This form is typically used when the deceased did NOT leave a will or estate plan. The Affidavit of Heirship is a sworn statement used to establish the heirs of a property, with a goal of putting the property in their name. Sometimes this form is used to bypass probate when the deceased left a will that leaves the property solely to the direct descendants of the deceased or when 4 years have passed since the death of the owner, the general time frame to probate a will in Texas. An Affidavit of Heirship can be filed anytime. An Affidavit of Heirship alone does not transfer property title. It identifies the heirs of the property.

General parameters for a Texas Affidavit of Heirship document:

No valid will, or if beneficiaries and/or heirs agree to disregard the will.
Only real estate needs to be transferred to heirs.
The deceased does not have any debts.
No administration of estate required.

(Texas Affidavit of Heirship Package includes form, guidelines, and completed example)

Great examples on how to fill out the quitclaim deed, but no info on how to fill out the cover sheet.

I purchased a Warranty Deed "package" on Friday and found that the Main download was a working document, but the secondary document (which is required) was not. In other words, I was able to use the fill-in feature on the main document, but not on the second document. I used the portal on the website to report my issue the same day. That was Friday. This is Wednesday. I have not heard a word from them and I have to use my documents in 2 days. I will probably have to resort to pen and ink for that document, but I have already tried filling it out twice and have to keep reprinting and starting over. You can't white out or cross out. I would really prefer to have the complete service that I paid for.

Thank you for your feedback. As is noted on the site, supplemental forms are provided as a courtesy with your order. They are not our forms, we did not create them. They are created and provided by the jurisdiction/agency that requires them. Have a wonderful day.

Forms were spot on and able to save over $100 by not going to an attorney to complete the same documents. There were templates on how forms are supposed to be completed. You just need a notary to sign.

Being a first timer, I was hesitant at first to use the service. I was genuinely surprised at how easy it is to set up an account, upload my document, and pay the invoice. The next day I downloaded my document duly recorded. Good work, guys!

Wow, great forms. They do have some protections in place to keep you from doing something stupid but if you use the forms as intended they will work perfectly for you.

I needed to file an affidavit of succession. I downloaded the forms and filled in the blanks. The instructions and example sheet were very helpful.
I got the paper recorded with the county today and all went smoothly.
Good product.

I downloaded the quit claim deed form and saved it on my computer. I opened it with Adobe and filled it out. The space for the legal description was too small (2 lines only) which did not allow enough room for the long property description that I had.
