Questions answered? Let's get started!

A Maryland transfer on death deed by an unmarried owner who holds title alone has no spouse to account for and two tiers of beneficiary to fill: the primary beneficiary who takes at the owner's death, and the alternate who takes only if no primary beneficiary survives. This Maryland TOD deed, a beneficiary deed in common search language, is prepared for one owner who is an unmarried person and the sole owner of the property, under Real Property Article, Title 14, Subtitle 10.

Two tiers of designation, one owner

Section 14-1009(a)(2) sets the order at death: the interest passes to a designated beneficiary who survives the transferor; where that beneficiary does not survive and the deed provides for an alternate, it passes to a surviving alternate; and the interest of any designated beneficiary who fails to survive lapses. The deed carries both designation sentences of the Section 14-1011 form verbatim, the primary in Section 3 and the optional alternate in Section 4. Section 14-1009(a)(2)(iv) separately allows successive alternates, and the guide describes how the chapter's lapse rule and the Estates and Trusts anti-lapse statute sit beside the alternate designation.

Each tier receives a natural person, a trust through its trustee, or an entity by its registered name, with a mailing address where available. Where more than one primary beneficiary is named and the entry indicates no form of tenancy, the Act's own note, printed in Section 3, passes title to them as joint tenants with rights of survivorship under Section 14-1003(b)(2).

No spouse at the table

An unmarried owner's deed carries one signature line because Maryland law gives no one else a claim to sign: Estates and Trusts Section 3-202 abolished dower and curtesy, Maryland has no community property regime, and under Section 14-1007 the deed conveys nothing during life. Section 1 prints the configuration as fixed deed text: the owner named below is an unmarried person and the sole owner of the property. With no spouse when the deed is made, the surviving spouse's elective share that Section 14-1009(a)(1)(ii) applies at death has no claimant at that point. The Act looks ahead: Section 14-1009(a)(1)(iii) subjects the transfer to Estates and Trusts Section 4-105(b)(3), revocation by a subsequent marriage followed by a child, which the Act's informational sheet describes as automatic revocation, and a later marriage brings the elective share into view at death.

What this configuration recites

The form recites exactly one record owner, an unmarried person and the sole owner of the property, and carries one owner signature block with the (SEAL) notation the statutory form prints, one acknowledgment certificate in the State Government Section 18-216(b) short form with a reserved area for the notary's stamp, and the party certification of preparation that Section 3-104(f) makes a condition of recording, with a capacity entry for owner, primary beneficiary, or alternate beneficiary. A married owner holding title alone, two owners of any kind, a fractional co-owner, and a trustee, an entity, a personal representative, or an attorney-in-fact each present a configuration this deed is not set up as. An owner who has never married naming a sibling as primary beneficiary and a niece as alternate, a widowed owner naming an adult child with a grandchild as alternate, and a divorced owner titled alone naming the children with a sibling as alternate present the pattern this deed recites.

Recording while the owner is living

Recording is the condition of effectiveness under Section 14-1006: a deed left unrecorded at the owner's death transfers nothing, and the form prints the statutory warning at its head that the deed must be recorded in each county, or Baltimore City, where the property is located before the owner's death. A Land Instrument Intake Sheet accompanies the deed as its own form; under Section 3-104(g)(6)(ii) the clerk may refuse a TOD deed that arrives without one. An election district line serves property in Prince George's County under Section 3-104(f)(2). Where the property is the owner's primary or secondary residence, Tax-Property Section 12-108(ii) exempts the deed from recordation tax, with matching exemptions from State and county transfer tax; recording fees and the land records surcharge still apply.

The package includes the fillable transfer on death deed as a PDF, a completed example filled in for a Washington County owner naming a son as primary beneficiary and a granddaughter as alternate, and a plain-language guide that walks through each section, the acknowledgment, the preparer certification, and recording. The materials are informational and are not legal advice.

Of little use to me. I did not feel this really help me to do a Quick Claim Deed here in Minnesota on my own. All it showed me is what a complex mess it is to fill out this deed. That, unfortunately, I am going to have to hire a professional to make sure it is done right.

Glad to hear that you are seeking assistance Dennis, that's always best when one is not completely sure of what they are doing. Have a wonderful day.
