their name. Sometimes this form is used to bypass probate when the deceased left a will that leaves the property solely to the direct descendants of the deceased or when 4 years have passed since the death of the owner, the general time frame to probate a will in Texas. An Affidavit of Heirship can be filed anytime. An Affidavit of Heirship alone does not transfer property title. It identifies the heirs of the property.

General parameters for a Texas Affidavit of Heirship document:

No valid will, or if beneficiaries and/or heirs agree to disregard the will.
Only real estate needs to be transferred to heirs.
The deceased does not have any debts.
No administration of estate required.

Easy to follow directions and instructions to properly and legally fill-in the Deed that I requested. It was also very easy and convenient. If I was going to employ an Attorney or Legal Documents Preparer, they would easily charge me between $150 to $225 a Deed! For the cost of $19.97, anyone would pursue this price! Thank you, Deeds.com for a wonderful and terrific experience! I'm going to need you again to change Titles for my other Investment Properties.

Was looking for information and forms relating to a trust my parents created, but what I purchased seems geared toward trusts containing real estate only, which is not what I needed. It was very easy to order,download, and print. The only issue I have is that the guide that came with my form really did not help me filling it out. I feel the explanations could have been better and suited more for the standard person. I was still confused when filling it out and will probably have to get a lawyer to make sure it's filled out correctly

I am a litigator based in Lee County that rarely needs to record deeds or mortgages. However, at times, the settlement or resolution of a dispute results in the conveyance of real property. I ended up in a situation where a deed to real property in Bradford County needed to be recorded on behalf of a client. My usual e-recording vendor does not include that County. Registering with Bradford County's regular e-recording vendor would have required an expensive and unnecessary annual fee.

Deeds.com was easy to use, inexpensive and fast. I highly encourage its use, especially for lawyers that occasionally need to record instruments but do not do so regularly.
