Under the Kentucky Revised Statutes, the beneficiary of an interest in property may renounce the gift, either in part or in full (KRS 394.610 to 670). Note that the option to disclaim is only available to beneficiaries who have not acted in any way to indicate acceptance or ownership of the interest (KRS 394.640)
The disclaimer must be in writing and include a description of the interest, a declaration of intent to disclaim all or a defined portion of the interest, and be signed by the disclaimant (KRS 394.610 (2)).
File the disclaimer within nine months of the transfer (e.g., the death of the creator of the interest) to the District Court of the county in which proceedings have been commenced, or could commence, for the administration of the estate of the deceased. Also, deliver a copy of the disclaimer to the personal representative or any other fiduciary of the decedent or donee. In the case of real property, record a copy of the disclaimer in the office of the county clerk of the county in which the real estate is located (KRS 394.620 (3)).
A disclaimer is irrevocable and binding for the disclaiming party and his or her creditors, so be sure to consult an attorney when in doubt about the drawbacks and benefits of disclaiming inherited property. If the disclaimed interest arises out of jointly-owned property, seek legal advice as well.

Deeds.com recorded documents for me without any issue. It's a good service and provides a lot of assistance on its web site. However, I asked for a printed receipt (i.e. an pdf copy of one), but after a staff provided me with an obvious answer, they simply ignored my follow up requests. I also asked a simple formatting question that they should have been able to answer; instead, they passed the buck and referred me to the recorder, which currently is a very time-consuming venture. They also have no telephone number for any issue. Generally, the service saves me the time and effort of physically recording a document, but when you think about $19.00 per recording seems like a steep price for the services rendered.

I liked getting the forms but I was charged twice for some reason. I'm not sure what happened with that. Can you reimburse me? Thank you. Lanette
Thank you for your feedback Lanette. In review, it looks like your first payment was declined, second one was approved and processed. What you are seeing is one payment and a hold placed by your financial institution for the declined attempt. We are not sure why they do this but the hold usually falls off after a few day depending on their policy. The form itself was very good and easy to use. The only problem I had was the Sample they provided. Using a different name in every spot doesnt help determine what goes where. Using "Theodore Rockafeller" as Lien Claimant in one spot and Jebediah Finklestein in another then Harvey Johnson in the last spot is confusing if you really need a helpful sample.

I was disappointed in the form received. The language was not clear and for the price, one would think we would receive a Word version rather than a PDF.

Form needs to be gender neutral. Also, while the format prompts for the correct information to be included, more of the form needs to be open for editing and to eliminate unnecessary spacing.
