This form may be used by the current mortgage holder or representative to release a mortgage that is paid in full.
To avoid penalty the (mortgagee)/lender, (his or her executor or administrator, heirs and assigns), generally has (30 days) to file the release (after the payment of the debt secured by such mortgage) (765 ILCS 905/4)

Sec. 3. An instrument in writing which releases a mortgage or trust deed of real property may be acknowledged or proved in the same manner as deeds for the conveyance of land.

If the release is delivered to the mortgagor or grantor, it must have imprinted on its face in bold letters at least 1/4 inch in height the following: "FOR THE PROTECTION OF THE OWNER, THIS RELEASE SHALL BE FILED WITH THE RECORDER OR THE REGISTRAR OF TITLES IN WHOSE OFFICE THE MORTGAGE OR DEED OF TRUST WAS FILED".

Deed.com is an amazing site. After calling many places and going on many websites to figure out what I needed to submit (most counties cannot help with questions and the place I needed to turn the documents into could not help either, they are not allowed to give legal advice) I came across Deeds.com. It has been so helpful and I was able to research what documents I needed. I purchased one document and after more research I realized I needed a different document. Deed.com refunded my first purchase. I then purchased an Affidavit of Death and a Deed for the county and state I needed them for. It was easy to download the form I wanted BUT there were 2 other options listed for "open/download." I didn't want to risk more charges for something I couldn't determine I needed so I passed them up. There were a few others listed with the option to "view" so I did that, without down-loading, and there were no additional charges. I would've liked that opportunity for 2 others that didn't offer "view" so maybe deeds.com missed a sale?

Very helpful, with blank and sample completed documents. The only thing I was confused about was the "legal description" of my property. The documents weren't too helpful on what that meant. Otherwise they were great. It saved me $200 to prepare these myself.
