A warranty deed in Colorado can be used to facilitate a conveyance of real estate in fee simple. The Colorado Revised Statutes, section 38-30-113, provide a short form for a warranty deed with covenants on the part of the grantor. The use of the phrase "warrant the title" in a warranty deed implies the following covenants from the grantor to the grantee, his heirs, and assigns: (a) That at the time the instrument was made, the grantor was seized of an indefeasible estate in fee simple in and to the property described in the deed and has good right and full power to convey the same; (b) That the property was free from all encumbrances, except as may be stated in the instrument; and (c) That the grantor warrants to the grantee, his heirs, and assigns the quiet and peaceable possession of the property and will defend the title thereto against all persons who may lawfully claim the same (38-30-113).
A warranty deed must include the grantor's signature, which should also be acknowledged. If executed in Colorado, a warranty deed can be acknowledged or proved before any of the officers listed in 38-30-126. Section 38-30-126 also lists the officers authorized to perform acknowledgements if the deed is executed out of state. No officer authorized to take acknowledgments of deeds should take or certify acknowledgements unless the person making the same is personally known to the officer to be the person he is stated to be in the deed or is proved to be such person by at least one credible person known by the officer (38-35-101).
The recording act in Colorado is a race-notice recording statute. An unrecorded warranty deed is not valid against any person with any kind of rights in or to such real property who records first and those holding rights under such person, except between the parties to the deed and those having notice of it prior to the acquisition of such rights (38-35-109). Warranty deeds should be recorded in the office of the clerk and recorder in the county where the property is located in order to provide constructive notice of the contents.

The service was prompt and attentive to my questions. I would've just appreciated a heads up that I also needed to contact the county directly (and provide contact info) to receive a certified copy of the document (Notice of Commencement) in order to submit the certified copy to the Building Department. This was an extra step that I haven't had to complete before using another eRecording service. Even if this extra step is a result of the county's system. I would still have expected a head's up (since there wasn't any info regarding this on the county's site for eRecording).

Highly Pleased- Strongly Recommend Deeds.com Long review... sorry:-) Originally I was very skeptical due to the enormous amount of the scams going on now days and the number of online sources that "claim" to provide you with deed forms for free or for a few. Nothing that you need and want done is free. There is always a cost. So luckily I came across deeds.com. This was the only site that appeared to be simple, to the point, and made no crazy promises. So before selecting this site, I did a little more checking around/price checking to ensure I am getting the best price for the product I needed. I even checked Staples and Amazon to find that they do indeed sell these forms but I do not think the products they provide are specific for my state and county. They claim their forms provided are for all states but my state is specific and I prefer to have forms provided by Deeds.com that is based on Indiana statute that Deed.com clearly identifies on each form. Deeds.com price of $20 seemed a little high at first but when I saw the products provided, the $20 cost is more than reasonable and fair. You not only get the deed form specific for my state and my specific "county" but also the other various/supplemental forms that may be required. Being familiar with my state and knowing how tedious and anal my state is on everything, I was pleasantly please to see the info and extra supplemental forms provided. For example, a person new to the State who recently had property deeded to them, would not necessarily know about the Homestead tax exemption provided if property is your primary residents, over 65 exemption etc. I would highly recommend this site for anyone needing these documents because Deeds.com has you covered on any and all forms/info you could ever need! A bonus is that there is one flat fee and not monthly cost that you have to worry about canceling later unless you superficially select a monthly package. I love the fact that Deeds.com is nothing fancy. There is not a bunch of elaborate graphics etc. They only provide what you need and what they provide is very accurate. Deeds.com has a customer for life.

You charge too much for a form. Your business model is shortsighted. I would not try to use your service again. You got $20 from me this once, but I would try very hard to not use your service again. Your model does not encourage serial or professional usage.
