An executor's deed is a fiduciary instrument used in estate administration to transfer real property pursuant to the terms of a will and/or laws of descent. An executor is a personal representative who is named in a decedent's will to administer the decedent's estate.
Use an executor's deed to convey interest in real property to a grantee with a special warranty. This type of warranty affirms that, while the grantor/executor controlled the property, she never acted in a way to change the status of the title.
In addition to meeting state and local standards for real estate deeds, executor's deeds also include details about the decedent's probate case. A court order for sale is required before a transfer can be made, unless the decedent's will specifies a power of sale. Supporting documentation, such as an affidavit of real property transfer under KRS 382.135(4), is required before an executor can record the deed in the office of the county clerk.

I am an attorney who was trying to draft some deeds in arizona. The deed templates coupled with the document instructions saved me hours work. At 1st I was skeptical, so spent hours figuring out how to draft the documents, but could have saved so much time If I had just spend the $20 sooner. Was driven to this site by the county website. It took a bit of work having to create an account, etc. The example was useful; however the example only showed both parties in the same county, nor did the instructions mention anything about differing counties. This caused an oversight on my part.

Not knowing I could down load these forms, I first went to the local recording office thinking I could get info on the forms I needed. I was told that obviously you dont know what you are doing so find someone who does. This snippy clerk obviously didnt know the forms were accessible on line; either that or she was needing to feel her phony superiority.

In Colorado a Release of a Deed of Trust without the original note must be efiled - the Recorder said it had to be Simplifile or CSC Global neither of whom are designed to do a 1 off filing (you have to subscribe). Fortunately, I found Deeds.com - they were great. helped me work through a couple clerical issues and it is done. I am so happy and pleased. I would give them more stars if I could. I will spread the word among the realtors and title companies who couldn't help that there is a better option.
