An affidavit of descent (alternately, affidavit of heirship) under KRS 382.120 establishes a source of title for a grantor who is transferring property he or she acquired from an intestate estate.
The affidavit must be filed before the grantor can record a deed conveying the subject property. Pursuant to Kentucky statute, the affiant (person making the sworn statements contained within the affidavit) may be the grantor or any one (1) of the heirs at law or next of kin of the ancestor of the grantor, or of two (2) residents of the Commonwealth of Kentucky.
The affidavit must recite the ancestor's name, date of death, and place of residence, as well as information regarding the ancestor's surviving spouse, if applicable. In addition, the affidavit must state that the ancestor died intestate (without a will), and contain a list of the names, ages, and addresses of each of the ancestor's heirs at law and next of kin, and include everyone's relationship to the ancestor and the interest in real property he or she inherited by the ancestor's death.
The affiant must sign the document before a notary public before filing in the office of the county clerk of the county wherein the subject real property is situated.

Great to have a downloadable form, rather than a cloud solution that gives no guarantee of privacy. Appreciated the sample.......but all of that still left me with open issues about how to tweak the form to serve my particular needs......for example: how to ensure that survivor rights were properly characterized; how far back I should go with the "Source" section + how I should layer my own additions to the chain of ownership, etc. Nonetheless, an overall happy experience. I was trying to register a financial statement (non real estate document). There was no link or statement on the home page to indicate that this could be done. All I had to do was to create an account, name and then upload the document. It took me over a day and several phone calls to the local deed recording office to try to figure this out. A simple link or statement to this effect would have saved me a lot of time

My rating is not a 5. Although it had good instructions, it would NOT print the whole document no matter how many times I inputted the names. I ended up writing it in to complete. I also recommend putting it on one page. I had to pay an additional fees per page and if I had to notarize it, why did I have to find 2 witnesses as well. I deserve a discount for the time I spent repeatedly putting the same data. I was trying to save money since Im on social security only. It didnt. Get it to work correctly

Really solid system for determining what may prevent your documents from being accepted. I love the comments section allowing for fluid communication. I only wish there were automated emails for all those communications and once documents were accepted, but I did receive a couple personally-generated emails regarding the progress instructing me to check the site.
