This form serves as notice that the Seller has agreed to sell, and Buyer has agreed to buy a specific property. Record this instrument when a Contract for Deed, Land Contract or Buy-Sell Purchase Agreement has been completed. This is done for a variety of reasons.
When parties want the details of a contract to be kept private.
When the Seller doesn't record the original Contract, very important for the Buyer to record a Memorandum of Contract. It serves as notice that the buyer is in fact purchasing the property, providing protection from further liens or encumbrances being placed on the property by the Seller. Memorandums are frequently recorded by buyers alone.
When owner financing is involved, and a buyer needs to finance property at a later point in time, a Lending Institution will most likely require a recorded Memorandum document. Further, banks like to see a history of payments, at least 12 months, often referred to as "Seasoning" a recorded Memorandum proves the subject property was under contract at a specific time.

I'm transferring a property into a trust and ordered the QuitClaim Deed. Everything was pretty straight forward and user friendly. However, the Additional Information/Instructions for the Preliminary Change of Ownership Report skips from Section "I" to "M" and does not address "K". It would have been very helpful to have an explanation of the difference between the three options in that section. Thank you.

This was the first time I had ever had to fill out a Warranty Deed, so if it was not for your example form on how to fill one out, I would be still be here completely lost. I had originally gone to another site for a Warranty Deed & they wanted double the amount of your price & their website had no examples forms. I am so happy with your site & service. The process was not difficult but I don't think that it suited my needs. There were several fields that were not applicable to me but I had to enter something to proceed. I also filled out the other form and mailed it in with some documentation that the electronic service did not ask for. Questions of my attempt are still unanswered. I hope I didn't waste time with this process. We shall see. Thank you.

recently joined Deeds.com. still exploring the site. has been very helpful in providing local information for recording, such as fees and requirements. i am working to correct mistakes made within a deed. it is amazing how these municipalities operate outside the scope of Article 1, Section 8, Clause 17; to claim land is "in" the "State of ____. when the land is actually not ceded to the United States of America as for use for needful buildings. beware of the fraud perpetrated by Attorneys in the recording of your Deeds. Registration as "RESIDENTIAL" puts your private-use land on the TAX rolls with the use of that one word. i recommend this site as it appears there is information for each state and each county office. will update my review once i place an order.
