The Idaho trustee's deed conveys property out of a trust. This type of deed is named for the person executing the instrument rather than the type warranties it contains. The trustee's deed is a modified fee simple deed, and contains only the covenants stated in I. C. 55-612.
The deed names the trustee as the grantor and the name and date of the trust under which the trustee is acting. A certificate of trust under I.C. 68-115 is sometimes used in conjunction with transactions by a trustee.
As with all instruments of conveyance in Idaho, the grantee's full name and mailing address is required in the granting clause (I.C. 55-601). To delineate the specific parcel conveyed, the legal description of the real property must appear on the conveyance. All acting trustees need to sign the deed in the presence of a notary public before it is submitted for recording in the county in which the real property is situated.

$40 is an excessively expensive price for this very simple form, especially since I couldn't view it before purchasing. I did successfully register the TODD at my county clerks office, although I wasn't certain it would be accepted given the notary format was on a separate page. Knowing what I know now, I would have formatted a form on my computer and filled it in with a pen. The background materials were superfluous and in my case, didn't add value.
David, we’re glad you successfully recorded your deed using our form. The value of a DIY package is not measured by how complicated the finished document looks or how easily it could be recreated on a computer. It provides a prepared form and supporting information rather than requiring you to research and draft a document from scratch. My E-deed was not excepted by the county, so I had to snail mail the documents to the recorders office. Will probably not use this site again, as it did not fulfill my purpose, but would recommend to those who do not have complicated forms.

The TODD form has been notarized and registered with my county Register of Deeds office, so it works just fine. My only quibble is that when I printed it out, it missed part of the last line of the notary's info and the fine print in the bottom corners. When I printed it at 90% scale, it included those things.
