Deeds of Trust are the preferred method of securing debt on property in Colorado, if the Deed of Trust includes a proper power of sale clause the lender can pursue a public trustee foreclosure in the case of default. The borrower pre-authorizes the sale of property to pay off the balance on a loan in the event of the their default.
("Deed of trust" means a security instrument containing a grant to a public trustee together with a power of sale.) ( 38-38-100.3(7))
A promissory note is a promise to pay and includes things such as interest rates, default rates, late fees, penalties, etc. The Deed of Trust makes the promissory note a debt secured by a lien on the subject property. In Colorado a promissory note must include the loan amount, payment schedule and time frame. Both borrowers and lenders must sign.

After some initial general confusion -- (we sold a small piece of land privately and therefore do not typically prepare such documentation (!)) -- we were able to purchase and download all forms from Deeds.com and understand how to complete it/them. The help is all there, we just needed to read and study it - the "Example" helped alot. We were able to complete the Document per your online form(s) and then take it to be signed/notarized - and take the completed paper document to the Registry -- and it is now all registered and we are All Set. rn Took the morning (only). AMAZING! Easy to use, reasonable fee - and get MUCH MORE than just a deed form. I ordered a "deed" and received a whole "package," including a guide and the jurisdiction's costs schedule and cover page that would be needed to record the deed - even included a Certificate of Transfer that is not required for a deed but something I needed for a different transaction. The website was extremely easy to use and the cautions about not disclosing personal information were so clear and personal, they made me feel secure in knowing this site was not trying to rip me off. I filled out the Xfer on Death Deed and turned it in to the County Recorder - everything went well. I did NOT like the Huge Print over like a stamp of "DEEDS.COM" on some of the material - it just made it hard to read.
