Married couples in Indiana may hold title to real estate as tenants by the entireties. This means that when one spouse dies, the other gains full ownership of the property by function of law, and without the need for probate. Use this instrument to formalize the acceptance of ownership rights conveyed when a spouse dies. Complete and sign the affidavit and submit it, along with a certified copy of the decedent's death certificate, to the recorder for the county where the real estate is located.
In order to gain full ownership, the husband or wife submits a completed affidavit of surviving spouse, along with an official copy of the death certificate of the deceased spouse, to the recorder for the county where the land is located.
This does not, however, remove the deceased's name from the deed. To accomplish that, the survivor must execute and record a new deed from the married couple to the remaining spouse only. After completing this final step, the public record and current deed will contain the most up-to-date information.

Laborious process to gain access; need to indicate PRIINT when complete and inform that if page is backspaced, entered info disappears, necessitating starting all over again. There is only one “A” provision, when some documents have several more. Space is too limited in some instances to provide what is necessary for recording. Thank you

It all started out well, then I was abruptly told that I would have to submit the documents directly to the recording office. No explanation was offered and I wasted a lot of time on your website for nothing. Very disappointing, as the concept of e-recording is what is needed in 2026.
We reviewed your order and our support messages. The document uploaded for recording was a very low-quality scan that did not meet the county’s eRecording image requirements. Our staff asked that a clearer scan be uploaded, but the same image was submitted again.
Because the document could not be processed electronically, we advised recording it directly with the county recorder’s office.
E-recording systems require clear, legible document images that meet county standards. When those requirements cannot be met, recording directly with the recorder is often the fastest option.
