This form is executed by the current mortgagee named in the mortgage to (waive the priority of the mortgage in favor of another)(mortgage by executing a separate instrument acknowledged in the same manner as required for deeds and other instruments for the transfer of an interest in real estate. The waiver is effective to the extent of the mortgage waived.) When recorded (the waiver is constructive notice of the waiver to all persons dealing with the mortgage or with property described in the mortgage from the date the waiver is recorded.) Get Rid of the places to initial each page on the Trust Deed. The Co. Recorder (Davis) does not require that each page be initialled... If I and the "borrower" had initialed each page, then I would have to use US Mail to get the form from AZ to UT because scans of initials are not acceptable, but only a notarized signature from the borrower is...

Very good information. Easy access and easy to download. All the forms needed for TOD to be notarized and recorded with the county office. Much better than working with a Trust and the expense of lawyers, especially when several parties are involved and the owner of said property knows exactly to whom the property should go. Having forms and instructions available for the public to have their wishes recorded and confirmed makes handling final planning much easier and prevents family members from having the unnecessary task of going through court to solve property distribution issues. Would be nice to have a better description on how to complete the forms if it is separated couple and one is signing the deed over to the other. I am still unsure how it should be worded. Disappointed that the guide didn't have better explanations.
