This form is used for the SALE of real property. The principal designates an agent and empowers him/her to act in all necessary legal documents and instruments for the sale of a specific Kentucky property. This form includes a "Special Instructions" section where you can further limit or define the agent's powers/actions.
This Limited Power of Attorney becomes effective upon its execution.
457.060 Validity of power of attorney.
(1) A power of attorney executed in this state on or after July 14, 2018, is valid if its execution complies with KRS 457.050.
457.050 Execution of power of attorney.
(1) A power of attorney must be signed in the presence of two disinterested witnesses by the principal or in the principal's conscious presence by another individual directed by the principal to sign the principal's name on the power of attorney. If signed in the principal's conscious presence by another individual, the reason for this method of signing shall be stated in the power of attorney.
(2) A signature on a power of attorney is presumed to be genuine if the principal acknowledges the signature before a notary public or other individual authorized by law to take acknowledgments.

457.100 Termination of power of attorney or agent's authority.
(1) A power of attorney terminates when:
(e) The power of attorney provides that it terminates

Very good information. Easy access and easy to download. All the forms needed for TOD to be notarized and recorded with the county office. Much better than working with a Trust and the expense of lawyers, especially when several parties are involved and the owner of said property knows exactly to whom the property should go. Having forms and instructions available for the public to have their wishes recorded and confirmed makes handling final planning much easier and prevents family members from having the unnecessary task of going through court to solve property distribution issues. I am so glad I found this resource! As the Executor of a family members estate I wanted to save money by bypassing a lawyer as it seemed pretty straight forward to tranfer a Life Estate to the remainderman. (I had original deeds). But talking with 3 different states and 4 different counties - none of which seemed to need the same documents, I was almost ready to dump this in a lawyer's lap. This resource makes it simple!

I didn't have any problem downloading and filling out the form on my computer and printing it yesterday. I didn't know what to put for "Source of Title". I called the county recording office; they didn't know either and said to leave it blank. I got the form notarized at my bank and took it in to the recording office. They checked it, accepted it, I paid a fee, and it's done. So easy. My children will appreciate that I've done this. Added note: You do have one typo on your form--you left out 'at'. It should read: "You should carefully read all information at the end of this form."

The beneficiary deed was acceptable to the county clerk and my notarized official deed was mailed to me. The Missouri-based deed met with official approval so all is well in the land that time forgot.
