Commonly, when people create their wills, they identify one or more individuals to supervise the distribution of their assets. The person who fills this role is called an executor. An executor uses an assent to devise to transfer real property from the decedent's estate to beneficiaries named in the decedent's will.
Under Georgia law, "title to property in the estate does not pass to the heirs or beneficiaries until the personal representative assents thereto" (OCGA 53-8-15).
Record the completed assent to devise, along with any necessary supporting documents, with the real property records of the appropriate county. This shows that the executor assents to the passing of title from the decedent to the beneficiary.

I'm transferring a property into a trust and ordered the QuitClaim Deed. Everything was pretty straight forward and user friendly. However, the Additional Information/Instructions for the Preliminary Change of Ownership Report skips from Section "I" to "M" and does not address "K". It would have been very helpful to have an explanation of the difference between the three options in that section. Thank you.

The forms are nice; however, they do not display the "th" after the day or the second digit of the year. You can type them in, but they will not print out. I just left them blank and will handwrite.

My sale is a land contract and it is complicated. We were thinking we'd have to get an attorney. Your site is very thorough and helpful. It was frustrating to get the scans done but that might have been due to a learning curve. After 4 tries they were accepted. I couldn't figure out how to delete or close the failed attempts. Waiting to see if Recorder office has changed the title.
